PROJECT LOCATION: Robins Island, Town of Southold PROPERTY OWNER: Louis Bacon c/o James Thompson Architect 2 Lafayette Court, Suite ~2 Greenwich, CT 06830 APPLICATION DATE: April 28, 1994 PROJECT DESCRIPTION: o Reconstruct existing deteriorated 12'x 285' fixed timber dock. o Reconstruct offshore 6'x 64' "L" section with the installation of a wave curtain to protect docked vessels from North, Northeast and Northwest winds. o Reconstruct offshore 32' x 32' filled dock o Replace two 6'x 24' floats and add three additional 6'x 24' floats, with associated mooring pilings, for island visitors/government officials such as NYS DEC, Town of Southold Trustees, Nature Conservancy, Conservationists, emergency vessels, care takers, etc. o Install four 7-pile dolphins to safely berth ferry boat and/or supply barge. The purpose of reconstructing the deteriorated structure is to provide access and safe dockage for visitors, personnel, supplies and equipment vehicles for upland maintenance. The construction and design will provide a stabile structure during inclement weather and severe ice conditions. ~4-16-2 (2/87)--7c 617.21 Appendix A State Environmental Quality Review FULL ENVIRONMENTAL ASSESSMENT FORM SEQR Purpose: The full EAF is'designed to help applicants and agencies determine, in an orderly manner, whether a project or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent- ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that those who determine significance may have little or no format knowledge of the environment or may be technically expert in environmental analysis. In addition, many who have knowledge in one particular area ma,/not be aware of the broader concerns affecting the question of significance. The full EAF is intended to provide a method whereby applicants and agencies can be assured that the determination process has been orderly, comprehensive in nature, yet flexible to allow introduction of information to fit a project or action. Full EAF Components: The full EAF is comprised of three parts: Part 1: Provides objective data and information about a given project and its site. By identifying basic project data, it assists a reviewer in the analysis that takes place in Parts 2 and 3. Part 2: Focuses on identifying the range of possible impacts that may occur from a project or action. It provides guidance as to whether an impact is likely to be considered small to moderate or whether it is a potentially- large impact. The form also identifies whether an impact can be mitigated or reduced. Part 3: If any impact in Part2 is identified as potentially-large, then Part 3 is used to evaluate whether or not the impact is actually important. Thank you for your assistance in helping us to overcome all the obstacles associated with the'revisions and modification requests we experienced. Although, the overall functions of this dock facility are~::~.~ satisfactory, the northwest winds (gusting 35 - 40 m.p.h.) causes the incoming transient boats tocrash into thenorthside of the 6' x 24' floating finger docks or info,the sea~lane~flo~t.~The a~tempts~ t°'~ma~ever:-'ithe~boats'around~!~the 6 .x 20' fl6ats:is difficult ~ecause.the stron~'t~il windspr6Vents steerage and the-vessels are pushed into the shore. Knowing your- familiarity with weather conditions and 'doCking problems, I don't think it is necessary thatI over explaini~the problems at this site.~- : .- · . New Suffolk Permit ~4346 Dear Mr. Krupski: We would like to thank you and each member of the Board for all the review and assistance we received during the many faceted permit process for Robins Island Preservation Corp. (R.I.P.C.). Construction related activity is now underway at Robins Island and use of the landing craft plays a major role in transporting supplies, equipment, etc. to and ~rom the Island. While the present landing craft area has proven to be sufficient, we have experienced some difficulty with vehicle congestion because of the proximity to the town beach, ticket booth and parking area. As a result, we would like to install an alternate geoweb access ramp (20' x 120') at R.I.P.C's northerly property (SCTM #1000-117-8-19. Our proposal also includes a temporary crushed stone driveway leading to the landing craft loading ramp. This driveway will also extend onto the northerly adjacent parcel ~1000-117-8-18 (copy of lease agreement enclosed). Use of the ramp in this area would facilitate the easing of congestion at the end of First Street. We would like to request an amendment to locate the access ramp approximately 60' south of the existing jetty which would put it in line with the gate opening. In addition, we would like to install ten 2-pile dolpins and two 3-pile dolphins to secure the landing craft. Two of the 2-pile dolphins would be placed in Albert J. In order to remedy the situationf we would like to install two 14" galvanized pipes, approximately 30' in length into the bay bottom under the existing seaplane float. This pipe will have a wall thickness of 5/16" with a mounting flange on top for added ridgitity and will beiinstalled approximately 6' above the bay bottom so as not to interfere with the rise and fall of the float. We would then install two inner steel pilings which will be flange mounted between the floatation tubes using a 3' x 3' x 1" mount- ing plate and will belwelded to the existing tubes. These steel pipes will ride inside of the 14" lower pipe. This system will allow the float to ride up and down in a restricted pattern from pitching and rolling due to the clearance of the sliding pipes. Two steel piles will be used in place of the four greenheart piles that presently secure the 8' x 30' easterty access float. Rather than placing the steel pilings under this dock, we would place them in the same location as the greenheart pilings, inside 14" steel hoops° The hoops will be bolted, braced and welded on each end of the float. Thank you for your assistance in helping us to overcome all the obstacles associated with the revisions and modification requests we experienced. Although, the overall functions of this dock facility are satisfactory, the northwest winds (gusting 35 - 40 m.p.h.) causes the incoming transient boats to crash into the north side of the 6' x 24' floating finger docks or into the seaplane float. The attempts to manuever the boats around to the 6' x 20' finger floats is difficult because the strong tail winds prevents steerage and the vessels are pushed into the shore. Knowing your familiarity with weather conditions and docking problems, I don't think it is necessary that I over explain the problems at this site. Our client has aSked that we request an amendment to the existing permit to allow the installation of a 8' x 30' float on the east side of the dock. I have enclosed six copies of the site plan showing the location of the proposed float together with the $40.00 amendment fee. Box 1179 Southold, NY 11971 Re: Robin's Island Proposed Amendment to Permit #4365 Dear Mr. Krupski: At the conclusion of the dredging project, we will be reinstalling the floats from their present temporary location to the original location west of the main dock. We would like to make two modifications regarding the use of the floating docks. I have tried to simplify our request by explaining the problems and followed by our proposed solution. PROBLEM #1: There have been considerable problems landing and securing the seaplane which utilizes the 6' x 30' "L" float dock, basically because of the inadequate size. When utilizing this area, the seaplane lands and ties up to the west of the "L", with its nose facing south. After unloading the passengers and cargo, there is approximately 2' of dock space for foot passage. In addition, the seaplane must rotate off to the west and around to the north for take off (into the wind). The seaplane must turn on the 6' end of the float which is not wide enough for the pontoons and manuever- ing. During this manuevering, the pontoons on the plane constantly get hung up. SOLUTION #1: We would like to rectify the problem by replacing the existing 6' x 30' "L" float with a 15' x 30' "L". This would provide greater stability, more walkable space for safe loading and unloading, and will provide enough width for the seaplane to manuever around the south end of the float and face its nose to the west for direct takeoff into the wind. Krupski, President October 16, 1995 Page 2 of 2 PROBLEM ~2: The present float configuration and associated mooring pilings allow for the visiting boats to tie either "bow in" or "stern in" on the south side of the floats, thus making it very difficult for passengers to enter and exit (from the bow or stern on these boats) onto the floating dock. This situation becomes even more difficult with seasonal wind direction and wind velocity° SOLUTION #2: We would like to install two 6' x 20' floats which will be attached perpendicular on the south side of the four existing floats. This will enable passengers to safely exit from the sides of the boats. We realize and appreciate the time and review you have given to all the activites associated with Robin's Island. Although the landing craft has been secured using the three 2-pile dolphins located to the east, it is now difficult and somewhat unsafe to secure the vessel during the seasonal northeast winds. As such, we would like to request an amendment to the Town Permit #4365 to allow for the temporary installation of three 2-pile dolphins west of the landing craft site. For your review and files, I have enclosed a number of items. A map of Robins Island prepared by the N.Y.S.D.E.C. which depicts the general areas of mapped freshwater wetlands which exist on site. The map depicts the N.Y.S.D.E.C.:s mapped freshwater wetlands along with their identification code which have been assigned to them. The codes (SH) identify the areas of wetlands as they appear on the N.Y.S.D.E.C.~s Freshwater Wetlands Map of Suffolk County Southold (SH) Quadrangle as they appear on Map 20 of 39. A reduced map of the island on which the areas of identified freshwater wetlands are depicted which were then field verified/flagged by Mr. Stephen Jay Sandford of the N.Y.S.D.E.C.. We have added the names assigned to each area as well as the exact acreage of each area. This map was prepared to be used in conjunction with the Full Environmental Assessment Form prepared for the project. A letter from Mr. Michael S. Scheibel, the Robins Island Project Manager for the Nature Conservancy (8/24/94). This letter details those species identified by either the Federal or State as threatened or endangered. This letter had been o generated by Mr. Scheibel at our request to aid in the preparation of the Full Environmental Assessment Form° A map of the island on which the occurances of the species are shown. This specie~ wa~ last recorded nesting along the northern peninsula of Robins Island in 1991. 2) Osprey ~etus}; NYS-thregtened, Known to nest on Robins Island annually for at least the last fifty years. Six pair were recorded as native breeders in 1994, 3) Eastern mud turtle (Ki~~, NYS-threatened. Largest known population of the species in New York State. Discovered in 1994, this species is lmown to inhabit four distinct freshwater wetlands; localqly known as Northeast Pond, Duck Pond, Breeder Pond and Clay Pit Pond. 4) No state or federally-listed endangered/threatened species of plants are presently known to exist on Robins Island. Trapping efforts over the past five months by investigator Norman Soule have provided species documentation at four freshwater pond sites as indicated on maps I, II & III. Five adult turtles were fitted with radio transmitters and their movements recorded throughout the summer season providing additional habitat use information. Ail turtles were originally trapped within the ponds (as indicated on the maps by blue lines), and subsequently encountered within the ponds during most of the period. Documented use of upland habitat sites included nesting by adult females in late June and overland movement between two ponds in July (as indicated on the maps by green shading). Emigration from the ponds to upland wintering sites was first recorded in late August. By September 15th all five turtles with radio transmitters were at underground upland locations, and are now presumed to be at their winter quarters (as indicated by the red X's). Bacon we are seeking a waiver to Chapter 97 of the Southold Town Code (Wetlands) to allow for the hand cutting and removal of certain invasive species of plants. As proposed, This will involve the removal of said species of plants in and adjacent to areas of freshwater wetlands as identified/delineated by the staff of the N.Y.S.D.E.C. pursuant to Article 24 of the Environmental Conservation Law. The purpose of this proposal is twofold, the first is to control Multiflora Rose (Rosa multiflora), Common Reed (Phragmites communis)and Japanese Barberry (Berberis japonica) which are aggressive non-indigenous species which outcompete native species and secondly to control aggressive indigenous species such as Catbrier (Smilax sR.) and Grape(Vitis sp.). The areas in which the remOval is proposed are: Buttonbush Ponds (part of SH-52) which consists of two small kettles which are very heavily dominated by Catbrier with areas of Multiflora Rose. In this area the over abundance of Catbrier has severly overwhelmed and therefore restricted the growth of some of the Buttonbush (Cephalanthus occidentalis) which is a native freshwater wetlands shrub. · Claypits and Spring to Peconic Bay (Parts of SH-52) which consists of areas of Red Maple (Acer rubrum) and Tupelo or BlaCk Gum (.Nyssa sylvatica) swamp with scattered areas of grasses and dense tangles of Catbrier as well as Japanese Barberry, Multiflora Rose and Grape. As~in the case of the Buttonbush Ponds the native v~getatio~ is being severty overwhelmed by these aggressive sPecies. South Pond (Sh-5) which consists of an approximately one acre emergent marsh dominated by Common Reed with surrounding areas of Black Gum, Red Maple and Catbrier. .4. Northeast Pond (SH-52) which consists of an emergent marsh which is dominated by Common Reed and separated from Peconic Bay by a sandy berm. Other surrounding vegetation consists of areas of Salthay (Spartina patens), Swithgrass and Oak (Quercus sp.).~ 5. Breeder Pond (Sh-53) which consists of an emergent marsh which is completely dominated by Common Reed. To control these invasive species, the proPosal is to perform the following activities in those areas: Buttonbush Ponds (part of S~-52) the selective hand cutting and removal of Multiflora Rose and catbrier. The selective spot rotocutting of clumps of Catbrier. The use of a small light weight tractor to slip-chain clumps during removal. Claypits and Spring to Peconic Bay (parts of SH-52) The selective hand cutting and removal of Japanese Barberry, Multiflora Rose, Catbrier, Grape and Phragmite stems. Selective rotocutting of Multiflora Rose and the use of a small light weight tractor for the slip-chain removal of clumps of catbrier and Multiflora Rose° South Pond (SH-5) Selective hand cutting, selective spot rotocutting and the use of a small light wei'ght tractor for the slip-chain removal of clumps of Catbrier. Northeast Pond (SH-52) Phragmite control, hand cutting of Common Reed (Phragmites communis) stem flush with grade and removal of debris. Breeder Pond (SH-53) Phragmite control, hand cutting of Common Reed (Phragmites communis) stem flush with grade and the removal of debris. All hand cutting shall utilize hand tools such as chainsaws, polesaws, brush axes, shears, etc. Rotocutting shall be performed util.izing either wandsaws or a mounted rotoblade. The chain-pulling of clumps of Multiflora Rose and Catbrier is that chains shall be placed around the clumps of vegetation and cut as they are pulled by a small light weight tractor. Once cut all the resultant material shall be brought to an upland site where it shall be run through a tubgrinder and turned into chips. With this there shall be no disturbance to any species of wetlands vegetation, topography or soils. As proposed these operations will not adversely-~affect~-areast Df wetlands; cause damage from erosion, turbidity or siltation; cause saltwater intrusion into any areas of freshwater resource; adversely affect fish, shellfish or other beneficial marine organism aquatic wildlife and vegetation or natural habitat thereof; increase the danger of flood or storm-tide damage; change the course of any channel or the natural movement or flow of any waters; weaken or undermine the lateral support of other lands in the vicinity or otherwise adversely affect the health, safety and general welfare of the people of the Town of Southold. The proposed activity shall also have no adverse impacts on any species of plant or animal which has been identified as threatened or endangered. During construction, we will need areas for deliveries and storage of equipment and supplies, as well as dockage for construction workers, visitors and agency personnel traveling to and from the island. As you know, the bu!kheading at the New Suffolk site is in very bad disrepair and will not safely accomodate docking for the landing craft, barge, etc. The only docking accomodations at the Island is the use of a temporary float and a portion of the existing dock. Outlined below is a description of the areas we propose for temporary use. NEW SUFFOLK, NORTHERLY SECTION: We propose to install five pilings in front of the delap- idated bulkhead (north side of town launching ramp) to secure our landing craft and barge during the loading and unloading of equipment and supplies. We propose using the upland area for deliveries and storing equipment, supplies, etc. which will be used on the Island. Chesterfield is presently using this section as access to his landing craft. We believe it woud be beneficial to install a temporary access ramp (20' x 120' Geoweb) in this area. Enclosed please find project plans and photographs showing the details of the proposed "staging areas" and "temporary dockage". ~7 ROBIN'S ISLAND SITE: The two landing crafts presently use a small area east of the existing dock for loading and unloading equipment and vehicles. As previously stated, a portion of the existing delapidated dock and a temporary float now serves as a temporary docking area. When the dock construction gets underway, this entire area will be "off limits" to boat traffic and visitors. We are proposing, therefore, to provide temporary dockage by installing four 6' x 24~, one 6' x 30' float (secured with associated pilings) and a 32" x 30' access ramp to shore (foot traffic only). The floats will later be used in completing the floating section of the dock facility, as indicated in the dock application presently before your Board and approved by the DEC. Enclosed please find project plans and photographs showing the site location of the temporary floats in relationship to the landing craft and construction site.
