Romanelli would like to see a stabilized beach. It gives public access.
TRUSTEE KRUPSKI: So what was ...you explain what happened. So what are you
asking for tonight then, that was different from what was discussed on field inspection?
JOHN COSTELLO: I would like to see this Board act in favor of the original application
which requested what was originally buik.
TRUSTEE KRUPSKI: This Board, in making no reference to the DEC, this Board,
historically, and consistently, approves groin reconstruction at their functional length. So
what would the functional length of these three groins be?
JOHN COSTELLO: That's very questionable. The westerly one, the end is functional,
inter is not. The center one is basically, non-functional. The east one, only a very short
portion of its that functional the rest isn't, as you can see on the pictures submitted with
the application.
TRUSTEE KRUPSKI: Well that's been our policy. Under that policy we would approve
almost nothing there. Where this is going to establish groin field, I don't see where we
would have an objection to rebuild part of it. Now you tell me what was discussed in the
field. The 27' was discussed in the field?
TRUSTEE SMITH: Yes.
TRUSTEE KRUPSKI: Okay.
TRUSTEE S~MITH: The height of it was measured down from the top of the bulkhead
and we decide any future ......
TRUSTEE KING: The center groin is going to be centered on the property. This was
result of that meeting.
TRUSTEE KRUPSKI: Well I have a problem...that's actually more favorable to the
applicant than what we normally would have approved because usually we go by the
functionality of the structure whether it's a dock or a groin or a bulkhead or anything
else. But because it's in a groin field, I think the Board would look at that differently in
approving what would almost be new groins.
JOHN COSTELLO: I would think you would. I think every member on this Board
would look and see public access along that beach and the people protected by a
stabilized beach. If you count the groins, there are 50-60 along that whole stretch, and
that is stabilizing that beach. That is what you want, I hope.
TRUSTEE KRUPSKI: Is there any other comment? Does the Board have any other
comment? Do I have a motion to close the hearing?
TRUSTEE SMITH: Moved to close.

application to follow the description of the landward ends of the groins to be no less than
6'5 in. below the top of the bulkhead, the center groin is to be centered on the property,
and the groins are not to exceed over average low water.

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees
during its regular meeting held on December 16, 1998 regarding
the above matter:
WHEREAS, COSTELLO MARINE CONTRACTING CORP. on behalf of PAT
ROMANELLI applied to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated October 26, 1998, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and,
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on December 16, 1998, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area
and, ·
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
reconstruct three jetties using "C-Loc" vinyl sheathing with the
conditions that the landward end of the jetties are no less than
6'5" below the top of the bulkhead, the center middle jetty is
on the property, and the jetties are not to exceed average low
water.
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct and complete project will expire two years
from the date it is signed. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

As a follow-up to the November 23ra on-site meeting with John Costello and
Charles T. Hamilton of the NYSDEC, I am enclosing revised plans that reflect the
following:
Each of the three jetties have been shortened to 27 feet
The distance from the top of the bulkhead to the top of each jetty is 6.5 feet
The height of each jetty is 2.5 feet above beach grade
The king pile~at the end of the jetties have been removed

Dear Mr. Kmpski:
As a follow-up to last night's meeting, I would like to request that I be notified of
when the Trustees and NYS DEC are scheduled to meet at the site. I would like to attend
to discuss our proposal and address any questions that might arise.
Hopefully, the inspection will take place well prior to the December 16, 1998
meeting so that the Board can take action at the next meeting. Please advise me at your
earliest convenience so that I can adjust my schedule accordingly.
I would like to note that the use of the word "consistency" at last night's meeting
was a bit bothersome. The Board of Trustees is consistent in its efforts to help the
residents and taxpayers while expressing concerns that benefit the public by educating
them and directing them to pursue the best environmental alternatives. That is
consistency. Consistency is not whether a float or other structures are always the same
size.
Enclosed please find additional information received today from the New- York
State Department of State advising that the Army Corps of Engineers may approve the
Romanelli application under the Nationwide Permit or by Letter of PermisSion.

Acknowledgement of Federal Consistency Assessment Form
The Department of State received your Federal Consistency Assessment Form and supporting information on November
2, 1998 and has determined that the submitted doctmaentation is adequate to commence our review of your proposed project.
The proposed project includes reconstruction of three Iow profile groins; 45'. 50' and 48' in length. The proposed groin
reconstruction would not occur within a designated significant habitat or boundary of an approved local waterfront
revitalization program.
The proposed activities may be eligible for authorization under an existing Corps of Engineers nationwide permit or by
Letter of Permission. If the Corps of Engineers determines that this project could be authorized by regional general permit
or by letter of permission, no further review of this project by the Department of State would be necessary because the
proposed activities would not significantly affect resources of the State designated significant habitat or conflict with other
uses. If the Corps notifies you that this project may be authorized by one or a combination of these permtts, please provide
a copy of that notification to this Department as soon as possible so that we may close the file on your project.
If the Corps of Engineers determines that an individual permit ts necessary for the proposed project, you and the Corps of
Engineers will be notified of our decision when we have completed our review of this project for its consistency with the
New York State Coastal Management Program.
