Dear Mr. Haje:
The Department of State received your Federal Consistency Assessment Form and supporting information
on October 9, 1997 and has determined that the submitted documentation is adequate to commence our review
of your proposed project. We will contact you if additional information may be necessazy for consistency
review purposes.
You and the Corps of Engin~rs wgl be notified of our decision when we have completed our review of this
project for irs consistency with the New York State Coastal Management Program. The Corps of Engineers
cannot issue a petit for this project unless the Department of State concurs with your consistency
certification.
Please be advised that. the Corps of Engineers may authorize ~e proposed project under an existing
nationwide permit (#3). If the Corps of Engineers does determine that this project could be author/zed under
an existing nationwide permit, no further review of this project by the Department of State would be

RE: GRANDFATHER APPLICATION FOR EDYTHE SCHMITT
Dear Diane:
The enclosed application is for agrandfather permit for (2) groins which exist along the beach in
from of property known as 4900 Peconic Bay Blvd., owned by Mrs. Edythe Schmi~. Mrs.
Sehmitt would like to have the groins removed and replaced (in-kind/in-place).
Although the structures are clearly several decades old, Mrs. Schmitt has no historical records
such as old surveys or photographs which indicate the presence of the groins. Nonetheless, !
trust that upon a full board inspection, the Trustees will conclude that the structure is indeed old
enough to be grandfathered.
Finally, please note that the portion of beachfront upon which the groins are located is actually
owned by Mr. and Mrs. Joseph Cormelly. I have attached a letter signed by the Connellys,
indicating their approval of the project. Should you have any questions, please feel free to
contact me, as I hope that you will be able to place the application on this month's agenda.
