Arnold SCTM# 1000-126-01-05 Dear Trustees, I represent the Pollak Family as their agent and I have been requested to respond to your notice of application of Harley B. Arnold. The Pollak Family owns the adjacent 220 acre farm to the west. The subject property is a natural ravine which collects large quantities of rain water. The property is a natural wetlands and we have concerns on the proposed building site. The building is situated on a natural incline of water flow to the ravine. I fear that if the house is built, my client may be subject to future lawsuits due to the natural drainage. Eighth Street is currently a paper street. I question whether the owner is going to open this street. If so, then will it be built according to Town Specifications, will it be bonded and dedicated with the proper drainage? The Pollak Family would prefer that the house be relocated to the Bray Avenue side which would eliminate our concerns. Please keep us advised as to the progress of your decision and I would like to be notified of scheduled meeting or heating dates so that we may comment and be part of your decision making on said subject matter. If you are to allow this proposal, the Pollak Family would like to be indemnified by the owner for the natural peril this house is subject to. Very truly yours, ~---~
