Ne York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL To: Southold Town Board of Trustees From: Southold Town CAC Dated: January 14, 1992 Re: Recommendation of Wetland Applications The following recommendations were adopted by the CAC its meeting held Thursday, January 9, 1992: On a motion by John Holzapfel, seconded by John McCormi k,; it was RESOLVED to recommend to the Southold Town Trustees par ial approval of Wetland Application No. 86-6-p/o26 of Winds Way Building Corp. to construct 4' x 50' and 4' x 40' timbe stair- way from top of bluff to base of slope. Stairway to led to 4' x 225' elevated timber catwalk constructed along lope toe to 4' x 60' timber catwalk connecting adjoining pro erty staircase (4' x 40') and common beach. Also, to constr ct 4' x 100' elevated timber catwalk leading to a 3' x 10' ramp and two 6' x 20' floats in "T" formation secured by 8" ilings. Catwalk to be elevated 4' over TWL area. The CAC recommends approval of the dock a~ long as the go directly from the dock to the 15' contour line. While the construction is within the seventy-five (75) f jurisdiction of the Trustees, it is not within twenty-fi feet of mean high water, as you indicated. I should hasten to point out that this lot is part of a 1~ al subdivision for which the Trustees have little recourse b~ to approve house construction on, unless we can find legally defendable wetlands on site. This is not to say we are n(t concerned as you are, but are finding ourselves with many left-over problems of'the past with which to treat equall2 and fairly. We have heard this lot was created when wetland'as filled years ago from dredging. Fortunately, this sort o activity is no longer permitted. I know Supervisor Harris is very concerned with the envir nment as was his predecessor, Frank Murphy when he received Tow Trustee approval to construct his home near wetlands on Mattituck Creek. Neither this supervisor, the last, nor he Trustees were responsible for the kinds of land abuse and lack of planning which created the damage on this site enabli~ it to be developed. The question of whether an action is significant is not ways easy to answer. Freqnently, there are aspects of a project t are subjective or unmeasurable. It is also understood that those will need to determine significance will range from those with lit or no formal knowledge of the environment to those who are technic expert in environmental analysis. In addition, many who have know in one particular area may not be aware of the broader concerns af lng the question of significance. The EAF is intended to provide a method whereby the preparer be assured that the determination process has been orderly, compre sive in nature, and yet flexible to allow the introduction of info tion to fit a project or action. EAF CO}~ONENTS: The EAF is comprised of three parts: Part 1: Provides objective data and information about a give project and its site. By identifying basic project it assists a reviewer in the analysis that takes pla in Parts 2 and 3. Part 2: This phase of the evaluation focuses on identifying range of possible impacts that may occur from a proJ or action. It provides guidance as to whether an im is likely to be considered small to moderate or whet it is a potentially-large impact. The form also ide fies whether an impact can be mitigated or reduced. Part 3: Only if any impact in Part 2 is identified as potent large, then Part 3 is used to evaluate whether or no impact is actually important to the municipality in the project is located.
