Dear Mr. Just,
The following action was taken by the Board of To~m Trustees
during its regular meeting held on June 27, 1996, regarding the
above matter:
WHEREAS, WILLIAM PYMM, applied to the Southold Town Trustees
for a permit under the provisions of the Wetland Ordinance of
the Town of Southold, application dated June 12, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings, and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on June. 27, 1996, 'at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

At the meeting of the Southold Town Conservation Advisor~ Council held
MONDAY, JUNE 2~, 1996 the following recommendation was made:

Moved by Robert Keith, seconded by Allan Connell, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of WILLIAM PYMM 122-9-7.9 to
reconstruct in kind/in place 150' of timber groin and to construct a 50' timber
groin in the same location as deteriorated 50' groin.
The CAC recommends disapproval because there is no demonstrated need
shown.

Dear Mr. Krupski:
At the present time, we are writing you to update you as
to what has transpired since this applicati'on has been on
hold. As you may recall, the N.Y.S.D.E.C. technical staff
had questions regarding the smaller of the two groins (50')
and it's possible negative impacts upon erosion protection.
This was discussed in the N.Y.S.D.E.C.'s letter of 4/11/95
from Mr. Kevin A. Kispert (copy enclosed). Our response to
Mr. Kispert's letter took quite some time to put together,
since it was quite difficult to located aerial photographs
depicting the past conditions of the site which were a key to
cur response to the N.Y.S.D.E.C. For the Board's review and
comment, we've enclosed a copy of our response tc Mr.
Kispert, dated 4/19/96, as well as the aforementioned aerial
photograph. Also for your review, we've enclosed a copy of
the N.Y.S.D.E.C. permit which was issued for this activity on
5/11/96. As always, please feel free to contact our office
at any time should there be any questions or comments upon
the Board's review of this material.

Dear Mr. Kispert:
At the present time, we are writing you as a follow up
to our last discussion with you regarding this project. As
you may recall, the technical staff had felt that the
proposed 50' groin which would be constructed in the same
"footprint" of a deteriorated structure, would offer no
additional protection tot he beach, and has the potential to
create negative impacts. It was said that the 50' groin is
located in the "drift shadow" of the other groin and
therefore, will not be able to provide erosion protection,
and may actually create an erosion cell between the two
groins. They had also felt that beach sand in this cell
'would be carried out with each out going tide and not be
replenished because of the influenee of the larger groin.
Since the time of our last discussion, we have been
trying to locate photographs of the site which were taken
when the 50' groin was still functional. For your review,
we've enclosed a copy of a photograph taken sometime after
7/28/87, which was the date the Departmpnt issued the permit
for the construction of Mr. Pymm's home.' Kindly note that
the photograph depicts both jetties as well as a stable beach
affording protection against erosion.
Upon your review of this material, please feel free to
contact our office should you have any comments or questions
pertaining to this matter.

Dear Mr. Just:
This letter is in regard to your most recentsubmission in
support of the above application. Department staff have reviewed
the submitted information, inspected the site, and offer the
following.
The Department has no objection to the reconstruction of the
existing 150' groin in kind and in place, but staff objects to
construction of the proposed 50' groin as it will offer no
additional protection to the beach, and has the potential to ,
create negative impacts. The 50' groin is located in the "dr&ft
shadow" of the other groin and therefore, will not be able to
provide erosion protection, and may actually create an erosion
cell between the two groins. Beach sand in this cell would be
carried out with each out going tide and not replenished because
of the influence of the larger groin.
Given the unsubstantiated benefits and the potential
negative impacts, the new groin section of the project does not
meet the standards for permit issuance defined in Section 661.9
of the Tidal Wetland Land Use Regulations.

The pe[]~-]ittee has accepted expressly, by the execution of the appl ication, thel
full legal responsibility for all daTuges, direct or indirect, of ~hatever
nature and by vd~u~uver suffered, arising out of the project described in this
permit and has agreed to indu~ify and save ha..~ess the State fr~n suits,
actions, deluges and costs of every r~e and description resulting frcm this
project.
This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perfoma the
permitted v~rk nor does it authorize the i. pai.vunt of any rights, title, or
interest in real or personal property held or vested in a person not a party to
the permi t.
8. The permittee is responsible for obtaining any other permits, approvals, lands,
easements end rights-of-way that ~[ay be required for this project.

ADDITIONAL GENERAL CONDITIONS FOR ARTICLES 15 [Title 5), 24,
9. That if future operations by the State of New York require ae al-
teration in the position of the structure or work herein authorized, or
if, in the opinion of the Department of Environmental Conservation
it shall cause unreasonable obstruction to the free navigation of said
waters or flood flows or endanger the health, safety or welfare of
the people of the State, or cause loss or destruction of the natural
resources of the State, the owner may be ordered by the Department to
remove or alter the structural work, obstructions, or hazards caused
thereby without expense to the State, and if, upon the expiration or
revocation of this permit, the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted, the' owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all or any portion of the uncompleted
structure or fill and restore to its former condition the navigable
and flood Capacity of the watercourse. No claim shall be made against
the State of New York on account of any such removal or alteration.
10 That the State of New York shall in'no case be liable for any damage'
or injury to the structure or work herein authorized which may be caused
by or result from future operations undertaken by the State for the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
11 Granting of this permit does not relieve the applicant of the responsi-
biJity of obtaining any other permission, consent or approval from
the U.S. Army Corps of Engineers, U.S. Coast Guard, New York State
Office of General Services or local government which may be required,

of any wetland or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leachate or any

project.
13. Any material dredged in the prosecution of the work herein permitted
shall be removed evenly, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have
tendency to cause damage to navigable channels or to the banks of
a waterway.
14. There shall he no unreasonable interference with navig;'tJon by the work
herein authorized.
15. If upon the expiration or revocation of this permit, the project hereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department of Environmental Conservation may require, remove all or
any portion of the uncompleted structure or fill and restore the site
to its former condition. No claim shall I~e made against the State of
New York on account of any such removal or alteration.
16. If granted under 6 N¥CRR Part 608, the NYS Department of Environ-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301,302, 303, 306 and 307 of the Clean Water Act of 1977
(FL 95-217) provided that all of the conditions listed herein are met.
17. All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or bis agent as part
of the permit application.

SPEClALCONDITIONS
Any debris or excess material from construction of this
project shall be completely removed from the adjacent area
(upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or
protected, buffer areas.
There shall be no disturbance to vegetated tidal wetlands or_
protected buffer areas as a result of the permitted
activity.
The storage of construction equipment and materials shall be
confined to within the project work site and or upland areas
greater than 50 linear feet from the tidal wetland boundary.

S~PPLEMENTARY SPECIAL CONDITIONS
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits:
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign enclosed with the permit shall be protected from
the weather and posted in a conspicuous location at the
work site until all authorized work has been completed.
The permittee shall require that any contractor,
project engineer, or other person responsible for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the per~ittee shall contact the
Division of Regulatory Affairs at the address on page
one or telephone (516) 444-0365.
If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
pe~mittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
The granting of this permit does not relieve the permittee
of the responsibility of obtainin% a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services,' Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

recognizes the possibility that the structure permitted herein
may be subject to damage by wave wash from passing vessels. The
issuance of this permit does not relieve the permittee from
taking all proper steps to insure the integrity of the structure
permitted herein and the safety of boats moored thereto from
damage by wave wash, and the permittee shall not hold the United
States liable for any such damage. Passing vessels will not be
required to alter their current procedures to reduce the wake
caused by their operation, which may impacn the structure
authorized by this permit.
If for any reason, a change in your plans or construction
methods is found necessary, please contact us immediately to
discuss modification of your permit. Any changes must be
approved before they are undertaken.

functional, timber groin. All work shall be accomplished in accordance with the attached
drawings.

1. The time limit for completing the ~vork authorized ends on August 16, 1998 If you find that you need
more time co complete the authorized activity, submit your request for a time extension to this office for consideration at least
one month before the above dare is reached.
2. You must maintain the activity authorized by this permit in good condition and in conformance with the terms and condi-
tions of this permit. You are nor relieved of this requirement if you abandon the permitted activity, although you may make
a good faith transfer to s third party in compliance with General Condition 4 below. Should you wish to cease to maintain
the authorized activity or should you desire to abandon it without a good faith transfer, you must obtain a modification of
this permit from this office, ~vhich may require restoration of the area.
3. If you discover any previously unknown historic or archeologicat remains while accomplishing the activity, authorized by
~his permit, you must immediately notify ~his office of what you have found. We will initiate the Federal and stare coordina-

warrant. Circumstances that could require a reevaluation include, but are not limited to, the following:

b. The information provided by you in support of your permit application proves to have been false, incomplete, or
inaccurate (See 4 above).
c. Significant new information surfaces which this office did not consider in reaching the original public interest decision.
Such a reevaluation may result in a determination that it is appropriate lo use the suspension, modification, and revocation
procedures contained in 33 CFR 325.7 or enforcement procedures such as those contained in 33 CFR 326.4 and 326.5. The
referenced enforcement procedures provide for the issuance of an administrative order requiring you ro comply with the terms
and conditions of your permit and for the initiation of legal action where appropriate. You will be required to pay for any

Application of LOUIS M. BACON 134-3-5 to restore South Pond CSH-5).
Phragmites and root mass shall be removed (~excayated~) and trucked to an
upland site (greater than 100~ from freshwater wetlands and greater than 300~
from tidal wetlands) for disposal. For disposal a pit shall be excavated,
material shall be placed in pit, covered with a PVC liner and a Lr~ - 6~ layer
of soil shall be placed on top of liner. In restoring pond, approximately
17,000 c.¥. of soil shall be removed to create depths of I 1/2~ - 16~. Pond
shall be planted with rooted emergent vegetation. Existing road located within
adjacent area shall be utilized during excavation then replanted and
abandoned. Greenbrier and dead vegetation 'shall be removed from adjacent
area (1100I) and a wetlands transitional area shall be created. An area of
Phragmites located southwest of.pond along Great Peconic Bay shall be hand cut
to assure that no seed material returns to pond. Approximately 1,000 c.y. of
clean sand shall be placed in area located between pond and Great Peconic Bay
to strengthen shoreline from storm surge. Area shall then be planted with
American Beach Grass.

Dear Mr. Pymm:
Pursuant to 15 CFR 930.58, the following data and information are necessary ro enable the
Department of State to adequately assess the coastal zone effects of this proposed project.
The 50-foot western groin clearly does not appear to be flmcfioning or serviceable from the
photographs submitted. If there is no serviceable goin, your proposal would include the
new construction of a western groin. Is this structure necessary? It also appears from the
photographs submitted and information obtained by Department of State staff at the site
that the 150-foot structure k_th/bits the littoral transport of material toward the 50-foot
structure. This further places the necessity of the 50-foot structure Ln question.
Further justify the need for constructing a new 50-foot groin at this location.
Please provide the informal:ion requested above to the Deparrmem of State within thirty
days from the date of this letter. Pursuant to 15 CFR 930.64 (d), if the necessary data and
reformation are not provided, the Department of State may object to your consistency
certification on the grounds of ins,fiScient information.
Any additional information which you believe will facilitate our consistency review of this
project would be appreciated.

Purpose: The full EAF is designed To help applicants and agencies determine, in an orderly mannqr, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ly, there are aspects of a project that are subjective or unmeasureable. It is also understood that t~ose who determine
