November 7, 1996 Planning Board Town of Southold Main Road Southold~N~w York 11971 Re~ Proposed Site Plan for Strong's Marine Camp Mineola Road, Mattituck Dear Board Members: I am in receipt of a copy of your letter dated October 31, 1996, directed to Jeffery Strong of Strong's Marine, Inc. As you are aware, Mr. Strong has, for more than one year, been proceeding with a site plan and has, in order to obtain appropriate zoning for his site, applied for and has been granted a change of zone to M-I. The Planning Board recommended the change of zone and it was the subject' of an extended hearing. Unanimous approval was granted by the Town Board. Along the way Mr. Strong has made innumerable appearances before and received approvals from the Town Trustees, and, with the zoning approval in hand, formally submitted the site plan to you. Having been advised both separately and in my presence that the only requirement to be met before site plan approval was received was Health Department approval, which is anticipated shortly, it was surprising and distressing to learn that the Board is now demanding compliance with additional terms never before mentioned. Strong's Marine has no objection to complying with Town Code in connection with its lighting poles, however, it has great difficulty in accepting the imposition of zoning regulations from the Planning Board. Your request that the site plan show a uniform fifty foot deep landscaped area is contrary to the plans that have continuously been presented to the Planning Board and to the plan presented to the Town Board for the change of zone. Mr. Strong's plans for and use of his parcel are based upon the zoning approval. Time and again Jeffery Strong has repeated to the Planning Board that he has no present plans for commercial activity in the north Planning Board Page -2- November 7, 1996 basin. He should, however, not be placed in a position causing him to abandon or forego use of that area at some future date. The jurisdiction for that use, we believe, rests first with the Town Trustees and then ultimately the plan must be approved by the Planning Board. If there comes a time when the north basin is to be used commercially the appropriate application will be made and that will either be granted or denied based on the parameters of the Town Code. It is not acceptable to Strongs Marine to limit or define what activity will take place in the present site plan application since that subject is not before the Board. We look forward to a prompt resolution of the questions raised in your October 31st letter and to that end ask that you immediately schedule us to e present at your next meeting. Reasons Supporting This Determination: The parcel has peen 'nsBected and environmental references concerning the site eno area nave peen consulted. The subject site's composed of 8.46 acres of tend. and includes an existing ooerationa~ marina. The site was inspected and found to be characteristic of a boatyard/marina use. Strong's Marine consists of boat storage, slip space, fuel pumps, parking, offices, service areas and marine PrOdUCt center within an existing M! zone. The primary marina use is concentrated along a dredged canal on the southeast side of the site. In this area. Strong's Marine owns land on both sides of the canal These areas are typical of marina use. whereby boats are kept in slips and used for recreational purposes. The proposed use of the site has been comempiated by orev:ous actions. The Town Board ,ewewed a change of zone to modify the zoning on the north pan of the site from residentia~ (R-80) to MI Marine use. This was received favorably by the Town Board in consideration of the fact that part of the manna was a pre- existing non-conforming use in par~ of the R~0 area. and that the proposed change of zone wou~a ,not s~gnificantiy change intensity of site use. tn addition. a scenic easement was to be 3rovidea along the north part of the site adjacent to a dredged canal. It is atso qoted that the Town of Southold Trustees consicered the action which includes the basic site p~an items re(:uested of the Planning Board at this time. The Trustees have 'ssued a Negative Declaration. finding that the proposed site improvements would not have a s~gnificant impact on the environment. This determination was based on an environmental assessment and field inspection by the Boarc of Trustees. A permit for activity was issued on January 26. 1995 for activities within the jurisdiction of the Town Trustees. The proposed site b~an depicts site modifications which inciude addition of parking To conform to Town site plan requirements, with associated access, drainage, etc. The site 21an also depicts modification of the office building on site which incluoes the removal of three storage structures, an attached st~cture and a plastic shed. These structures are to be rep~ace(~ by a proposed shop and a proposed boat showroom. The area which will be occupied by the office and ShOWroom are areas which are currently used for boat repair and boat sales. The proposed building addition will facilitate indoor operations and will result in the remove of existing outdoor structures which are associated with goat repair. The modification is viewed as conforming with zoning as well as the basic existing operations on the sl~e. In addition. (ne modification is substantially in conformance with the proposed site design which was reviewed by the Town BoarG ~n connection with the change of zone decision in "995. Cross Sound Ferry: DEC has on file recent photographs showing dredge spoils and illegal parking within 57" of the high water mark at the ferry site. Is it within your purview to address this violation? 2. Strong's Marina: In a declaration of covenants and restrictions filedwith Suffolk County, Jeff Strong acknowledges a 20' conservation easement along the shoreline which hms across the mouth of the north basin. The declaration specifically .states that there shall be no docks north of this easement, but that ?this shall not prohibit dockage in the nOrth basin." The Town Attorney is of the opinion that this declaration is not binding because the Town Board resolution granting the zone change for the property neither supports nor prohibits usage of the north basin. The Planning Board feels that the zone change was not intended to increase intensity of use. Do you have on record an)- opinion regarding this issue? If and when Mr. Strong appears before you to obtain a dock permit for the noFLh basin, ~vould you be inclined re, grant one? Since that time we have received a zone change to have the parcels zoned correctly to accommodate this work. In addition, we have been working with the Planning Board to add the necessary details to meet their requirements. Attached is our current survey dated May 21, 1996. There are several differences on this from what you had originally approved, they are: The proposed shop and showroom are now configu~ed and shown exactly how we would build it - very similar tU the Jnit~a] rough proposal and no closer to the water. The Planning Board has asked us to install a catch basin per the Trustees approved drawings for pressure washing bottoms. 3. Additional parking has been added at the Planning Board's request. Storm water drainage calculations for all new construction and details of drainage structures. Include drainage calculations for the entire site. 2. Outdoor lighting, type of fixture and wattage. Ali lighting must be shielded To the premises. 3. Long environmental assessment form (LEAF). 4. Grade must slope away from bulkhead. 5. Show bumper stops at bulkhead. Grading, including existing and proposed topography with two-foot contours (on site and ~wo hundred (200) feet beyond the property line), together with spot locations for buildings must be shown. 7. A twenty foot (20') vegetative buffer must be placed between the MI and R-80 zones. The 14 parking spaces adjacent to the residential zone must be relocated to make room for the vegetative buffer. Boat wash down pad must conform to Trustees and DEC requirements, (see attached diagram). 10. Pump out station must be shown. 11. If docks exist or are planned for the north basin they should be shown. 12. Parking calculations should show retail, storage, office, and repair uses. 13. Parking should be moved away from waters edge, if possible, for environmental reasons. 14. Show landscaping for easement area. Trustee approval is required for existing boat racks and parking within seventy five (75') of the north wetlands. In addition to the above, review is required by the Suffolk County Department of Health Services and a notice of disapproval from the Building Department is required for the proposed boat racks that are to be installed fifty seven (57') from the bulkhead. A seventy five (75') set back is required, if the proposed racks are to be installed at this location action will be required by the Board of Appeals. If docks are proposed in small northerly basin, permission from Suffolk County, Department of Environmental Conservation, Army Corps. & Southold Trustees must be obtained A review of any covenants and restrictions required by the Town Board as a result of the zone change could result in additional requirements. The above list should not be considered a complete list, please consult Town Code Article XXV for additional requirements. Their reply is attached. I was not aware that the Town needed to request this. This area has not been dredged for quite some time. it is in direct access off the creek just south of my property where people come in to use the pump out station and get fuel. Would you please consider this request of dredging this area at the same time. it is very important because at this time boats that draw more than 2' of water get stuck there at medium to low tide. Date 7-10-96 Dear Gentlemen: I am the owner of Strong's Marine Inc. located on James Creek in Mattituck. I have reviewed the areas outlined to be dredged, which is similar to what has been done in the past. Outlined in green is a problem area for boats coming in and out of the creek. This has not been dredged for quite sometime. Boats do get stuck there frequently. All that would be needed is to extend your area to be dredged approximately 200' x 50' in width. Dear Ladies & Gentleman: We are very disturbed by all that has occurred in the past two years. Five years prior, we became very familiar with Mattituck and the area in general and that is what led to the purchase of a home on Ole Jule Lane two years ago. We now feel compelled to address the issues surrounding Strong's Marine. Our views are shared by a number of our neighbors that border on James Creek opposite Strong's Marine and also those neighbors on the opposite side of Ole Jule Lane. Fact, although not an issue we and/or our families have been homeowners in Suffolk County and the East End since 1952. # 1-Our first issue is addressed to Mr. Wickham who conducted the Town Board Meeting that was held on July 25, 1995. At considerable inconvenience to both of us not to mention expense we attended that meeting. (Our very first one in the Town of Southold). Why, Sir did you allow this meeting to become a popularity contest to the sole benefit of Mr. Jeffery Strong? Most of the people who spoke told us what a nice man he is and that is why the Board should grant him anything he wishes. Those people who spoke never addressed any of the zoning or environmental issues, most didn't even live within a 1/2 mile radius of the properties in question. Their voices were heard, however the taxpayers directly affected seemed to matter little, their voices became only whispers to the ears of the Board. Shame on all of you. # 2-To the entire Planning Board and the Board of Trustees we ask, why were we as taxpayers not informed of these meetings, when the zoning changes involved affected us directly. Are there any laws in our Town that require a petitioner to notify taxpayers within certain boundaries of any proposed zoning changes meetings etc.? If not, there should be, to protect the rights of all. Would you possibly be telling us that the Town of Southold is behind the times? We don't believe this to be the case. In the Town that we were formerly from it is mandatory that the Petitioner notify the General Public by publishing in the local papers 15 days in advance of the meetings, and also the day of the meeting and stating what changes he is applying for. He is also required to send a copy of said Petition by registered mail to all taxpayers within shall we say a 500 foot radius of the proposed zoning change. If that is the case in the Town of Southold, than something is amiss, as we are within less than 500 feet of Strong's Marine and we never received a registered or certified letter notifying us of the date and time of the meeting. Why not??? # 3-These questions are addressed to all of the above. (A) Was an Environmental Impact Statement (the long form) ever filled out by Strong's Marine? (After all this Marine is within 500 feet of a Federally Protected Estuary). (B) Have the proper taxes been assessed on all the Properties in question and have they been paid? (C) Has anyone checked to see if Strong's Marine is complying with the so called Scenic Easement? Mr. Strong himself made mention of planting new scrubs and trees to beautify this Easement to help hide the buildings, boat racks and to help buffer the noise. It is almost 2 months since that meeting, and from our backyards the view has not changed for the better it has only gotten worse. (We will address that part later). (D) Has anyone ever measured the racks to see of they along with the boats stored on them are in compliance? (We understand 28 feet was to be the limit allowed and in viewing them they certainly appear higher). # 4-There are other issues that need addressing. (A) The Paddleboat Docks are on top of the Scenic Easement, we don't believe that should be allowed. We also feel that the Marine should have an age requirement for those they rent the Paddleboats to. (This for the protection of the renters as well as the neighborhood at large). To often we see young children using them without adult supervision and without lifejackets. These children show little regard for the environment and the private homeowners' properties along James Creek. These young people scare, (on purpose I might add) the wildlife that is now also diminishing and they abuse both private property and the Scenic Easement. We have seen this t¥om as young as 8 & 9 year olds to 14 thru 16 year olds. (This of course is also a parental problem). (B) The unsightly floating docks stored in the cove adjacent to the Scenic Easement still have not been removed. (C) Mr. Strong stated that he has 12 full-time and 4 part-time employees also himself, total 15. Does he have 15 parking spaces set aside for these people along with the number of spaces needed for all the Boat Owners with docks as well as those who call in a 1/2 hour before time to have their boats removed from the high and dry racks and placed in the water? (We don't see where he can accommodate that many cars or trucks). (D) Then we have the garbage, it floats up the Creek and either ends up in our coves or at the end of the dredged canal. We clean it up, do we know for sure it comes from the Marine, no, but when it has identifying marks on it yes. # 5-The Noise. During the season May thru September, that is almost 1/2 a year we are forced to tolerate it, from 6am. till 9pm. or later, especially when parties are held. We are paying taxes on 1/2 an acre of property with only 100 feet on James Creek. Mr. Strong has 8 plus acres and probably close to 5000 feet on the water, (the water footage is approximate, as it is difficult to read the survey map we had at our disposal. I'm sure you must possess the accurate figures). Yet at the time of the July meeting he was only paying approximately $3000.00 more than us. We ask you is this FAIR??? Also at the same time Mr. Strong is earning a living plus on this property. Something is not right with this picture. We need you folks to take a better look at this situation and to act and help put things right. In closing, we ask that you address these issues and answer the questions we have put to you in this letter. We are not asking that you put Mr. Jeffery Strong out of business or even anything close to that, all we ask is that you consider the other affected taxpayers, justify their high taxes and put Strong's Marine, inc. into complete compliance to the benefit of ali the taxpayers, the environment and not just one person or business. That would provide no boat rack would be within 100 feet of the northerly tie line (along the dredged canal) of the parcel which is the subject of the change of zone application; this set back is to be separate from the 50 foot scenic easement which would remain parallel to the dredged canal. 2. That would further provide no structure or boat rack at the two parcels owned by Strong's Marine, Inc. in the M 1 Zoning Use District would exceed 28 feet in height and thus no boat on a rack or roof line would be over 28 foot in height. This Declaration of Covenants and Restrictions would bind not only Strong's Marine, Inc. but its successors and assigns and would be enforceable by the Town. At that meeting the matter of Strong's Marina zoning application for a change of zoning was discussed at length. While the Association voted unanimously with quorum not to oppose the zoning change, we did have serious concerns regarding the details of the proposed, development that will result from this change. They are as follows; 1) This marina has grown over the years and we believe that a reasonable final timi~ be place on any expansiont including the changes that may be brought about by the zoning change. 2) We are extremely concerned over the environmental aspects of such a use in James Creek and the surrounding waters. These environmental aspects include, potential fuel pollution, lighting pollution (extension of area lighting which might impact the marina's residential neighbors), proper screening both natural and man made of the marina from its neighbors and noise pollution. This marina is surrounded by residential neighborhoods. Careful attention to the details of th~ possible expansion and changes brought about by the change in zoning must be followed. We wish to be kept informed of the progress in this matter. Please continue to contac~ us in this regard. We believe that good communications and good planning will allow the neighborhood and the marina to mutually co-exist. When the master plan was adopted in 1988. the Town inadvertently followed the old property lines to establish the zoning line, We are requesting the zone line be moved north changing this RSO parcel to blI zoni~, like the rest of the facility. We are sensitive to the fact that several of our neighbors have requested we do not expand dockage on the north side of rials parcel. ~e agree with this. For this reason, we are p~eposing a 50' scenic easement (t~ghlishked..in green), This would remain undeveloped with no marina dockage on the north side of this easement, 2, We propose to extend one section of cur winter storage racks adjacent to the current racks, thus allowing us to be more efficient storing boats for the winter, 3. We show a proposed shop building that will eventually replace our greent%ouse and two small sheds enabling us to work indoors efficiently on 4-5 boats. We do not want to have marina dockage north of the easement, restauran'ts or bars, S-ig~ificantexp~sion. Ail we are looking to do is have a ~re efficient' facility - the way it should be. We run a clean, neat facility with many of our neighbors using and enjoying our paddleboats, picnic area or swing set and slide. The majority of the runoff entering 3ame~ Creek in this area is being generated by th,e parking lot. There is a ~mall amount ~f runoff traveling down the access road and entering the creek at the northwest corner of the parking lot. Ttds should be handled ~eperateiy from the parking lot project. A summary of the runoff computations has been included comparing the existing paved condition witi~ the p~'oposed ~ravel condition. As you can ~ee, going from an impervi~tS to a pervious conditon decreases runoff significantly depending upon the ~torm frequency. I have included a schematic showing details of ~n Impermeable subsurface gravel storage area to relain excess runoff on~ite. Runoff could be stored in this area and allowed to evaporate~ If the storage area is full and addition~al precipitation occurm, excess runoff would flow over the outer lip of the impermeable membrane wltere it could move laterally through the ~oil, making ii available to planted vegetation and~or outlet into the creek. There are obvious environmental benefits to such a concept. By retaining runoff onsite, there would boa net reduction of nitrates entering the estuary system, a high p~toriiy goal of th~ N~tiona] E~tua~y Program. The Council recommends approval provided the applicant replant the area disturbed by the heavy equipment and plant all spoil to beach grass in line with existing vegetation to extend in a northerly direction to include the 70' x 86' area on plot plan. However, the Department of State has yet to receive a Federal Consistency Assessment Form (FCAF) and supporting information for this proposed project. Upon receipt, we will determined if the submitted information is adequate to begin rev/ew of the proposed project for consistency with New York State's Coastal Management Program.
