The Hohns, however, have decided instead to construct a 6' x 6' platform and stairs underneath the rear door of the house that currently lacks such safe access to the yard. Thus, I have attached hereto a copy ora revised site plan depicting this'proposal for your records. Dept. 1329 Norih Sea Road ~Uthampton, New York 11968 516-283-6360 F~: 516-2~-6136 ENVIRONMENTAL SERVICES Board of Trustees Town of Southold 53095 Main Road Southold, NY 11971 April 29, 1998 RE: WAIVER REQUEST FOR HARRY AND JANET HO]tN Members of the Board: Attached please find an application by Harry and Janet Hohn for a waiver to construct a 350 square foot deck on the northwest corner of an existing 1½ -story one-family dwelling on Aborn Lane, Cutchogue, fronting a tidal pond associated with Little Peconic Bay. As the deck is proposed a minimum distance of 14.5' from the landward edge of the adjacent tidal wetlands, the structure will not meet the required 75' setback from tidal wetlands. The practical difficulty with meeting the required setback, however, is that the purpose of the deck is to provide a waterfront outdoor sitting area and the waterfront side of the existing dwelling is already located a minimum distance of 28' from the edge of tidal wetlands. The deck can not be situated on the north side of the house due to the presence of the existing roofed porch, and the presence of the bedrooms in the southwest corner of the house makes placement of a deck offthe southwest corner impractical. Therefore, constructing the deck offthe northwest corner of the house is the only practicable site alternative. Construction of the addition, however, will not result in any change in environmental conditions that would adversely impact the present or potential value of the adjacent tidal wetlands. Currently, more than 90% of the subject lot is held as a conservation easement area, including the tidal pond, which comprises nearly one acre or 25% of the property. The construction of the deck will increase coverage of the lot by impervious surfaces by a mere 0.22%, from approximately 1.08% to 1.30%. Therefore, given these site conditions and the minimal scope of the project , we respectfully request that a waiver be granted to Harry and Janet Hohn to construct a 350 square foot deck as proposed.
