The following recommendation was adopted at the meeting of the Southold Town-
Conservation Advisory Council held Monday, September 22. 1997:

Moved by Mary Griffin, seconded by Melvyn Morris, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
of the Waiver Request of OENNIS and IRENE KRAFT 11.~-12-23.1 for a
second story deck, measuring 12' x 15'.

Dear Ms. Herbert:
Please be advised that I represent Dennis and Irene Kraft
who recently purchased a house from Anthony Pepe.
I am enclosing herewith a copy of a letter I sent to the
Southold Town Building Department on June 24, 1997 which
sets forth the history of the construction of the house and
2nd story deck. When I closed the title for Mr. and Mrs.
Kraft I had asked the seller's attorney to obtain an updated
CO to reflect the 2nd story deck. I have been advised the
2nd story deck was part of the original structure and that
it was repaired approximately 10 years ago.
As so often happens, the old building department records for
permit 2078 does not contain much information. There were
no plans on file and there is no reference to the 2nd story
deck. I am enclosing a recent survey which I had prepared
which shows the 2nd story deck distance 60.1 feet from the
bulkhead.
I applied to the building department for a building permit
and CO for the deck and received a phone call from Pat at
the building department indicating that I must bring this
matter to the attention of the Board of Trustees.
I am hereby requesting a non-jurisdiction letter from your
office. The Certificate of Occuancy for the house was
issued October 28, 1963. Unfortunately, the certificate did
not include the deck. As you are aware back in l~63 the
building department was not specific in itemizing every item
on the CO, as it is today. If there is any fee for the
application, please advise my office.

Gentlemen:
Please be advised that I represent the present owners,
Dennis and Irene Kraft. I am enclosing herewith the
following:
1. Application for Building Permit to repair 2nd story
deck.
2. Copy of survey.
3. Cop~of_Certificate of Occupancy dated October 28,
1963, number 1715.
4. Plans for deck.
5. Application for updated CO and Consent to Inspect form.
I have b~en advised that nhe 2nd story deck was part of the
original structure and approximately 10 years ago was
repaired.
The old Town file for building permit #7028 is very sparse
and there are no plans in the file referring to the 2nd
story deck.
In any event, I would like an updated CO for the Two story
wood frame residence with a 2nd story wood deck. I am
enclosing herewith a check in the sum of $75.00 for a
Building Permit and $25.00 for the Certificate of Occupancy.
