Box 1179 Southold, New York 11971 Telephone (516) 765-18~2 Fax (516) 765-1823 BOARD OF TOWN TRUSTEES TOWN OF SOUTHOLD May 29, 1998 Donald Feiler Main Road Mattituck NY 11952 Re: JAMES MINOGUE SCTM #115-10~6 Dear Mr. Feller The following action was taken by the Board of Town Trustees during its Regular Meeting held on May 28, 1998, regarding the above matter: WHEREAS, JAMES MINOGUE, applied to the Southold Town Trustees for a permit under the' provisions of the Wetland Ordinance of the Town of Southold, application dated May 7, 1998, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 28, 1998, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health', safety and general welfare of the people of the town, NOW THEREFORE BE'IT, RESOLVED, that the Board of Trustees approves the application of JAMES MINOGUE to construct renovations and an addition to first floor of existing house and a new second floor to northeast side of house, and remove existing deck. Located: 5550 New Suffolk Ave., Mattituck. BE IT FURTHER RESOLVED that this determination should not be considered a determination made for any other Department'or Agency which may also have an application pending for the same or similar project. Permit to construct and complete project will expire two years from the date it is signed. Fees must be paid, if applicable, and permit issued within six months of the date of this notification. Box 1179 Southold, New York 11971 SOUTHOLD TOWN CONSERVATION ADVISORY COUNCIL The following recommendation was made at the meeting of the Southold Town ConServation Advisory Council held May 21, 1998; No. 1570 Moved by MelvYn Morris. seconded by Sharon Shine. it was RESOLVED to make NO COMMENT concerning the current construction of the Wetland Permit application of JAMES MINOGUE 115-10-6 to addition and renovations to first floor of existing one story frame residence and new second floor construction, 5550 New Suffolk Avenue, Mattituck The CAC has no comment on the construction, the work has already commenced, but, since a Wetland Permit is required prior to construction, the CAC recommends a' Violation be issued. Town Trustees James Minogue April 29, 1998 Please put a ~Stop Work Order' on the property of James Minogue as soon as possible. On April 23, 1998 Mr. Minogue was issued a Waiver for a project with stipulation that a dilapidated boat be taken out of the water. He has not done s° as yet. The boat is not abandoned. It is my intention to restore/replace the rotted wooden decks. On either Monday, April 27, or Tuesday, April 28, I plan to get the water out of the boat so that it will float at high tide. There isn't enough water behind my bulkhead at low tide to float the boat, but at high tide, and for about two hours before and after the high tide, the entire boat does float. When we are able to move back into our house, I will begin the restoration. In the meantime, I will do my utmost to keep the boat from looking abandoned.
