Box 645 East Marion, NY 11939 Re: Bernard Fisher SCTM ~ 114-12-4 Dear Mr. Fisher: The following action was taken by the Board of Town Trustees during its regular meeting held on May 22, 1996 regarding the above matter: WHEREAS, BARNARD FISMER applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated April 29, 1996, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council for their findings and rec~m~tendations, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on May 22, 1996, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area· and · WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standard set forth in Chapter 37-18 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees grant a Wetland Permit to construct a 2 1/2 X 327' catwalk with a 4' X 4' platform at the end inclusive of the 327', elevated 2 1/2' , and, BE IT FURTHER RESOLVED that this determination should not be -considered a determination made for any other Department or Agency which may also have an application pending for the same or similar project. Permit to construct project will expire two years from the d~te it is signed. Fees must be paid, if applicable, and pezmit issued within six months of the date of this notification. It is my concern that my present access to James Creek, via canoe, is not restricted or eliminated. These waterways are very narrow with little room to spare. Any new construction permitted should be considerate of this limitation. The prospect of a boat tied to the proposed dock can even further restrict passage. DOS has determined that the submitted documentation is adequate to commence our review of your proposed project. However, pursuant to i5 CFR 930.58, the following data and information is necessax7 to enable the Department of State to adequately assess the coastal zone effects of this proposed proje~ct. Due to the narrow width of the watercourse, we are concerned that placement of a floating dock and vessel would eliminate access for others boaters in the area. Please discuss this important issue with respect to the Public Access Polic~es of New York State's Coastal Management Program (a copy of the forty-four policies is attached). As illustrated within the submitted photo~aphs, the area of proposed construction presently supports intertidal vegetation. Shading might result in adverse impacts to the vegetation thereby diminishing the viability of this tidal wetland area. However, the effects from shading may be minimized if the proposed catwalk surface would be constructed at least 4' above grade. Please discuss this issue with respect to Coastal Policy #44. The decision whether to issue a permit will be based on an evaluation of the probable impact, including cumulative impacts, of the proposed activity on the public interest. That decision will reflect the national concern for both protection and utilization of important resources. The benefits which reasonably may be expected to accrue from the proposal must be balanced against its reasonably foreseeable detriments. All factors which may be relevant to the proposal will be considered including the cumulative effects thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historical properties, fish and wildlife values, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, consideration of property ownership and, in general, the needs and welfare of the people. The Corps of Engineers is soliciting comments from the public; Federal, state, and local agencies and officials; Indian Tribes; and other interested parties in order to consider and evaluate the impacts of this proposed activity. Any comments received will be considered by the Corps of Engineers to determine whether to issue, modify, condition or deny a permit for this proposal. To make this decision, comments are used to assess impacts on endangered species, historic properties, water quality, general environmental effects, and the other public interest factors listed above. Comments are used in preparation of an Environmental Assessment and/or an Environmental Impact Statement pursuant to the National Environmental Policy Act. Comments are also used to determine the need for a public hearing and to determine the overall public interest of the proposed activity. Presently unknown archeological, scientific, prehistorical, or historical data may be lost by work accomplished under the required permit. Pursuant to Section 307 (c) of the Coastal Zone Management Act of 1972 as amended [16 U.S.C. 1456 (c)], for activities under consideration that are located within the coastal zone of a state which has a federally approved coastal zone management program, the applicant has certified in the permit application that the activity complies with, and will be conducted in a manner that is consistent with, the approved state coastal zone management program. By this public notice, we are requesting the state's concurrence with, objection to, 'or waiver of the applicant's certification. No permit decision will be made until one of these actions occur. The work would involve construction of a 2.5 foot x 327 foot fixed pile-supported timber pier with a 4 foot x 6 foot fixed platform at its waterward end. Pilings would be of variable length, 8 inches in diameter, and would be spaced 6 feet apart on center. The stated purpose of this project is to provide access to Jones Creek from the adjacem upland property and provide a mooring facility for a 21-foot vessel.
