TERMS and CONDITIONS
The Permirtee John F. O'Grady
residing at West Cove Road, Cutchogue, 11935 N.Y., as
part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or rialtos for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permit'tee will, at his or her own expeme,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, ro the complete exclusion of the Board of Trustees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
~o~mated time required to complete the work involved, but should circumstances warrant, request
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and Iow water marks.
7. That if furore operations of the Town of Southold require the removal and/or alterations
iff the location of the work herein authorized, or fi, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstrucaon to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board wi/l be notified by the Permittee ox the completion of the work auga.

9. That the Permittee will obtain all other permits and consents ,that may be required sup..
plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees
during its regular meeting held on January 25, 1990 regarding the
above matter:
WHEREAS, Proper-T Services on behalf of John F. O'Grady applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated
and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS~ a public hearing was held by the Town Trustees with respect
to said application on January 25,1990 at which time all interested
persons were given an opportuni'ty to be heard, and,
WHEREAS~ the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that Proper_T Services ON BEHALF OF John F. O'Grady BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
To construct 16'x40' pool, construct ll5'(approximate) retaining
wall, excavate and regrade rear yard, and construct addition to house.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid, if
applicable, and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for
work to be done below Mean High Water Mark:

NOTICE OF HEARINGS ON WETLAND APPLICATIONS
NOTICE IS HEREBY GIVEN THAT PUBLIC HEARINGS WILL BE HELD BY THE
TOWN TRUSTEES OF THE TOWN OF $OUTHOLD, AT THE SOUTHOLD TOWN HALL,
MAIN ROAD, SOUTHOLD, NEW YORK ON THURSDAY, January 25, 1990, ON THE
FOLLOWING APPLICATIONS FOR PERMITS UNDER THE PROVISIONS OF THE
WETLAND ORDINANCE OF THE TOWN.
7:00 PoM. - In the matter of the application of John H. Geidemann
on behalf of Grant H. Lennox, Knoll Circle, East Marion, N.Y. to
construct a 65' bulkhead on property fronting on Spring Pond.
7:01 P.M. - In the matter of the application of J.M.O. Consulting
on behalf of Peter Bavaro, Lupton Point Road, Mattituck, N.Y. to
remove existing 4' X 30' catwalk, construct a 4' X 60' catwalk
(elevated a minimum of 4' over grade), a 3' x12' ramp and a 6' X 30'
float which shall be secured by (2) two spile dolphins" on Deep
Hole Creek.
7:02 P.M. - In the matter of the application of John and~Nancy
Pearson, South Harbor Road, Southold, N.Y. to clear away multiflora
andCatbrier from area within 150' of Richmond Creek and replant
undergrowth with oak, beech and hickory seedling, native shrubs and
ground covers such as bayberry, blueberry, kalmia, etc. and cover
all soil with leaves or hay until undergrowth is re-established.
7:03 p.m. - In the matter of the application of En-Consultants, Inc.
on behalf of Robert Barry, West Shore Drive, Southold, N.Y. to
replace (within 18") an existing high retaining wall 76' in length.
New wall will be approximately 6' l~wer in elevation than existing
which will also be cut lower. A second retaining wall will be built
approximately 4' landward, whiCh will match existing grade
elevation. Fill to be removed from behind old wall will be used to
fill depressed area behind wall. A 25' return on the e/s and a 15'
return on the w/s will-.be built.
7:04 p.m. - In the matter of the application of Proper-T Services on
behalf of John F. O'Grady, West Cove Road, Cutchogue, N.Y. to
construct 16' X 40' swimming pool, construct 115' (aprox.) retaining
wall, excavate and regrade rear yard, construct addition to house
ALL PERSONS INTERESTED IN SAID MATTERS SHOULD APPEAR AT THE TIME AND
PLACE ABOVE SPECIFIED AND WILL BE GIVEN AN OPPORTUNITY TO BE HEARD.

RESOLVED to recommend approval of Wetland Application No. 10-6-89-37-5-14
by Grant H. Lennox to construct 65' of bulkhead tied to existing bulkheads
at each end.

RESOLVED to recommend to the Southold Town Trustees approval of Wetland
Application No. 10-5-89-89-3-11.5 of Roscoe Corey to construct a 2' x 35' catwalk
to waters edge, 6' x 4' dock and pilings
830 Clearview Road, Southold
Vote of Council: Ayes: All
RESOVLED to table Wetland Application of Carl Vail to construct rock revetment.
The need Council needs additional information.

RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 11-1-89-115-55-7 of Peter Bavaro to remove existing
4' x 30' catwalk constaruct a 4' x 60' catwalk, a 3' x 12' ramp and a 6' x 30 '
float secured by tow spile dolphins. The Council approves if the applicant
turns the float so it is parallel to shoreline. (The Council would like the
_Trustees to consider a policy concerning the length of catwalks).

RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 11-2-89-111-2-11 of John F. O'Grady to construct a
swimming pools 16' x 40', retaining wall 115', excavate and regrade rear yard,
construct an addition to house. The CAC requests there be no disturbance
within 25' of the bluff, including the retaining wall and the applicant turn the
pool so it runs parallel to the shoreline.

Vote of Council: Ayes: All
RESOLVED to recommend to the Southold Town Trustees approval with
stipulations of Wetland Application No. 11-3-89-75-5-6 of John and Nancy
Pearson to clear away multiflora rose and catbriar from an area within 150'
of Richmond Creek. The Council requests the applicants use haybales between
the work area and wetlands, and all work stay 10' away from bank.
3258 South Harbor Road, Southold
Vote of Council: Ayes: All
RESOLVED to recommend to the Southold Town Trdstees approval of Wetland
Applicaiton No. 11-4-89-80-3-6 to replace withing 18' and existing high retaining
wall 76' in length and construct a new wall 6' lower than existing wall to create
a terraced effect with returns on east and west sides.
West Shore Drive, Southold
Vote of Council: Ayes: All
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 12-1-89-17-2-1.4 of Antonio Perez and Anne Branch Williams to
construct a single family dwelling, pool, sanitary system, well, driveway and
truck in fill to raise grade. The CAC disapproves of the project because
the road will go across the freshwater wetlands, the septic system would be
higher than the pond and more information is needed on the hydraulics of the
pond and the property should be staked and ~narked clearly.

WAiver of Maria Mercorella to add a deck at 2260 Great Peconic Bay Blvd,
Laurel is approved with suggestions that applicant not fertilize lawn because of
