ANGELO STEPNOSKI: I'm pretty certain. TRUSTEE KRUPSKI: Well, if you come back with that, with their approval on that, then bring it back to us and maybe we'll amend it. We'll take a look at that. ANOELO STEPNOSKI: (can't understand) TRUSTF. F- KRUPSKI: No, the length tO dock, that's why I didn't vote on it, because I think 54' gives you the same depth as at 72'. TRUSTEE KRUPSKI: But access isn't being denied. You still have access to the water. He's got a boat in the water today. But if you can convince the state that a fixed platform is the way to go, then come back to the board for an amendment. "ANGELO STEPNOSKI: Boat floats TRUSTEE KKUPSKI: Boats floats, but Kenny explained that there's that deeper area there that it (unclear) up after that and I think that's why Kenny pulled it back so that you'd keep that deeper area open for navigation. Approx. 3,000 c.y. of resultant spoil will be used both for backfill and temporarily deposited on open field site. Spoil deposited in stated located will be removed and deposited at approved upland site after de-watering. Located: 2835 Shipyard Lane, East Marion. SCTM #38-7-7.1 TRUSTEE KRUPSKI: Before we start this public hearing, I just want to clarify something. The Board first issued this Permit four year ago, I'm looking for the exact date, March 28, 1995, the Permit expired. So that is why they re-applied for this Permit. However, there was a 10 year maintenance dredging that was granted on the original Permit in 1995. Sothe applicant, for everyone involved here, still has the maintenance dredging portion, is still valid, The only part that ran out is the re-building of the bulkhead and all the structures on the site. there anyone who would like to comment on the application? partially clarified some of my questions, because of the way it was listed, it looked as if also the DEC permit about the dredging along with the Army Corp. of Engineers was up for grabs again. O'Grady This letter is in response to the letter of June 2, 1997 from the Department of the Army, N.Y. District, Corps of Engineers. We are opposed to the construction of the pier and float as described in the above letter. We have been in Horseshoe Cove for over 26 years and have been using a simple pipe in the water, 25' off our bulkheading with a pulley system to moor a rowboat which is rowed out to our boat moored in Horseshoe Cove Harbor. Walter and Rajean Salmon, who were the prior owners of the O'Grady property for over 40 years, did the same. The Pauls, who have lived in the area for over 50 years, on the other side of the present O'Grady property, also use a pipe with the pulley system. This is the safest way to take advantage of the unique mooring spots Horseshoe Cove offers people who want to keep their boats in the harbor. At the same time it does not interfere with anybody's enjoyment of walking along the beach, or swimming, or taking the sunfish out for a sail without having to walk out into deep water to avoid a 121' dock. Horseshoe Cove is one of the very few - if not the only- naturally protected harbors in Little Peconic Bay protected by Meadow Beach, the beautiful little sandy beach created to be forever wild by the Nature Conservancy, only about 800 feet across from the O'Gradys who want to have a 121' dock jut out towards this little jewel, thereby encroaching on this beautiful , idyllic birds' paradise. The purpose of this dock is "to provide safe mooring facility for the applicant's vessel(s)" (quotation from Army Corps of Engineers' letter of 6/2/97) . But because the proposed dock at thd O'Grady location faces A. open water B. South it is not safe for mooring a boat in a storm which in our area Comes predominantly out of the south, south/west and west. If a boat is to be safe in a storm, it needs play, preferably 360 Our harbor offers these unique mooring spots . If the cumulative experience of our neighbors and ourselves is correct, and the proposed structure provides an unsafe mooring spot for a vessel, then its actual function is to provide a convenient loading and unloading spot for the O'Gradys' boats, while inconveniencing everyone around, in particular the Pauls and us. In terms of ecology, we are all aware that there is less shellfish in our cove. We need bulkheading to protect our land, but not CCA- treated wood for a dock that will have to be repaired after a severe storm or because of the frequent build-up of ice in our cove during a typical winter, which means more CCA-treated wood will be sitting in our water.
