Assessment Form and certification that the above proposed permit activity complies with
New York State's approved Coastal Management Program, and will be conducted in a
manner consistent with this program.

Department of State concurs with your consistency certification. This concurrence is without
prejudice to, and does not obviate the need to obtain. all other applicable licenses, permits,
and approvals required under existing State statutes.

At the meeting of thé Southold Town Conservation Advisory Council held'
Monday, April 22, 1996, the following action was made:
WR-36
The Council did not inspect and therefore cannot make a recommendation for
the Waiver Request of the FISHERS ISLAND FERRY DISTRICT 12-1-10 to
reconstruct the east ramp in the Silver Eel Cove including the installation of
65 +/- I.r. of steel sheetpile bulkhead with backfill (70 +/- c.y. over 250 +/-
s.f.), new counterweight supports, and protective dolphins, waterward of the
high tide line.

The Department of the Army permit program is authorized by Sectiœ 10 of the Rivers and Harbors Act of 1899, Sectiœ 404 of the Clean Water Act and Section 103
of the Marine, Protection, Research and Sanctuaries Act. These laws require permits authorizing activities in or affecting navigable waters of the United States, and the
transportation of dredged material for the purpose of dumping it into ocean waters. Information provided on this form will be used in evaluating the applicatiœ for a
permit. Information in this application is made a matter of public record through issuance of a public notice. Disclosure of the information requested is voluntary;
however, the data requested are necessary in order to communicate with the applicant and to evaluate the permit application. If necessa¡y information is not provided,
the permit applicatiœ cannot be processed nor can a permit be issued.

proximate to your project site.

5. Provide a thorough discussion of alternatives to your proposal This discussion
shòuld include, but"iiot necessaT/7y be liir1itød to, the "no action" alternative and
alternative(s) resulting in less _disturbance to waters of the United States. For filling
projects in waters of the United States, including wetlands, your alternatives
,. discussion should demonstrate that there are no practicable alternatives to your
proposed filling and that your project meets with current mitigation policy (i.e.
avoidance, minimization and compensation).
DREDGING PROJECTS
Answer the following if your project involves dredging.
1. Indicate the estimated volume of material to be dredged and the depth (below
mean low water) to which dredging would occur. Would there be overdepth
dredging?
2~ You can apply for a ten-year permit for maintenance dredging. If you wish to
apply for a ten-year permit, please provide the number of additional dredging events
during the ten-year life of the permit and the amount of material to be removed
during future events.
3. Indicate of your drawings the dewatering area {if applicable} and disposal site for
the dredged material (except landfJ71 sites). Submit a sufficient number of
photographs of the dewatering. and disposal sites as applicable so as to provide a
clear indication of existing conditions. For ten-year maintenance dredging permits,
indicate the dewatering/disposal sites for future dredging events, if known.
4. Describe the method of dredging (i.e. clamshell, dragline, etc.) and the expected
duration of dredging.

5. Indicate the physical nature of the material to be dredged (i. e. sand, silt, clay,
etc.) and provide estimated percentages of the various cons'titP,ents if available. For
beach nourishment projects, grain size analysis data is required.

6. Describe the method of dredged material containment (i.e. hay bales,
embankment, bulkhead, etc.) and whether return flow from the dewatering/disposal
site would reenter any waterway. Also indicate if there would be any barge
overflow. .
MOORING FACILITIES
Answer the fol/owing if your project includes the construction or rehabilitation of
recreational mooring facilities.
1. It is generally recommended that any fixed piers and walk ramps be limited to four
feet in width, and that floats be limited to eight feet in width and rest at least two
feet above the waterway bottom at mean low water. Terminal floats at private, non-
commercial facilities should be limited to 20 feet in length. If you do not believe
your proposal can meet with these recommendations, please provide the reason{s).
2. Using your plan view, show to scale the location(s), position{s) and size(s)
(including length, beam and draft) of vesse/{s) to be moored at the proposed facility,
including those of transient vessel(s) if known.
3. For commercial mooring sites such as marinas, indicate the capacity of the facility
and indicate on the plan view the location{s) of any proposed fueling and/or sewage
pumpout facilities. If pumpout facilities are not planned, please discuss the rationale
below and indicate the distance to the nearest available pumpOllt station.
4. Indicate on your plan view the distance to adjacent marine structures, if any are
proximate and show the locations and dimensions of such stf'(¡ctures.

5. Discuss the need for wave protection at the proposed facility. Please be advised
that if a permit is issued, you would be required to recognize that the moorina
facility may be subject to wave action from wakes of passing vessels, whosë
operations would not be required to be modified. Issuance of a permit would not
relieve you of ensuring the integrity of the authorized structure{s} and the United
States would not be held responsible for damages to the structure{s} and vessel{s}
moored thereto· from wakes from passing vessels.
BULKHEADING/BANK STABILIZA TION/FILLlNG ACTIVITIES
Answer the following if your project includes construction of bUlkheading {also
. retaining_walls and seawalls} with backfill, filling of waters/wetlands, or any other
bank stabilization fills such as riprap, revetments; gabions, etc.
1. Indicate the total volume of fill (including backfill behind a structure such as a
bulkhead) as well as the volume of fill to be placed into waters of the United States.
The amount of fill in waters of the United States can be deteimined by calculating
the amount of fl71 to be placed below the plane of spring higb tide in tidal areas and
below ordinary high. water in non-tidal areas.
2; Indicate the source{s} and type{s} of fill material.
3. Indicate the method of .fill placement {i.e. by hand, bulldozeF, crane, etc.}. Would
any temporary fills be required in waterways or wetlands to provide access for
construction equipment? If so, please indicate the area of such waters and/or
wetlands to be filled, and show on the plan and sectional views.
The foregoing requests basic information on the most common types of projects
requiring Department of the Army permits. It is intended to 15bviate or reduce the
need for requesting additional information; however, additional information may be
requested above and beyond what is requested in this form.-

NARRATIVE STATEMENT
East Ramp Reconstruction
Fishers Island Ferry District
April 5, 1996
This narrative statement is intended to be an Executive Summary of the proposed east ramp
reconstruction project as well as providing direct information solicited in the environmental form
ENG Form 4345 Supplement for the U.S. Army Corps of Engineers permit application.
Project Description:
This project is the reconstruction of the east ramp utilized by the Fishers Island Ferry in
Silver Eel Cove on Fishers Island. The scope of work includes removal of an existing 14' wide
by 24' long steel and wood ramp, counterweight towers, protective dolphins (3 pile) and a ramp
support beam structure. The new work will include placement of approximately 65LF of steel
sheet piling waterwa!d of the high tide line, including a tie-back system into the existing bank,
placement of a new pile supported ramp support beam, with pile braces, ramp support framework
and bmnper, counterweight towers, protective 3 pile dolphins and an 18' wide by 24' long steel
and wood ramp.
The new sheet piling will be placed 2 to 3 feet in front of the existing steel sheet piling
which faces to the north and 5' .:t in front of the sheet piling along the easterly edge (side) of the
ramp illld access drive. Prior to driving sheet piling along the northerly face the stone scour
protection laying on the bottom sediments will have to be removed and stock piled to permit
driving of the sheet pile and then replaced in front of the sheet piling for scour protection. The
sheet piling along the· easterly edge of the ramp must be 5' beyond the existing sheet piling in
order to provide adequate room to accommodate the new wider ramp as shown in the application
drawings.
Project Purpose:
The existing ramp and bulkheading system at the east end of Silver Eel Cove was built
approximately 30 years ago. The entire system has corroded and deteriorated extensively and
must be replaced in order to provide the Ferry District with a second loading slip on the island
for use during peak periods or when -adverse weather necessitates using the more protected slip.
Adjacent Property Owners:
The Town of Southold owns land adjacent to the Fishers Island Ferry Terminal site both on
the east and west waterfront edges.

Environmental Impact Statement prepared for the New York State DEC joint permit application.

Alternatives:
There are only 3 real options for the Ferry District to pursue at this time. The do nothing
option is not considered viable or appropriate because the existing east ramp is in such condition
that failure to rehabilitate the structure will necessitate the discontinuance of its use.
The next option is to reconstruct the ramp exactly the way it is today, however, the existing
ramp is too narrow to properly serve either ferry, MY RACE POINT and MY
MUNNATAUCKET, the beams of which are 33' and 3D' respectively. The existing ramp does
not land on the center of the vessels but favors the port side in both cases, thus requiring vehicles
to be maneuvered, sometimes adversely, to disembark but more importantly to load the vessel.
It is in the best interest of operational efficiency and safety to have the ramps centered on the
ferries.
The option selected is the best option because it will provide a wider ramp for easier vehicle
maneuvering and the ramp will be almost exactly centered for both existing ferries. This
widening will require the existing sheet pile embankment retention structure and ramp support
to be wider as well, thus yielding the configuration depicted in the application drawings.
Bulkheading I Bank Stabilization I Filling Activities:
The total amount of fill to be placed behind the bulkhead will be approximately 70 CY.
This constitutes fill waterward of the existing sheet pile bulkhead. The fill will be clean granular
material providing a suitable pavement support base and sub-base and will be topped with hot
mix asphalt binder and surface courses. Fill will be placed by mechanical methods, probably
dumped in bulk, graded and compacted in layers to assure uniform compaction throughout the
10 foot vertical height from existing bottom sediments to fuùshed grade. There will be no need
for temporary illl and no wetlands will be disturbed as a result of this project.
Accessory Structures:
The proposed counter weight lifting towers, dolphins and ramp support beam and bumper
system will be virtually identical to the structures that now exist for the CUlTent east ramp. The
will. just be located in a position which will allow for the proper operation of the wider ramp.
