Permit Modification
Dear Mr Neitson:.
The Department of State has reviewed the information you submitted on September 2, 1997 regarding a
modification to the project that was authorized bv COE/NY Permit g~97-03510-L2. The proposed
modification would result in the widening of the pier ~nd ramp from 4' to 6' to provide handicap access.
The project as modified would not cause coastal zone effects substantially different than those originally
reviewed by this Department. Therefore, the Deparunent has no objection to the proposed permit
modification.
A copy of this letter is being sent to the Corps of Engineers informing that federal agency of this
determination. If you have any questions on this matter, please call Gary J. Haight ar (518) 474-6000.

This letter is to be placed with the file of Residential Permit #4738 Modification. It has been
bo ~ught to my attention that the Board does not normally approve of residential docks in excess of 4' in
width. Tho proposal before you is for a dock 6' in width.
The reasoning for this request centers around the inal~ty of my mother- Katherine
Weymouth- and my aunt- Margaret Ogden- to see clearly. They both suffer a condition known as
Macular Degeneration, which allows them only peripheral vision. Walking down a narrow dock
unassisted is virtually impossible for each of them. Walking with another person is much safer;
however, four feet is unduly restrictive especially taking into consideration handbags and/or tote bags.
Additionally, storage facilities for miscellaneous marine supplies and equipment are ~pera~e for this
proposed dock. A standard dock box is 6' long by 27" wide. The simple math indicates less thart half
of the approved 4' width would be available for transit. For someone with impaired vision, this a
prohibitive dimension.
I am very concerned that a four foot wide dock would prohibit access for both my Mother and
Aunt (both visually handicapped). As a result, I am asking thc Board to consider appro'vfl~g the
proposal 6' width citing the special circumstances involved. Additional~, there arc six docks, two to
the west and four to the eas~ that are 6' or more in width~ I urge the Board to consider these
circumstances during its deliberations.

Reynolds duPont, Fishers Island
In accordance with our conversations last week, we have revised the application drawings
for a new fixed and floating dock facility at property owned by Reynolds duPont, Jr. on
Peninsula Road, Fishers Island. I have provided the length of the ramp as requested in your most
recent correspondence and clarified the tie-off piles that Mr. duPont intends to install. Ma.
duPont has informed me that his fixed pier and ramp need to be 6 feet wide, in lieu of the
original 4 feet requested, in order to accommodate the special needs of his family.
Since this adds only 100 square feet to the structure, and since there is no significant
aquatic or benthic habitat beneath the dock which will be affected by the increased coverage, it
appears clear that there will be no significant environmental impact associated with this increased
width.
I trust that you will find these revised drawings adequate for your approval and look
forward to receipt of the requested permit. By copy of this letter we are submitting duplicate
drawings to the Town of Southold Trustees and the U.S. Army Corps of Engineers. Please let
me know if the need for further discussion arrises.

Dear Mr.Neilson:
The following action was taken by the Board of Town Trustees
during its regular meeting held on April 30, 1997 regarding the
above matter:
WHEREAS, Docko, Inc. on behalf of REYNOLDS DUPONT applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of So~thold, application dated
March 24, 1997, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings, and
recommendations, and
WHEREAS, a Public Bearing was held by the Town Trustees with
respect to said application on April 30, 1997, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth, in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,'
RESOLVED, that the Board of Trustees grant a Wetland Permit to
construct a 4' X 50~ fixed timber pier, a 3' X 14' hinged ramp,
and a 8' X 20' float to be secured to four pilings and install
six tie-off Pilings, and,
BE IT FURTHER RESOLVED that this determination should not be
considered a detezmination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two. years from the date
it is signed. Fees must be paid, if applicable, and permit

Background Information -
The duPont family has just acquired the site, identified on SuffoLk County assessors map
for the Town of Southold District 1000, Section 010, Block 3, Lot 19, copy included in this
application package. The property slopes down moderately to the south and has a pre-existing
stone wall approximately 4 feet high, forming a shorefront erosion protection barrier and
embankment stabilization which needs to be retained and maivtained. They wish to install a
small dock system for recreational boating. The site is located in a tidal wetland area, by
definition, subject to flooding, however, our preliminary coordination with the NYS DOS has
yielded no information regarding sensitive wildlife or aquatic vegetation which might be impacted
by the project. In addition, our site visit has confirmed no such sensitive environmental features.
Photographs of the site and inter-tidal zone accompany this application to document coastal and
environmental features.
ENVIRONMENTAL QUESTIONNAIRE -
General:
The proposed fixed and floating dock system is to support recreational boating at the
duPont property. Maintenance of the stone wall is not needed at the current time, however,
there is no knowledge of the pemdt stares of this structure and it is therefore considered prudent
to permit all existing/proposed structures simultaneously.
The names and addresses of adjacent property owners ar shown on the application
drawings and listed on the US ACOE application. Photographs of the site and work area are
enclosed with this form..Both photographs are taken from Vartardan's dock to the west looking
back at the shoreline and proposed dock area. Environmental assessment is limited on this
project. The dock structure is open, wood pile and timber construction, and will not adversely
affect water flow patterns, circulation or water quality. The only options were shorter or longer
docks or no dock. A shorter dock would have the float and boat in the bottom sediments at low
tide; a longer dock is not needed for small recreational boats. In addition, too long a dock
would possibly have navigational impacts in Pirates Cove. The no dock option is not desirable
since recreational boating access would then not be possible except to have the boats lay on the
mud against the wall at low tide. The proposed dock is consistent with other facilities in the area
and is considered reasonable and appropriate. Ability to maintain the wall is considered essential
to protect the embankment stability and prevent erosion induced by rising and falling tides.
Mooring Facilities -
i. It is requested that the fixed 4' wide pier/walkway to the floating dock be 50 feet in lieu
of the normal 20' length limit. The reason for this is to obtain access to water
approximately 3 feet in depth for berthing of the duPont's motorboats. 3 feet is
considered the minimum reasonable depth for these vessels because of the draft of the
boat and prop when the motor is extended in order to avoid bottom contact during
berthing or initial maneuvering.

The plan view for this project indicates the distance to adjacent marine structures. Sheet
2 of the plans shows the approximate distance to the Sorenson's dock to the east while
Vattanian's dock to the west is shown.
There is no need for wave protection at the proposed facility. Pirates Cove is an
extremely well protected body of water where the only wave action is induced by boat
wakes. The existing wall to be maintained is nonetheless considered to be a necessary
shorefront erosion protection feature because of the f'me sandy material constituting the
embankment. Even slight disruptions of the water caused by tidal fluctuations can erode
this sandy material.
Bulkheading / Bank Stabilization / Filling Activities -
There is no proposed work on the existing stone wall at this time. This request is to
validate [ permit the existing stone wall shorefront embankment erosion protection structure for
future maintenance if and when necessary. As a result, volumes of filling and area of coverage
cannot be predicted. Any such material used to rebuild the wall would consist of existing
materials which have fallen out of place supplemented by stone so prevalent on Fishers Island.
The sources of these materials is inevitably clean; Method of placement would in most cases be
by hand rather than machinery due to the limitations of the site and the size of existing stones
(that being approximately 1 cubic foot in size on the average). The limits of work will be limited
to the existing wall size and configuration.
