Southold Town Board of Appeals
February 18, 1960
A regular meeting of the Southo!d To~.m Board'of
Appeals was held 7~30 P.M.~ Thursday, February 18~ 1960,
at the Town Clerk Office, Main Road, Southold, New York.
There were present: Messrs. 'Robert W, Gillispie, Jr.,
~nairman~ Robert Bergen, Herbert Bosenberg, sm~d Charles
Grigonis~ Jr.
Also present: M~. Howard M. Terry, Building Inspector.
Absent: Mr. Serge Doyen, Jr.
PUBLIC _W2~ARING: 7:30 P.M.~ Appeal No. 2~ - Upon appli-
cation of Richard C. Whitlock, Tuckers Lane, Southold~ New
York, for a variance in accordance with the ZOning Ordinance~
Article III, Section 300, Subsection l, for permission to use
for a two family dwelling the premises located on the north-
east side of Tuckers Lane, Southold~ New York, bounded north
by ~ailroad, east by R. P. Booth~ south by Tuckers Lane and
west by Tuckers Lane. Fee paid $1~.00.
The Chairman opened the hearing by reading notice of
disapproval issued by the Building Inspector, application
for a variance and legal notice of hearing with affidavit

attesting to its publication in the official newspaper.
CHAIBi~AN: There is a sketch here in the file which
indicates they intend essentially to divide the house down
the middle.
Is there anyone present who wishes to speak for this
application?
PR. RICHARD C. WHITLOCK, Tuckers Lane~ Southo!d, New
YOrk: I think I have stated my reasons quite thoroughly in
the application. If you will look at the sketch, it will
make a very nice apartment. I have been approached by several
people we know who are looking for an apartment.
C~I~L&N: Is. there anyone else present who wishes to
speak for this application? Is there anyone present who
wishes to speak against this application?

CHAIRM~d~: I would like to say for the record~ that it is
not permitted for this Board to consider a financial hards~p
because that is a hardship common to all of us. In my opinion
I believe this would be an improvement to the neighborhood and
you are changing this from a rooming house to a two family
dwelling and is an improvement for reasons which you state.
MR. WHITLOCK: We feel the same at home because roomers
are not an asset. They are a bother.
Resolution was offered by ~. Bergen: seconded by Mr.
Grigonis and carried~ W~-~F~A8 application of Richard C.
Whitlock having been considered at Public Hearing No. 2~ on
February 18~ 1960, and the Board finding that strict appli-
cation of the Ordinance would produce undue hardship because
the house~is much too large as a one family dwelling and would
be ideal as a two-family dwelling. The situation is unique
and would not be shared by all properties alike in the i~mmediate
vicinity because none of the properties in the area are as
large or as old' as this residence. The public convenience
and welfare and justice will be served and the legally
established or permitted use of neighborhood property and'
adjacent use districts would not be substantially or perm-
anently injured and the spirit of the Ordinance would be -
observed because there will now be a permanent two family
residence instead of a one family residence with roomers.
There will be no structural changes made to indicate two
families~ therefore be it

The minutes of the meeting of February ~, 1960~ on motion
of ~. Rosenberg~ seconded by Mr. Grigonis~ and carried~ were
approved as submitted.

Mr. Rosenberg, and Mm. Grigonis.
Mr. Ralph L. Glover~ $outhold, New York, appeared before
the Board of Appeals to present his application for a variance~
appealing from the decision of the Building Inspector. Mr.
Glover is requesting approval of access to his two rear lots
on property on the south side of North Sea Drive~ Southold.
This access was determined to be 20 ft. wide. He intends to
build a rental cottage if this access is approved.
On motion of ~. Rosenberg, seconded by Mr. Bergen and
carried~ it was RES. OLV~) that the Board of Appeals set 7:30
P.M. (E.S.T.)~ Thursday, March 3~ 1960, Town C$ rk 0ffice~
Main Road~ Southold~ New York as time and place for hearing
upon application of Ralph L. and Una Belle Glover~ East Main
Street, Southold, New York~ for recognition of access in accord-
ance with State of New York To%~ Law, Section 280A. Location
of property: south side North Sea Drive, southold, New York~
bounded north by other lauds of the'applicant~ south by
Margery Burns~ east by Donald Hauck~ and west by Blanche
Siebert and others.

accordance with the Zoning Ordinance~ Article III~ Section

map of Nassau Point Club Properties~ Inc.

Rosenberg and carried, the Board of Appeals RESOLVED to set
8:00 P.M. (E.S.T.), Thursday, March 3, 1960, Main Road,
Southold, ~Uew York, as time and place for hearing upon appli-
cation._,of Claudio Giovanelli~ and Frederick L. Schultze,
d/b/a ~. & $. Service Station, Route 2~, Greenport, New York,
for a special exception in accordance with the Zoning 0rd~ance
Article IV, Section 400, Subsection 9, for ~rmi~sion to erect
and maintain a public garage on property located on the south
side of Route 2~, Greenport, New York, bo~ded north by Main
Road, east by Robert Brown, south by Railroad and west by
E. E. Jotmuson.
Vote of the Board: Ayes:- Mr.Gillispie, ~. Bergen,

carried, it was RESOLVED that 8:10 P.M. (E.S.T.)~ Thursday~
March 3, 1960, Main Road~ Southold, New York, be set as time
and place for hearing upon application of Claudio Giovanelli
and Frederick L. Schultze, d/b/a G. & S. Service Station, Route
2~, Greenport, New York, for a special exception in accordance
with the Zoning Ordinance, Article IV, Section 400, Subsection
9, for permission to erect and maintain a gasolineservice station
on property located on the south side of Route 2~, Greenport, New
York, bounded north by Main Road, east by Robert Broom, south by
Railroad, and west by E. E. Johnson.
Vote of the Board: Ayes:-

and carried that hearing upon application of H. J. Mitchell,

for permission to erect and maintain a directional advertising
sign on the land of Julia Wickham Estate~ located on the north
side of Route 2~, Arshamomaque, bounded north by Albertson Lane,
southeasterly by Route 2~, and west by Cassidy Farm, be set at
8:20 P.M. (E.S.T.), Thursday, March 3, 1960 at the Town Clerk
Office, Main Road, Southold, New York.

application of Louis Komarek, a/c First National Bank, Greenport,
New York, for a special exception in accordance with the Zoning
Ordinance, ~krticle III, Section 300, Subsection ll, for permission

northwest side.of land of Edwin H. King, south side of Route
27A, Greenport, New York.

It was further RESOLVED that legal notice of hearings
be~published in the official newspaper under date of February
.2~, 1960.

Mr. A. H. Lutz~ proprietor of a food market in Mattituck,
and Mr. W. V. Duryee, proprietor of a hardware store in
Mattituck, appeared before the Board of Appeals for an informal
discussion, lv~. Lutz explained that they represent 21 merchants
along Love Lane and Pike Street who have joined together and wish
to call that section the Mattituck Shopping Center. Their present
problem is directional signs. On County Route 27A, approximately
200 Feet east and west of Love Lane~ there are now two signs
about 2 ft. by 3 ft. They wo~2d like to enlarge and refinish
those two signs. The question is enlarging and moving them
back and forth according to the wishes of the landlords. Mr.
Lutz stated there was also a sign on the south side of Route
2~ on the Silk~orth corner which was about ~ ft. by 8 ft. The
sign had been overhauled and reinstalled about two years ago~
but the County, when working on Route 2~ removed the sign and
it has not been replaced. They would like to find a new
location for the sign because they cannot put it up in the same
place again. The Board advised that~in cases where the State road
program caused removal of signs they had permitted the relocation
of the sign in some instances, for example, motels and restaurants~
and the Board definitely feels the Shopping Center to be in the
public interest. It was decided by i~M. Lutz and Mr. Duryee that
they would look for new locations of the several signs and then
come before the Board of Appeals to see if the proposed locations
would be satisfactory.
The Board of Appeals received an application for a variance
from George Bird~ 843 East Main Street~ Riverhead, appealing
from the decision of the Building Inspector on application for
building permit Z971. Mr. Bird has po~chased Lot No. 21 at
Lupton Point from ~. Walter Grabie. This lot has a 7~ ft,
frontage on Lupton Point Road and 100 ft. on Deep Hole Creek
with a depth of 237 and 27~ ft.
The Board decided to forward a letter to ~. Bird calling
his attention to Article X, Section lO00A which reads as
£ollows: "No lot shall be sold, divided or set off in such a

manner that either the portion sold~ divided~, or set off~ or
the portion remaining shall have an area and/or open spaces
of less than that prescribed by this Ordinance for the district
in which said lot is located." Therefore the Board did not
schedule ~.~. Bird's appeal for hearing.
The Board of Appeals received a letter from Robert H.
Preston~ Greenport~ New York stating that it is his desire
to sell parcels of land on Sterling Creek at Greenport 20 ft.
by 7~ ft. These parcels to be used as boat slips with no
structures except a boardwalk dock. Mr. Preston wished to
know if there would be any objection as far as zoning is
concerned. The Chairman advised he would sperm to Robert
Ta~ker~ To~m Attorney~ in regard to this matter.
The next meeting of the Southold Town Board of Appeals
will be held 7:30~P.M.~ March 3, 1960 at the Town Clerk
Office~ Main Road~ $outhold~ New York.
