Dear Ms. Rorke:
Please be advised that at the present time, we are
respectfully requesting to modify this application you
currently have under review. The requested modification is
to relocate the "Limits of Clearing" to a point greater than
100' landward of the Freshwater Wetlands line flagged by
Department staff. With this, I believe that the entire
project is now located outisde of the Department's
jurisdiction under Article 24 of the Environmental
Conservation Law. For your review, ~e have enclosed copies
of the modified survey as prepared by Chandler, Palmer & King
last dated June 21, 1996. Please be advised that on this
past Tuesday, June 25, 1996, I accompanied Mr. Charles T.
Hamilton and Mr. Steven Lorence of the Division of Natural
Resources as well as Mr. James King of the Southold Town
~Board of Trustees during their inspection of this project
site.
As always, should you have any comments or questions
regarding this request, please feel free to contact our

that the construction of a house is out of the Trustee
juriSdiction, under.the Wetland Ordinance under Chapter 97 of
the Town Code.
However any activity within 75 feet of the Wetlands line would
require a peamit from th~s office.
