PROJECT DESCRIPTION
Applicant proposes to maintenance dredge an existing inlet to
a depth of -- 1 1/2 to -2' at ALW. Dredge spoil shall consist
of beach stone and gravel. + 190 e.¥. of material shall be
dredged and placed on adjacent beach, above AHW. Material
will be spread evenly with a maximum depth of 10". Proposed

Dear Mr. Just,
The following action was taken at the Southold Town Board of
Trustees meeting on July 22, 1998:
RESOLVED, that the Southold Town Board of Trustees approve the
request for an Amendment to Permit #4556 to install erosion
protection at the 8th tee itself. The proposal is to remove the
existing wooden timber ties located adjacent to the tee, install
the "boulder barrier" which will consist of a deep layer of rock
chips on the fabric and then placing 2-4 ton boulders on top of
the chips on a 2:1 to 1.5:1 slope using no grout. This
revetment will be 116+' long and shall vary in width from 20 to
30' and shall be located 10+' above the AHW line. The Trustees
request that there be vegetation planted in any of the 'voids'
in the rock placement. Located: East End Road, Fishers Island.
However, this does not constitute approval from any other
agencies.

Dear Mr. Krupski:
At the present time, we are seeking to modify this
permit which was issued on 1/29/96 and amended on 1/30/97
and is due to expire on 1/29/98. (copy enclosed) We have
obtained approvals on behalf of the Club to install a
"boulder barrier" rock revetment along the 8th Fairway. At
this time, the Club is seeking approval to install erosion
protection at the 8th Tee itself. The proposal is to remove
the existing wooden timber ties located adjacent, to the tee,
then'to install the "boulder barrier" which will consist of
placing filter, fabric~on the existing slope, placing a 1"
deep layer.of rock chips on the fabric and then placing 2-4
ton boulders on top of the chips on a 2:1 to 1.5:1 slope
using no grout. The~ revetment shall be ± 116' long and shall
vary in width from 20'-.30' and shall be located ± 10' above
the AHW Line. Any disturbed areas shall be revegetated with
Rosa rugosa 3' o/c and American Beach Grass 6" o/c.

Inspections
1. The permitted site or facility, including relevant records, is subject to in-
spection at reasonable hours and intervals by an authorized representative of
the Department of Environmental Conservation (the Department) to determine
whether the permittee is complying with this permit and the ECL. Such represen-
tative may order the work suspended pursuant to ECL 71-0201 and SAPA 401(2). A
copy of this permit, including all referenced maps drawings and special
conditions, must be avait~able '
for inspection by the Department at all times at
the project site. Failure to produce a copy.of the permit upon request by a
Department representative is a violation of this permit.
Permit Changes and Renewals
2. The Department reserves the right to modify, suspend, or revoke this permit when.
a) the scope of the permitted activity is exceeded or a violation of any
condition of the permit or provisions of the ECL and pertinent regula-
tions is found~
b) the permit was obtained by misrepresentation or failure to disclose
relevant facts-
c) new material information is discovered; or
d) environmental conditions relevant technology, or applicable law or
regulation have materiall~ changed since the permit was issUed,
3. The permittee must submit a Separate written application to the DePartment for
renewal, modification or transfer of this permit. Such application must include
any forms, fees or supplemental information the Department requires. Any
renewal, modification or transfer granted by the Department must be in writing.
4. The permittee must submit a renewal application at least:
a) 180 days before expiration of permits for State Pollutant Discharge
Elimination System (SPDES), Hazardous Waste Management Facilities
(HWMF). major Air Pollution Control (A?C) and Solid Waste Management
Facilities (SWMF). and
b) 20 days before expiration of all other permit types.
5, Unless expressly provided for by the Department, issuance of this permit does
not modify, supersede or rescind any order or determination perviously issued by
the DePartment or any of the terms, conditions or requirements contained in such
order or determination.
Other Legal Obligations of Permittee
6. The permittee has accepted expressly, by the execution of the application, the
full legal responsibility for all damages,I direct or indirect, of whatever
nature and by whomever suffered,'arising out of the project described in this
permit and has agreed to indemnify and save harmless the State from suits,
actions, damages and costs of every name and description resulting from this
project,
This permit does not convey to the permittee any right to trespass upon the
lands or interfere with the riparian rights of others in order to perform the
permitted work nor does it authorize the impairment of any rights, title, or
interest in real or personal proPerty held or vested in a person not .a party to
the permit.
The permittee is responsible for obtaining any other permits, approvals, lands,
easements and rights-of-way that may be required for this project.

revocation of this permit the structure, fill, excavation, or other
modification of the watercourse hereby authorized shall not be com-
pleted~ the owners, shall, without expense to the State, and to such
extent and in such time and manner as the Department of Environmental
Conservation may require, remove all o~any portion of the uncompleted
structure or fill and restore to its former condKion the navi~abfe
and flood capacity of the watercourse, No claim shall be made against
the State of New York on account of any such removal or alteration.
10 That the State of New York shall in 'no case be liable for any damage
or ir~jur¥ to the structure or work herein authorized which may be caused
by or result from future operations undertaken by the State f6r the
conservation or improvement of navigation, or for other purposes, and
no claim or right to compensation shall accrue from any such damage.
11. Granting of ti]is permit does not relieve the applicant of the responsi-
b[lity of obtaining any other permission, consent or approval from
the U.S~ Army Corps of Engineers, U.S. Coast Guard, New York State
Office of General Services or local government which may he required.
12. All necessary precautions shall be taken to preclude contamination
of any wedand or waterway by suspended solids, sediments, fuels,
solvents, lubricants, epoxy coatings, paints, concrete, leacbate or any

13, An,,, material dredged in the prosecution of the work herein permitted
shall be removed eveniy, without leaving large refuse piles, ridges across
the bed of a waterway or floodplain or deep holes that may have a
tendency to cause damage to navigable channels or to the banks of
a waterway.
14. There shall be no unreasonable interference with navigation by the work
herein .aut.h. orized.
15. If upon the expiration o~ revocation of this permit, the project hereby
authorized has not been completed, the applicant shall, without expense
to the State, and to such extent and in such time and manner as the
Department o[ Environmental Conservatiort may require, remove att or
any portion of the~uncompreted structure or fill and restore the site
to its former condition. No claim shall be made against the State of
New York on account of any such removal or alteration.
16, If granted under 6 NYCRR Part 608, the NYS Department of Enviror)-
mental Conservation hereby certifies that the subject project will not
contravene effluent limitations or other limitations or standards under
Sections 301, 302, 303, 306 and 307 of the Clean Water Act of 1977
(PL 95-217) provided that all of the conditions listed herein ar~ met.
17. All activities authorized by this permit must be in strict conformance
with the approved plans submitted by the applicant or his agent as part
of the permit application.

SPECIALCONDITIONS
1. Any debris or excess material from construction of this project
shall be completely removed from the adjacent area (upland) and
removed to an approved upland area for'.disposal. No debris is
permitted in tidal wetlands and or protected buffer areas.
2. There shall be no disturbance to vegetated tidal wetlands or
protected buffer areas as a result of the permitted activity.
3. All areas of soil disturbance resultin~ from this project shall
be stabilized immediately followin~ project completion or prior to
permit expirationj whichever comes first. The approved
methodologies are as fOllows:
stabilization of the entire disturbed area with appropriate
vegetation (grasses, etc.).
stabilized as per specifications identified on approved plans.
temporarily stabilized with straw or hay mulch or jute matting
or other similar natural fiber mattin~ within 1 week of final
~radin~. Temporary stabilization shall be maintained until a
mature vegetative cover is established.

5. Ail peripheral berms, cofferdams, rock revetments, seawAlls,
gabions, bulkheads etc. shall be completed prior to placement of
any fill mat~riat behind such structures
6. Ail dredged material shall be disposed on an approve~ upland
site and be retained so as to not re-enter any water body, tidal
wetland or protected buffer area. I
7. Excavated. sediments shall be placed directly into the approved
disposal site or conveyance vehicle. No sidecasting (double
dipping) or temporary storage of dredge material is authorized.
8. No dredging shall occur within 15 linear feet of the seaward
edge of the vegetated tidal wetland.
9. Dredging is prohibited' from June 1 - September 30 of each year
to protect spawning shellfish and/or spawning finfish.
t0. The use of a dragline for dredging is sErictly prohibited.
11. Dredging shall be undertaken no more than once in any calendar
year unless specifically authorized by the Department.
12. Within 30 days of completion of dredging operation, a dredged
depth survey of the dredged area shall be submitted to the Region
i Bureau of Marine Habitat Protection, 'SUNY Building 40, Stony
Brook, NY 11790-2356. Attention: Compliance
13. For' maintenance dredging projects, permittee shall submit a
Notice of Commencement prior to each dredging occurrence,
specifying the disposal site (including an updated site plan).
Upon completion, a Notice of Completion specifying the amount of
dredged material deposited at the approved disPosal site must be
submitted.
14. A staked filter cloth fence must be installed along APHW prior
to commencement and remain in place until dredge project is
completed.
15. Dredge material may not be placed greater than 10" deep on
beaCh (dredge material area).
16. A staked filter cloth fence shall be installed at edge of
tidal wetlands prior to commencement and remain in place until
project is completed in its entirety. .
17. No jetting or trenching of C-Loc ~etaining wall is authorized,
it must be driven into substrate for installation.

18. Ail retaining wall installation must be supervised by an
environmental monitor who will insure no alteration to the
vegetated tidal wetlands will occur. Daily reports will be
submitted to the Regional Supervisor of N~tural Resources qf status
of project.
19. Ail placement of fill at the 14th hole will be supervised by
an environmental monitor to insure no alteration to the vegetated
tidal wetlands occurs. Environmental monitor will report to 'the
Regional Supervisor of Natural Resources of daily status of
project.
20. Staked haybales and silt curtain shall be installed at edge of
wetlands on 14th hole prior to commencement and remain in place
until fill area is vegetated.
21. Maintenance dredge area is to be no deeper than 2' below mean
low water.

SUPPLEMENTARY SP~.CIAL CONDITIONS
The following conditions apply to all Tidal Wetlands; Freshwater
Wetlands; Coastal Erosion Management; and Wild, Scenic, and
Recreational Rivers Permits:
A copy of this permit, including all conditions and
approved plans, shall be available at the project site
whenever authorized work is in progress. The permit
sign ehclosed with the permit shall be protected from
the weather and posted in a conspid6ous location at the
work site until all authorized work has been completed.
The permittee shall require that any coDtractor,
project engineer, or other person responsible.for the
overall supervision of this project reads, understands,
and complies with this permit and all its general,-
special, and supplementary special conditions. Any
failure to comply precisely with all of the terms and
conditions of this permit, unless authorized in
writing, shall be treated as a violation of the
Environmental Conservation Law. If any of the permit
conditions are unclear, the permittee shall contact the
Division of Regulatory Affairs at the address on page.

If project design modifications become necessary after
permit issuance, the permittee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit. .~
At least 48 hours prior to commencement of the project,
the permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequen~ years.
The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.

retaining wall and placing fill in the walled area and then plant area
with turf.
3. Elevate the grade of the fairway and rough in the area adjacent to
the 1L[th hole. In an area of +13,600 s.f. clean material and +2/~6
c.y. of topsoil to be used to raise the area 2'-36'. All disturbed
area to be seeded and mulched.

authorization for the installation of a low-profile retaining
wall and elevation of an existing tee area by 1.5 feet at the
15th hole at the Fishers Island Country Club.
Since the proposed work shown on the Proposed Construction
Plan, prepared by Chandler, Palmer & King, dated April 12, 1993
does not appear to include dredging or construction activities in
or over any navigable waters of the United States, the placement
of any dredged or fill material in any waters of the United
States (including coastal or inland wetlands) or the
accomplishment of any work affecting the"course, location,
condition or capacity of such areas, a Department of the Army
permit will not be required. In addition, the delineation of
wetlands shown on said plan appears accurate based upon'site
photographs provided by J.M.O. Consulting.
Care should be taken so that any fill or construction
materials, including debris, do not enter the waterway to become
a drift or pollution hazard. You are to contact appropriate
state and local government officials to ensure that the subject
work is performed in compliance with their requirements.

Dear Mr. Xrupski:
At the present time~ we are writing you regarding three
separate projects we are currently applying for approvals
for; all of which are located on the Fishers island Country
Club. For your review, we have enclosed copies of
applications, project descriptions~ photographs and plans for
each of the projects.
The first project is the proposed maintenanc.sJdredging
of an inlet connecting an un-named tidal pond and East
Harbor. This site is located in that area adjacent to the
i4th Tee. This project involves the maintenance dredging of
the inlet and utilizing the spoil for the nourishment of the
adjacent beach.
The second project involves raising the elevation of the
iSth Tee by installing a low'profile retaining wall and
placing fill in the walled area and then planting area with
turf. The object of this project is to elevate the tee area
+ 1.5
The third project is to elevate the grade of the fairway
and rough in the area adjacent to the 14th Hole. It will

part of the consideration for the issuance of the Permit does understand and prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of 5outhold are released from any and
all damages, or claims for damages, of suits arising directly or indirectly as a remflt of any oper-
ation performed pursuant to this permit, and the said 'Permittee will, st his ox her own expense,
defend any and all such suits initiated by third parties, and the said Permittee.assumes full [iabRity
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

5. That there will be no umeasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no intirference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That ff future operations of the Town of Southold require the removal and/or alterations
in fl~e location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstructton to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permlttee ot the completion of the work auth-
oxized.
9. That the Pe'rmittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject *o revoke upon failure to obtain same.

Dear Mr. Just:
The following action was taken by the Board of Town Trustees
during its regular meeting held on January 26 1996 regarding
the above matter: ,
WHEREAS, J.M.O. Consulting on behalf of FISHERS ISLAND GOLF
COURSE applied to the Southold Town Trustees for a permit under
the provisions of the Wetland Ordinance of the Town of Southold
application date November 13, 1995, and, ,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 26, 1996, at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning thiq application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grants a Wetland Permit to
restore an eroded shoreline by installing a boulder slope and
reconstruct/repair existing dune. The ro os ·

disturbed or eroded wall be revegetated with American which were

Grass planted 12 on center. Apprex. 410' eroded dune shall be
restored by placing approx. 750 c.y. of clean sand, which shall
be trucked in from an upland source, along eroded shoreline.

BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for ahy other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire two years from the date
it is signed if not started. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

State concurs with your consistency 'certification. This concurrence is without prejudice to, and does not
obviate the need to obtain all other applicable licenses, permits, and approvals required under existing State
