Dear Mr. Krupski:
At the present time, I am writing you on behalf of the
Fishers Island Country Club. The Club is attempting to
obtain a determination of jurisdiction for the new practice
area which construction began on last fall. The site is
located greater than 75' from the existing tidal wetlands
line.
At this time, the Club is also interested in extending
the existing irrigation system into the practice area. They
a~e also planning to finish the work on the three (3) "sand
bunkers" by trucking in approximately 80 c.y. of clean sand.
The golf course superintendent, Mr. Robert Johns, Has already
installed a silt fence for erosion con'trol and shall maintain
the fence until such time the work on the practice area is
complete.

Based on the information you have submitted, the New York State
Department of EnviroDmental Conse~--vation has determined that:
Therefore, in accordance with the current Tidal Wetlands Land'Use
Regulations (6NYCRR Part 661) no permit is required under the Tidal
Wetlands Act . Please be advised, however, that no construction,
sedimentation, or disturbance of any kind may take place seaward of
the tidal wetlands ~urisdictional boundary, as indicated above,
without a permit. It is your responsibility to ensure that all
necessary precautions are taken to prevent any sedimentation or
other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction which may result from your
project. Such precautions may include maintaining adequate work
area between the tidal wetland jurisdictional boundary and your
project (i.e. a 15' to 20' wide construction area) or erectin~ a
temporary fence, barrier, or hay bale berm. '
Please be further advised that this letter does not relieve you of
the responsibility of obtaining any necessary permits or approvals
from other agencies. ~

Dear Mr. Krupski:
At the present time, we are seeking a determination of
jurisdiction for this project. Presently, the applicant is
proposing to construct a 20' x 40' addition onto an existing
maintenance building. The addition shall be utilized for the
storage of chemicals normally associated with the operation
and maintenance of a golf course. The proposed addition
shall be located 86' landward of the Freshwater Wetlands Line
as located recently by Mr. Charles T. Hamilton of the
N.Y.S.D.E.C. The proposed addition shall be located on the
landward side of the existing maintenance building. Prior to
and during all phases of construction, a continuous line of
staked hay bales shall be placed between the existing
building and the limits of the wetlands.
At this time, we have a Freshwater Wetlands Application
pending before the N.Y.S.D.E.C. and have already obtained
approval from the Suffolk County Health Services to construct
a Toxic/Hazardous Materials Storage Facility (copy enclosed).

Your application for a permit to construct the project described
above has been reviewed for compliance with Article 12 of the
Suffolk County Sanitary Code. The application has been approved
with the following conditions:
1. The storage .facility will be constructed in accordance
with the approved plan. A copy of the approved plan must
be kept at the construction site.
2. The tank(s) will be used in the service specified in the
Permit to Construct as approved by this office.
3. The tank and all monitoring devices will be maintained in
accordance with Article 12 requirements and best industry
practice.
4. Any changes in the use of the tank or modifications to the
tank must be approved by the Department.'
5. Ail safe construction practices shall be followed during
the installation of the tank.
6. The tank installation contractor is strictly prohibited
from substituting items of equipment clearly listed on the
plan without the written consent of the Department. The
contractor must~also advise the owner that' equipment sub-
stitutions are being made.
You must contact John Gladysz of this office at 854-2524 at least
48 hours prior to commencement of any work to arrange for the re-
quired construction inspections.
The storage facility cannot be placed into service until this
department performs a final installation inspection and issues an
interim permit to operate.
The documents submitted in support of this application for a per-
mit to construct pursuant to section 760-1206 of Article 12 of
the Suffolk County Sanitary Code was reviewed for compliance with
Articles 7 and 12 of the Sanitary Code only.

forcement office for any additional requirements that may apply
to your project.
You have one year from the date of this notice to construct your
project. You can renew your application any time during the year
after the construction permit expires. There is a $100 fee for
this renewal.
If the Department does not receive a renewal application for this
project within the year after the construction permit expires,
the application will become void and you will be required to
refile a new application for a permit to construct. All ap-
plicable fees will become due and payable.

P~oject Description
For the llth green applicant proposes to install a
boulder barrier to repair/protect shoreline damaged during
storms of December 1993. Barrier shall be installed by
trucking in from an opland source 2-4 ton stones which
shall be placed on filter cloth. A 1' thick layer of'rock
chips shall also be utilized. There is no fill involved
with project. All work shall be located appr6x. 30'
above the MHW line. Any eroded/disturbed areas shall be
revegetated with "Rosa rugosa" (3'o/c) and American beach
Grass (6"o/c). Barrier shall be approx. 175' long and
shall vary in width from 20'-25'
For t6th tee applicant proposes to install two
boulder barriers (65~'x35') and (120~x35T) to repair/protect
shoreline which was damaged during storms of December 1992.
Barrier shall be installed by trucking in from an upland
source, 2-4 to~ stone which shall be placed on filter cloth.
A 1' thick layer of rock chips shall also be utilized. Ail
work shall be located approx. 70' above the MHW line. There
is no fill involved with project. Any eroded/disturbed areas
shall be revegetated with "Rosa rugosa" ~(3'o/c) and American
Beach Grass (6"o/c)
For the 15th tee applicant proposes to install approx.
225' of either timber retaining wall or "C-LOC" retaining
wall. Wall shall be constructed aroun~ existing tee area~
Approximately 150 c.y. of topsoil and loam shall then be
placed on top of area of tee to raise elevation approx. 2~
The area of tee shall then be revegetated with turf material.

DESCRIPTION OF ACTIVITY: For the llth green applicant
proposes to install a boulder barrier to repair/protect
shoreline damage during storms of December 1993. Barrier shall
be installed by trucking in from an upland source 2-4 ton stones
which shall be placed on filter cloth. A 1' thick layer of rock
chips shall also be utilized. There is no fill involved with
project. All work shall be located approx. 30' above the MHW
line. Any eroded/disturbed areas shall be revegetated with
"Rosa Rugosa" (3' o/c) and American Beach Grass (6" o/c).
Barrier shall be approx. 175' long and shall very in width
from 20' - 25'.
For 16th tee applicant proposes to install two boulder
barriers (65' X 35')and (120' X 35') to repair/protect
shoreline which was damaged during storms of December 1992.
Barrier shall be installed by trucking in from an upland source,
2-4 ton stone which shall be placed on filter cloth. A 1' thick
layer of rock chips shall also be utilized. All work shall be
located approx. 70' above the 5554 line. There is no fill
involved with project. Any eroded/disturbed areas shall be
revegetated with "Rossa Rugosa" (3' o/c) and American
Beach Grass (6' o/c).
For the 15th tee applicant proposes to install approx. 225'
of either timber retaining wall or "C-LOC" retaining wall.
Wall shall be constructed around existing tee area. Approx.
150 c.y. of topsoil and loam shall then be placed on top of area
of tee to raise elevation approx. 2' The area of tee shall
then be revegetated with turf material. The purpose is to
prevent the flooding of the tee area during periods of storm and
lunar tides.
Date of permit issuance: July 29, 1993
This permit is valid for a period of two years from the date of
issuance.
SPECIAL CONDITIONS:
NA Bluff restoration through a re-vegetation agreement is
attached hereto and is a necessary special condition of this
permit.
NA A relocation agreement is attached hereto and is a
necessary special condition of this permit.
NA A maintenance agreement is attached hereto and is a
necessary special condition of this permit.
