We are ~iting to request that ~u inspect o~ creekfront property on yo~ next
field trip, to see the build-up of sand along the creek and in front of o~ b~k-
heading on the east side of B~sh's Creek. It has rendered use of o~ waterfront
property practically impossible.
We all ~ow that the mouth of B~sh's Creek, (like others), is constantly filling
~th s~d and in need of dredging. However, to compo~ this situation, the
Board of Trustees appears to have given Richard Zeidler carte bl~che as far as
bringing in sand. He has it continually piled higher than the b~eading; it
then washes into the creek d~ing hea~ wind and s~f action, filling the creek
area adjacent to his b~ead. ~is is of no concern to h~, s~ce the mouth of
B~sh's Creek is dredged a~ually ~d his bul~eading is kept clear ~d deep.
However, in the 21 years we have been living here, and despite const~t requests
to go farther up to o~s, they have never dredged beyond the edge of his property.
As a result, the spoil has been building up beyond this dredging point over~ the
years, compo~ded more recently by the additional sand brought in. We now have
o~ o~ sandy beach along o~ portion of the creek. ~e build-up in front of
o~ bul~eading is almost as high as the b~eading, itself, m~g it very
difficult to keep a boat there.
~e of the pict~es show< the latest 60 yards that was brought in a few weeks
ago, which hasn't yet ha~ a ch~ce to acc~ulate in front of o~ property. ~at
you see in another picture is pr~arily the afte~ath of last year's ad~tion
of sand.
We have put our house on the market and, of course, o~ potential p~chaser is
a boater. However, ~y wo~d be buyer loses interest once he views o~ "sand
bar".
We wo~d like you to: (1) Intercede ~th those who desi~ate the areas to be
dredged, to try to convince them to remove the spoil that has buil~up along o~
portion of the creek, ~d beyond if possible. ~ey say there's ~d there, but
this s~d is many feet above where ~y ~d would be enco~tered. It threatens
to render the creek ~usable soon .... ~d (2) to li~t and monitor the ~o~t
of s~d o~ nei~bor is pe~itted to bring in.

Gentlemen:
It has become increasingly obvious that much of the bulkheading along
B~ash's Creek in Laurel, south of Peconic Bay Boulevard, will have to be
replaced very soon.
We replaced our bulkheading in 1993-94. At that time the Board of Trust-
ees insisted we remove the old, before putting in the new. We did this
under protest, since it was primarily basin-front not creekfront, aund at
great additional expense. We were told then ~hat anyone wishing to out
in new bulkheading along Brush's Creek would have to do the same.
We are writing to remind you of this circumstanqe, so that there is no
misunderstanding when other bulkheading along the creek is required to be
repaired or replaced.
It cost considerably more for us to adhere to your mandate, (to remove
250' of bulkheading), in time, labor and disposal fees~ before install-
ing the new material.
We would be very distressed if this same procedure was not imposed upon
subsequesnt applicants. In fact, we would be forced to litigate, should
it not be equitably imposed on other landowners.
We appreciate your continued interest in keeping Brush's Creeek a viable
waterway and protecting the already narrow span of the creek.

SPECIAl CONDITIONS
1. A copy of this permit with' supplementary conditions and approved plans
must be available at the project site whenever authorized work is in
progress.
2. The permit sign enclosed with the permit or a copy of letter of approval
must be protected from the weather and posted in a conspicuous location
at the work site until completion of authorized work,
3. At least 48 hours prior to commencement of the project, the permittee
must complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that form must also be completed
and returned.
4. If the permittee intends to undertake any project design modifications
after permit issuance, the permittee must submit the appropriate plan
changes for approval by the Regional Permit Administrator prior to
undertaking any such modifications. The permittee is advised that
substantial modification m~y require submission of a new application for
permit.
5. All repairs to existing structures are confined to replacement of
existing structural elements with no change in design, dimension or
materials unless specifically authorized herein.
6. Construction of bulkhead and return walls must be completed prior to
placement of any fill material behind such structures.
7. Use of timbers (wood) treated with pentachlorophenol is strictly
prohibited.

8. All fill must be from an approved source and consist ef clean gravel and
soil. Use of asphalt, slag, fly ash, broken concrete or demolition
debris is prohibited.
9. All fill must be graded to match the elevation of the land immediately
adjacent to the bulkhead.
10. Contamination of tidal wetlands and the waters of New York State by
suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings,
paints, concrete, leachate or any ether environmentally deleterious
materials associated with the project is prohibited.
11. Any debris or excess material from construction of this project must be
immediately and completely removed from the adjacent area and disposed of
at an approved upland site. Disposal of debris in tidal wetlands is
prohibited.
12. Any bulkhead constructed directly adjacent to vegetated tidal wetland is
to be jetted in with minimal disturbance to the tidal wetland. Trenching
is strictly prohibited.

13. Any debris or excess material from construction of this project shall
be completely removed from the adjacent area (upland) and removed to an
approved upland area for disposal. No debris is permitted in tidal wetlands.
14. There shall be.no disturbance to Vegetated tidal wetlands as a result of the
permitted activity.
15. Prior to the removal of the existing bulkhead, the permittee shall excavate
'all backfill and suitably retain it so as not to re-enter the waterway. Once
the new bulkhead is in place the backfill may be returned in place and
augmented by the approved 35 cu. yds. Of clean fill.

lowing:
I. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or clalmq for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permit'tee will, at his or her own expense,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

We wish to thank you fort%Rking the time to inspect our bulkheadino yes-
terday, (September 26th). As you could see, it has deteriorated beyon~
repair, particularly with the latest damage inflicted by Hurricane Bob,~l
and must be replaced.
As discussed, we are writing to request permission to replace approximately
207 feet of it "in kind, in place". 160 feet on the basin and 47 feet along
Brush's Creek, withua ten foot return.
Enclosed is..a copy of a survey, showing the dimensions and layout. You
may already have a copy on file, since we had applied for permission to
replace a portion of the easterly corner back in 1983-84, but were never
able to go forward. A copy of that permit, and the D.E.C. notice is also
enclosed.
Our bulkheading is probably 'grandfathered!, having been installed back in
the t940's and, hopefully, this circumstance will enable you to give us
quick permission to start the new installation. We are concerned that its
precarious condition will not withstand the effects of another winter's
tidal action, and would like to have the work done before that time.
This work will be contracted by the James H. Rambo Company of Bishop's
Lane, Southampton.
We will appreciate your favorable consideration and look forwardl~to an
