Dear Mr. McGahan:
The following action was taken by the Board of Town Trustees
during its regular meeting held on April 30, 1997 regarding the
above matter:
WHEREAS, Bay Creek Builders on behalf of FRANK SCAVONE appt~ed
to the Southold Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southotd, application
dated Aprit 10, 1997, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advis.o~Council for their findings and
recommendations, and
WHEREAS, a ~hlic Hearing was held by the Town Trustees with
respect to said application on April 30, 1997, at Which time all
interested persons, were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises, in question and the surrounding arear
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure c~mplies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that theproject as proposed
will not affect the health, safety' and general welfare of the
people of the town,

Dear Mr. Harnillon:
Al[er the thoroughly exhaustive and painful process of dealing with your dep~.r~ment, I
finally had the experience of meeting Louis Chiaretla and hhe Southold Board o.[ 'l'rusrees
on April 23 --at my property. [ am. now of the opinion that Region I of the Ne,*' 'fork State
D.E.C. is not only ineompemm but gross.:'y abusive of their authority. Louis Chiare!la
had the audaciPf to sta~e ff~a~ a piton of action which required an expenditure of S30.000
should no~ be considered a significant impediment to it's implementation- App;~endy,
either Mr. Cfi~eJla is a wealthy man or the D.E.C pays ouite well.
When I POinTed out the unfairness of his statement, Mr. Chiaret!a stated twice in row, in
an aggressive, reprimanding and condescending fashion, that he had nothing to lose in
cmmection with his evaluation of my property. He could not hax, e been less pro£essional.
He even threatened to walk offmy property if my "to~e" with him did not change and
dared me to ~'just push his bu=on~" as if he were looking for mt excuse to end the
