The following action was taken by the Board of Town Trustees during
its regular meeting held on July 28, 1994 regarding the above matter:
WHEREAS, Proper-T Permit Services on behalf of EDWARD HINDERMANN
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated July 5, 1994, 1994 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on July 28, 1994 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and arefamiliar
with the premises in question and thesurrounding area, and,
WHEREAS, the Board has considered al% the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that the Board of Trustees approves the application of
Proper-T Permit Services on behalf of EDWARD HINDERMAlfN to
construct a fixed open walkway 3' X 4!', a hinged ramp 3' X 12' and a
floating dock 6' X 2Q'. Also install two 2-pile dolphins to secure
floating dock. The dock shall not extend out any further than
neighboring docks. Located 405 Pierce Drive, Cutchogue.
Permit will expire two years from the date it is signed. Two
inspections are required and the Trustees are to be notified upon
completion of said project. NOTE: This is a transfer of permit to A. Filipowicz,

Gentlemen:
We are the attorneys for Edward F. and Joan Hindermann who
conveyed their residence at 405 Pierce Drive, Cutchogue, New York
(SCTM 1000-136-1-7.1) to Artur M. Filipowicz and Halina
Filipowicz, husband and wife, and Arthur J. Bortz and Dana
Fitipowicz Bortz, husband and wife, on September 16, 1994.
As attorneys for the Hindermanns, you are hereby authorized
to transfer Permit #4362 to the above mentioned purchasers. I
have discussed this transfer with the Hindermanns and they have
given me their authorization tow rite this letter.

Recommendations
July 21, 1994
RESOLVED to recommend to the 'Southold Town Board of Trustees
DISAPPROVAL AS SUBMITTED the Wetland Application of LUIS PORTAL
70-5-52 to construct a L~' X 20' catwalk; 4' x 10' ramp; 6' x 18' float;
install (8) pilings; dredge to 3' below MLW on south side of float to a maximum
of 20' out from MHWM.
The CAC recommends disapproval of the dock as submitted but would
approve a shorter version of the dock. The dock should not be any longer
than that of the dock on the adjacent property to the east. The submitted
version was too long and would create navigational problems. Also, the
southerly piles must be removed. There is no need for them and t~hey would
be a danger to navigation.
In addition, the Council approves a minimum of dredging and the dredge
spoils must be hauled off site.

WITFI STIPULATIONS of the Wetland Application of EDWARD ~IlNDERMAN
136-1-7.1 to construct a fixed open walkway 41' x 3'; hinged ramp 12' x 3';
and floating dock 20' x 6'; install two 2-pile dolphins to secure floating dock.
The Council recommends approval with the stipulations that the walkway be
a minimum of 4' above the vegetation and that applicant replant all spartina
damaged during the work.

DISAPPROVAL of the Wetland Application of HENRY LATHAM 66-2-~ to
amend permit for bulkheading and request permission to place 100 - 300 lb.
armor stone immediately seaward of 57' of that bulkhead.
The Council recommends disapproval because there is no need. Council
suggests the applicant plant beachgrass. (NOTE: Applicant has indicated to
CAC members that he plans to withdraw the application.)

for replacement of existing 75' bulkhead, in kind/in place..
The' Council recommends approval with the understanding that applicant
DO NOT TOUCH the 25' to the west, work must begin from that point and also
that a sand buffer is needed.
