Box 1179 Southold, New York 11971 It is my/our understanding that we are to maintain this structure with materials designed'to endure 30 years and or equivalent to the original approved structure and that for any maintenance which.involves more than 5% in length of this structure we are to give prior written notice to the administrator, waiting for their approval in all but true emergency situation's which would seriously endanger life, property and important coastal natural resource features such as bluffs or wetlands. The permitted site or facility, including relevant records, is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmentai Conservation (the pepartment) to determine whether the permittee is complying with this permit and the ECL. Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. Permit Changes and Renewals 2. The Department reserves the right to modify, suspend or revoke this permit when: a/ the scope of the permitted activity is exceeded or a violation of any condition of the permit or provisions cf the ECL and pertinent regulations is found; b) the permit was obtained by misrepresentation or failure to disclose relevant facts; c) new material information is discovered; or d~ environmentai conditions, relevant technology, or applicable law or regulation have materially changed since the permit was issued. 3. The oermittee must submit a separate written application to the D6partment for renewal, modifica- tion or transfer of this permit. Such application must include any forms, fees or supplemental infor- mation the Department requires. Any renewal, modification or transfer granted bY the Department must be in writing. 4. The permittee must submit a renewal application at least: a) 180 days before expiration of permits for State Pollutant Discharge Elimination System (SPDES), Hazardous Waste Management Facilities (HWMF), major Air Pollution Control (APC) and Solid Waste Management Facilities (SWMF); and ~) 30 days before expiration of ali other permit types. 5. Unless expressly provided for by the Department, ~ssuanc~ o th~s permit does not modify, supersede or rescind any order or determination previously issued by the Department or any of the terms, con- ditions or requirements contained in such order or determination. Other Legal Obligations of Permittee 6. The permittee has accepted expressly, by the execution of the application, the full legal responsibili- ty for ail damages, direct or indirect, of whatever nature and by whomever suffered, arising out of the project described in this permit and has agreed to indemnify and save harmless the State from suits, actions. 0amages and costs of every name and description resulting from this project. 7. Article XXI~, Section 100-244B of the zoning code provides for a setback at not less than 10 feet as a minimum in one side yard, and minimum of 15 feet in the other side yard, for a total of both sides yards at not less than 25 feet. 5. It is the opinion of the Board that the relief requested for setbacks of 4.5 feet and at 5.0 feet to the property line is substantial in relation to the requirement- The percentages requested are: (a) 50% reduction on the westerly side; (b) 55% on the easterly, side; (c) 62% reduction for total sideyards. No variance is being requested for the setback from the low bank or the front yard area. The setback is shown on the March 23, 1993 survey prepared by Roderick VanTuyl, P.C. to be 100 feet or more from the low bank (8' contour near the highwater mark) The front yard set~ack is required to be a minimum of 35 feet, and the applicant is proposing a front yard at 48 feet to gain width for the sideyards. 6. In considering this application, the Board also finds and determines: (a) that the grant of the side yard relief as requested will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; (b) that although the uniqueness of the property due to the size and character of the property do lend to the difficulties in this proposal, the percentage of relief requested for a reduction between 50% and 62% of the requirements is personal to the applicant or landowner; (c) that the variance requested is not the minimum necessary to afford relief and there is an alternative available with a greater side yard setback for minimal relief; (d) that the grant of the relief requested will set Page 3 Appl. No reasonable~ prudent alternative site or method is available. b~ Adverse impacts anticipated from coastal erosion process on the system can be mitigated~ c. Because the location of the sanitary system is in front of the dwelling and at a higher than grade elevation the development of a sanitary system will be reasonably safe from ~lood and erosion d~=auageo do The variance requested is the minimum necessary to overcome the practical difficulty of siting and constructing a sanitary system with sufficient elevation above ground water to meet sanitary codes and the h~'SDEC Tidal Wetlands Permit. e. There are no public funds utilized for this project, no long term adverse effects are anticipated to public utilities or properties in the area. He has advised me that he is the contract vendee on certain property immediately to the west of Town beach and is intending to build a single family dwelling on this -undersized" piece. He advises that he made application for a variance to the Zoning Board of Appeals at or about the same time that this municipality was enacting our Coastal Erosion Management Act. Therefore [and quite properly) the Zoning Board ~he advises) did not act but rather referred him to the Trustees. He claims to have made prompt application to the Trustees and has attempted through his consultant. Roy Haje. to comply with the various Board's requests, in fact. he advises that he has already secured DEC approval for the construction of a single family dwelling on the premises. ~Nhat is troubling to me is he has shown me a survey which shows thereupon a proposed house as well as a potential relocation site for %he house, which he claims to have prepared pursuant to the request of the Trustees. To say that Mr. Petikas is confused would be a vast understatement. My suggestion is that perhaps representatives from your Boards can meet with me. absent the applicant, to discuss how this matter can be handled as expeditiously as possible, since Mr. Petikas seems more than willing to comply with whatever requests the Boards are making in order to facilitate and expedite this matter.
