Pending sanitary approval for 45.5 under#R-21-2478 Dear Heather: The owners are Kaplan (1000-70-4-45.3) and 2515 Calves Neck Road LLC (1000-70-4- 45.5). The Kaplan parcel has an application to upgrade the existing sanitary system and relocate it out of DEC and Trustee's jurisdiction. When the Health Department application was filed,the Health Department notified us that a"lot line change"had occurred after 1981. Upon investigation, we learned that the prior owners of both adjacent parcels had split the vacant lot between them and made each parcel larger. Each parcel is over 40,000 in a r-40 zoning district. The Health Department notice from December 16th is attached. The Health Department has requested either a letter or approval from the Town for the previously split parcel. Enclosed is our application for the existing subdivision/lot line modification of the two adjoining parcels. Each lot had tax map numbers which have now been retired: 1000-70-4-43,44, and 45 Lot 45.3 was a described property owned by Hendrickson which was created by deed prior to zoning and improved prior to zoning with a single-family dwelling. Lot 45.5 owned by Blankley was a described property created by zoning and improved with a single-family dwelling. In 1989 the owner of 45.3 (Kramer)conveyed part of the parcel to his neighbor,Blankley,Lot 45.5. In 1996 Blankley sold the oversized combined parcel to Anderson. Multiple permits on both post-split parcels have been issued by the Town of Southold(see CO's). Only when the current owner of 45.3 applied to the Suffolk County Health Department to update their existing sanitary system with an I/A system did the two owners discover that the split had occurred in 1989. A change to the property lines after 1981, according to the Health Department,requires a"subdivision"application to the Health Department. The transfer of land from an oversized parcel(larger than the minimum zoning requires) where the oversized parcel remains above the minimum lot size required, and where no new development potential will be created in the parcel to which the land is transferred. 2. The transfer of land between two or more parcels, all of which are currently developed and can produce legal certificates of occupancy,which results in no new development potential. 3. The transfer of land between two or more parcels, vacant or developed,where the SCDHS has previously approved the subdivision map, and where the two lots will remain at or above the minimum lot size required by zoning. 4. Other situations where the Planning Board finds the amount of land being transferred is negligible will result in no additional residential units being developed, and that there will be no impact to wetlands or other sensitive environmental features. The Planning Board shall formally waive the requirement for SCDHS approval by resolution prior to their decision resolution. The following language shall also be included in every Planning Board decision resolution containing the waiver of the requirement for SCDHS approval: `The Southold Town Planning Board, in waiving the requirement for SCDHS approval prior to their own approval, is simply waiving a technical requirement of final plat approval under the Town Code and makes no representations as to whether SCDHS approval is required. SCDHS approval of this lot line change may be necessary to be in compliance with the Suffolk County Sanitary Code, and to be eligible for future construction or renovations.'
