The following action was taken by the Board of T~*n Trustees
during its regular meeting held. on Wedmesday, February 19, 1997
regarding the above matter:
WHEREAS, GardSne~s Bay Estates Homeowners Association applieclto
the Southold Town Trustees for a per,git under the provisions
the Wetland Ordinance of the Town of Southold~ application~ate~
January 21, 1997, and,
WHEREAS, said application was referred to the SoutholdTown
Conservation Advisory Council for ~heir findings
recommendations_,
WHEREAS, a Public Hearing was hel~bythe Town Trustees with
respect to said apDtication on ~ebx~aary 19, 1997, at whi~ktim~
all interested persons were given an. opportunity to be hear~
and,
WP~2dZAS, the Board members have personallF viewe~ an~ are
f~miliar with the premises 5n question and the surr~na%ng are~,
and,
WHEREAS, the Board has considere~ all the testimony and
documentation submitted concerning this application., and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

The following rec6mmen'~lation was passed at the Southold Town Conservation'
Advisory Council meeting which was held Friday, February 14, 1997:

Moved by Kenneth Meskill, seconded by Scott H|lary, it was
RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of GARDINERS BAY
ESTATES HOMEOWNERS ASSOCIATION, INC. 37-5-23 to install 100 +/- linear
feet wood retaining wall, repair existing retaining wall, deteriorated planking.
The Councils recommends approval with the stipulation that applicant minimize
any disturbance to shoreline during the repair.

Dear Gentleman:
we have re'Cently rece'ived a copy of the Joint Application
for permit you filed with the New York State Department of
Environmental Conservation (NYSDEC).
Please be advised we have reviewed the copy of the Joint
Application sent to this office by NYSDEC. Based solely upon the
information provided, it appears that a Department of the Army
permit is not required for your proposal.
The Department of the Army regulates construction activities
in navigable waterways and ~ischarges of ~redged ~T ~i~l matg~ial
into waters o~ the United States, including inland and coastal
wetlands. If your proposal would involve such work, and has not
been portrayed as such in your Joint Application, you should
contact this office immediately so that a project-specific
determination can be made as to whether a Department of the Army
permit will be required.
