The following action was taken at the Southold Town Board of
Trustees meeting on August 26, 1998:
RESOLVED, that the Southold Town Board of Trustees approve the
request for an Amendment to Permit 369 to remove a 4' X 36'
section of fixed dock and 16 pilings and replace it with a 6' X
36' float and 5 pilings, add a 6' X 6' float to connect to
existing floats that are to remain, and 2 existing ramps are to
be replaced with one new ramp.
However, this does not constitute approval from any other
agencies.

received a request for Department of the Army authorization for
the following activity:

ACTIVITY:
Remove a 36 foot by 4 foot section of an existing
fixed pier and 16 existing mooring piles; install
a 36 foot by 6 foot float secured to five pilings,
a 4 foot by 6 foot connecting float, and a 3 foot
by 13 foot walk-ramp. The purpose of this project
is to provide adequate mooring facility.
WATERWAY: Sterling Basin, Shelter Island sound
LOCATION: Greenport, Town of Southold, Suffolk County, NY
As this is minor in nature, authorization ma~' be by Letter
of Permission. This is in accordance with current Federal
Regulations governing work in navigable waters of the United
States. To accomplish the coordination'required, prior to the
issuance of a Letter of Permission, your review of the enclosed
drawings is requested.-
Pursuant to Section 307 (c) of the Coastal Zone Management
Act of 1972 as amended (16 U.S.C. 1465 (c) (3) (A)), the applicant
has certified that the activity complies with and will be
conducted in a manner that is consistent with the approved state
coastal zone management program.
To allow for the timely processing of the subject
application, your comments are requested within 15 days of the
date of this letter.

Gentlemen,
I request that the existing permit for my dock be amended to allow a deteriorated section
of dock (fixed) be replaced with a floating section.
The work to be performed would be to remove a 4'x 36' section of fixed dock and 16
pilings and replace it with a 6' x 36' float and 5 pilings, plus a 6' x6' float to connect to
existing floats that are to remain. Two (2) existing ramps are to be replaced by one (1)
new ramp.

and use. This documentation outlines the section to be removed, in addition to that wh/ch

SPECIAL CONDITIONS
TIDAL WETLANDS
1. Any debris or excess material from construction of this project
shall be completely removed from the adjacent area (upland) and
removed to an approved upland area for disposal. No debris is
permitted in tidal wetlands and or protected buffer areas.
2. Floats and ramps may not rest on or be stored in any vegetated
tidal wetland.
3. Floats/pilings may not (a) extend laterally beyond property
lines, (b) be placed so that docked boats extend over adjacent
property line, (c) interfere with navigation, (d) ~interfere with
other landowners riparian rights.
4. The use of wood treated with pentachlorphenol in the
construction of structures that will be in contact with tidal
waters is strictly prohibited.
5. Dock reconstruction or replacement or seasonal installation
.shall not involve expansion or substantial modification of existing
structures or facilities. '
6. Installation of additional docks at marinas, boat basins, or
or'her commercial facilities is not authorized by this permit.
7. No dredging, excavating or other alteration of shoreline or
underwater areas is authorized by this permit, nor shall issuance
of this permit be construed to suggest that the Department will
issue a permit for such activities in the future.

If project design modifications become necessary after
permit issuance, the permit=ee shall submit the
appropriate plan changes for approval by the Regional
Permit Administrator prior to undertaking any such
modifications. The permittee is advised that
substantial modification may require submission of a
new application for permit.
At least 48 hours prior to commencement of the project,
the Permittee and contractor shall sign and return the
top portion of the enclosed notification form
certifying that they are fully aware of and understand
all terms and conditions of this permit. Within 30
days of completion of the permitted work, the bottom
portion of that form shall also be signed and returned,
along with photographs of the completed work and, if
required, a survey.
For projects involving activities to be undertaken in
phases over a period of more than one year, the
permittee shall notify the Regional Permit
Administrator in writing at least 48 hours prior to
recommencing work in subsequent years.
The granting of this permit does not relieve the permittee
of the responsibility of obtaining a grant, easement, or
other necessary approval from the Division of Land
Utilization, Office of General Services, Tower Building,
Empire State Plaza, Albany, NY 12242 (516) 474-2195, which
may be required for any encroachment upon State-owned lands
underwater.
