between new and old retaining walls is necessitated%y
presence of improvements such as fish pond located close
behind existing wall which will not allow tie back system

Dear Members of the Board:
Please be advised that I represent Anthony Scarmato, who has
received a Notice of Violation dated July 8, 1998 (a copy of
which is annexed hereto) regarding a fence located at 235
Huckleberry Hill Road, East Marion, New York.
The Notice of Violation alleges that my client is in
violation of the Code of the Town of Southold, Chapter 97,
Article II, Section 20 in that he does not have a Trustee Permit
for the fence. As you are well aware, this fence was erected in
1973 after Qbtaining a building permit from the Southold Town
Building Department. At that time, no Trustee Permit was
required, as acknowledged by the Bay Constable. As a result, the
fence was lawfully erected and no further work of any kind
relating to said fence has occurred in over twenty-five (25)
years.
Chapter 97 of the. Southold Town Code, Section 97-20, states
in relevant part: "...no person shall conduct operations
(emphasis added) on any wetlands in the Town of Southold, unless
he shall first obtain a written permit therefor issued by the
authority of the Trustees .... " Section 97-13 defines the word
operations as follows:
A. The removal of materials from wetlands.
B. The deposit of materials on wetlands.
The erection, construction, alteration or enlargement of
any building, dock, pier, wharf, bulkhead, jetty, groin
or other structure, temporary or permanent, on
wetlands.
It is abundantly clear that my client is, in no way,
conducting any operation on any wetlands, as said term is defined
by the Code. Absolutely no work of any kind has been performed
regarding said fence since it was erected in 1973. It is
