SPECIAL CONDITIONS
During construction, concrete or leachate shall not escape or be d~scharged, nor shall
washings from transit mix trucks, mixers, or other devices enter tidal wetlands and or
protected buffer areas.
Any debris or excess material from construction of this project shall be completely
removed from the adjacent area (upland) and removed to an approved upland area for
disposal. No debris is permitted in tidal wetlands and or protected buffer areas.
There shall be no disturbance to vegetated tidal wetlands or protected buffer areas as a
result of the permitted activity.
The storage of construction equipment and materials shall be confined to within the
project work site and or upland areas greater than 25 linear feet from the tidal wetland
boundary.
Dock or timber catwvalk shall not exceed 4 feet in width and shall be a minimum of 3 ½
feet above grade* over tidal wetland areas (* as measured from ground to bottom of dock
sheathing).
The use of wood treated with pentachlorophenol in the construction of structures that will
be in contact with tidal waters is strictly prohibited.

Floats and ramps may not rest on or be stored in any vegetated tidal wetland.
No dredging, excavating or other alteration of shoreline or underwater areas is authorized
by this permit, nor shall issuance of this permit be construed to suggest that the
Department will issue a permit for such activities in the future.
No permanent structures may be installed on dock/catwalk/float without first obtaining
written Department approval (permit, modification, or amendment).
Docks/catwalks/floats may not (a) extend laterally beyond property lines, (b) be placed so
that docked boats extend over adjacent property line, (c) interfere with navigation, (d)
interfere with other landowners riparian rights.
No structures are to be constructed on pilings without further authorization of the
Department.

The following action was taken at the Southold Town Board of
Trustees meeting on January 28, 1998:
RESOLVED, that the Southold Town Board of Trustees approve the
request for an Amendment to Permit 359 to change an existing "T"
dock to an "L" by installing a 4' X 25' fixed dock connecting to
existing 4' X 15' catwalk, install existing 6' X 16' float on
north side in an "L" configuration, install existing 4' X 14'
ramp to access float from dock with 3- 2 pile dolphins, as per
new drawings and plans submitted and received January 27, 1998.
Located: 60 Harbor Lights Drive, Southold.
However, this does not constitute approval from any other
agencies.

This letter shall serve to confirm the concession and
compromise of the Southold Town Trustees, at our on-site meeting
January 21, 1998, in regard to the modified dock configuration.
The enclosed plans have been revised pursuant to the recommenda-
tions of the Trustees.
The catwalk has been reduced from 16' to 15'.
The proposed fixed dock has been reduced from 28' to 25'.
· The distance from the end of the dock to the bulkhead on
the opposite side of the canal has been increased from 49' to
53'.
I trust this is a now acceptable to all parties and our
modification request can be concluded at your meeting scheduled
for january 18, 1998.

Dear Mr. Krupski:
I was advised by Trustee Peter Wenczel, that the Board of
Trustees will make an on-site inspection prior to your next
meeting to evaluate the width of the canal as it relates to our
proposal. Mr. Wenczel also requested that we supply the Board
with additional photographs and measurements from the end of the
floating dock (in proposed position) to the bulkhead on the other
side of the canal.
I am enclosing photographs that were taken at the site this
morning. The measurement from the seaward end of float (in
the proposed position) to the bulkhead on the othe side of the
canal is 49'. Placement of our client's 8' wide sailboat along
side the float would leave 41' to the opposite side of the canal
for other boats to navigate.
I realize it is a policy of the Board that "all docks with a
boat at it shall be no further than 1/3 across the width of the
creek". Although a visual inspection of the canal is deceiving
and appears narrow, the entire width from our client's bulkhead to
the bulkhead on the other side of the canal is 95'~ (16' catwalk,
14' ramp, 16' float and 49' channel). The proposed configuration
of our dock is less than 1/3 across the waterway aind will not
impede or restrict navigation.
I would like the opportunity to meet with the~ Board at the
site when they inspect the property. Please let me know the date

Dear Mr. Krupski:
As a follow-up to my recent application submittal, my
telephone conversation with Diane and my subsequent conversation
with Mr. Simon, I would like to offer the following information:
The Board of Trustees approved a Wetland Permit, ~359, issued
with application #310 on December 23, 1986 for the existing dock.
The dock was permitted to extend up to Mr. Simon,s property line
that extended out into the canal because at that time ~here were
covenants and restrictions prohibiting the structure from extend-
ing beyond that point. Although En-Consultants processed the
Permit applications, Robert Tasker,'Esq. represented Mr. Simon to
resolve the question regarding the seaward limits of the dock
construction as it related.to the covenants and restrictions.

Mr. Simon wishes to change the configuration of his dock from
a "T' to an "L", by using the existing float and adding one addi-
tional float. This configuration will add approximately 10' to
the length of the structure and will provide an adequate amount of
water to accommodate his sailboat.
As you can see in the photographs previously provided, the
existing float has been temporarily positioned to show there will
be ample room for access and navigation near and on all sides of
the canal and adjacent to.

to use it. Although, there is no formal "property owners
association,,, for this canal, those living along it maintain it
in a joint neighborly effort.
Upon receipt of copies of the dock permit and property deed,
I will forward copies of same to you for your files. If you have
any questions, please feel free to call me. In the meantime, we
would ask the Board to approve an amendment to the existing permit
at your meeting scheduled for October 29, 1997.
