Dena, Jr. 21 Gramercy Park South, Apt. 3C New York, NY 10003 RE: Permit #1-4738-01163/00001 Dear Mr. Dena: On November 10, 1995 the Department issued the above referenced permit allowing you to construct a bulkhead with fill on your property in Southold. Since the issue date of this permit, DEC staff from the Division of Fish and Wildlife have visited your site and confu'med nesting activity of the endangered piping plover (Charadrius melodus) on the beach east of your residence. Nesting shorebirds are highly vulnerable to human disturbance associated with construction activities occurring between March 15th and August 31st. Such disturbance could significantly affect their nesting behavior and reproductive success. Therefore, in order to protect this valuable natural resource, the Department intends to modify your permit pursuant to 6NYCRR Part 621.14 (Uniform Procedures) to include the following Special Condition: Due to the documented occurrence of a New York State endangered species, vehicular beach access to and from the project site between Goldsmith's Inlet and the western most terminus of Salt Marsh Lane is prohibited from April 15th to August 31st, 1997. During the calendar year of 1998, the prohibition dates shall be March 15th to August 31st. Mr. Elino U. You may submit to the Department within 15 calendar days of the date of this letter, a statement giving reasons why the permit should not be modified or a request for a hearing, or both. All bolts shall be T~pe, and shall be galvanized. Steel sheet piles shall be driven by approved methods in such a manner as not to subject the steel sheet piles to serious injury and to insure continuous interlocking throughout the length of the steel sheet piles, kny obstructions e~countered in driving the steel sheet piling shall be removed or otherwise disposed of so as to permit the proper installation of the steel sheet plllD~.. Any steel sheet piling, which at any time becomes damaged, displaced, separated from adjacent sheets or otherwise injured, shall be withdrawn and replaced with new steel sheet piling at the expense of the Contractor. 5.2 Walers Walers shall be continuous and shall be bolted to each sheet. 5.3 Filter Fabric The filter fabric shall be placed below the armor stone and around the toe stone as indicated in the Contract Drawings. 5.4 Armor Stone Armor stones shall be set as shown on the drawin~s, with filter fabric under the stones. Stones shall be set at least three (3) stones high and three (3) stones wide.
