The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, March 21, 2007:
RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to
Permit #4664 to replace 14 pilings with 6" pilings in order to adequately support the
dock.
Any other activity within 100' of the wetland boundary requires a permit from this office.
This is not a determination from any other agency.

The following action was taken by' the Board of Town Trustees
during its regular meeting held on March 26, 1997 regarding the
above matter:
WHEREAS, J.M.O. Consulting on behalf of HAROLD SCHWERDT applied
to the Southotd Town Trustees for a permit under the provisions
of the Wetland Ordinance of the Town of Southold, application
dated October 23, 1996, and,
WHEREAS, said. application was. referred to the Southol~ Town
Conservation. Advisory Council for their findings and.
recommendations, and
WHEREAS, a Puhtic Hearin~ was hel~ b~ the Town Trustees with.
respect to said application on March 26, 1997, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Boazd members have personally viewed and are
familiar with the premises in question and the surrounding area,

Permit to construct project will expiate two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.

The Schwerdt property is well suited to vegetative treatment. This is a low impact area with a
relatively flat beach front. The upland area is in no danger since it is well protected by a bulkhead.
Since the bulkhead is way above the high tide mark, scouring of the beach associated with waves
hitting the bulkhead will not be a problem. There is really no need for any additional structures
here. In fact, the addition of a second retaining wall in the same location as the existing concrete
block wall could cause more damage due to scouring associated with wave action.
The property directly to the east of the applicant's has an excellent stand of Spartina altemiflora
growing there. Phragmites dominate the area above mean high tide, but these grasses are doing a
good job protecting the beach which is very similar to the site in question.
In order for vegetative treatment to be successful at this site however, certain practices must
change. First, the float from the dock cannot be left on the beach since it will kill any vegetation
growing there. The same is true for boats when they are being used. Moorings must be out in the
water and a pulley system devised to access the boats.
The entire beach area should be planted to Spartina grasses. These grasses will act as a shock
absorber to dissipate wave energy, and will entrap sand to help build up the beach. They also
provide valuable habitat for bait fish and other marine organisms.
With that in mind, I would recommend stabilizing this site by planting Spartina aitemiflora below
mean high tide and Spartina patens between mean high tide and the upland bulkhead after
removing the concrete block retaining wall. Have the landowTa, er consult the enclosed planting
guide for the proper planting procedure. I have also included a list of sources for these grasses
for the applicant's use.

Dear Mr. Just,
The following action was taken by the Board of Town Trustees
during its regular meeting held on November 22, 1996, regarding
the above matter:
WHEREAS,. HAROLD P. SCHWERDT applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated October 23,
1996, and,
WHEREAS, said application was. referred to the Southold Town
Conservation Advisory Council for their findings and.
recommendations, and
WHEREAS, a Public 14earing was held by the Town Trustees with
respect to said application on November 22, I996, at which time
all interested persons were Given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the. Board has considered all the testimony and .
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set farth in
Chapter 97-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfane of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
HAROLD P. SCHWERDT to remove a 4' X 40' catwalk and a 4' X 8'
inshore ramp, and constr~ct a'new 4' X 52' catwalk (elev. 4'
above grade) and a 3' X 11' ramp and an 8' X 16' float secured
by 2 two-pile dolphins.
BE IT FURTHER RESOLVED that this determination Should. not be
considered a determination made for any other Department or
Agency which may also have an application, pending for the same
or simita~ project.
Permit to construct project, will expire two years from the date.
it is signed. Fees must be paid, if' 'applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

CONSERVATION ADVISORY COUNCIL
At the Southold Town Conservation Advisory Council meeting held Wednesday,
November 13, 1996 the following recommendation was made:

Moved by Bruce Loucka, seconded by Scott Hilary, it was
RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of HAROLD SCHWERDT 77-2-1 to
remove 9~ +/- feet of concrete block retaining wall and to reconstruct in
kind/in place with an 80' timber wall, construct a 7' return on either end of
wall and backfill with 5+ c.y. of sand.
The CAC recommends disapproval of that portion of the wetland application
because there is no need shown.
The CAC recommends APPROVAL WITH STIPULATIONS of the Wetland
Application of HAROLD SCHWERDT to remove ~4' x ~4' catwalk and a ~4' x 8' in
shore ramp, and construct a new ~' x 52' catwalk (elev. ~' above grade) and a
3' x 11' ramp and an 8' x 16' float secured by :) two=pile, dolphins.
The Council recommends approval of that section of the application with the
stipulation that it extends no further than the existing catwalk and float.
