Dear Mr. Herman:
The following action was taken by the Board of Town Trustees
during its regular meeting held on February 25, 1998 regarding
the above matter:
WHEREAS, En-Consultants on behalf of HENRY MCNEILLY applied to
the Southold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
February 6, 1998, and,
WHEREAS, said application was referred to the Southo!d Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on February 25, 1998, at which time
all interested persons were given an opportunity to be heard,
and, '~1
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
remove and replace inkind, inplace an existing 6' X 10'
platform, 2.5' X 17' ramp and 6' X 44' float. Also reseath
approx. 151' of existing timber bulkhead. Proposed sheathing
will be placed landward of existing sheathing. A 6' to 8'
non-turf buffer must be maintained. Backfill with approx, fifty
(50) c.y. of clean sand to be trucked in from approved UPland
source. Located 250 Goose Creek Lane, Southold, and
BE IT FURTHER RESOLVED that this determination should not be
considered a determination made for any other Department or
Agency which may also have an application pending for the same
or similar project.
Permit to construct project will expire .two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

2a) Because the proposed dock replacement and bulkhead resheathing are located wkhin
and adjacent to the State designated littoral zone tidal wetlands of Goose Creek, the
project must be consistent with Policy 44. While the replacement of the existing dock
will cause a minor, temporary disturbance to the creek bottom, the project will not
adversely affect the benefits derived from tidal wetlands. As. the project wilt also require
a Tidal Wetlands Act permit from the NYSDEC, the project wilt be consistent with
Policy 44.
2c) Because the proposed activity will occur within the State designated significant fish
and wildlife habitat of Goose Creek (Orient Harbor), it must be consistent with Policy 7.
Although the proposed replacement of the existing dock wilt temporarily disturb the
creek bottom at the site, the surrounding habitat will not be "significantly impaired" as
defined by Policy 7. There will be no reduction in vital resources or chances in
environmental conditions beyond the tolerance of organisms as a result ofthe project.
3a) Because the proposed activity will occur at a waterfront site the project must be
consistent w/th Policies 2, 21, and 22. Pursuant to Policy 21, the proposed construction
will facilitate recreational boating on Goose Creek by providing safe dockage at the
subject property. Policies 2 and 22 do not apply to the project.
3c) Since the bulkhead is an erosion control structure, the project must be consistent with
Policies 13, 14 and 16. The resheathing of the existing bulkhead will not alter the
existing conditions at the site and will serve to stabilize an existing, functional erosion
control structure. Therefore, the project will not ~ause or increase erosion at adjacent
properties, and will be consistent with Policy 14. Additionally, the resheathing of the
bulkhead will increase the existing structure's probability &controlling erosion at the site
for at least thirty years. Therefore, the project will also be consistent with Policy 13.
Policy 16 is inapplicable to the project.
