The following action was taken by the Southotd Town
Trustees on Wednesday April 30,1997, at their regular meeting.
RESOLVED that the Southold Town Trustees grants permission
to transfer permit 9's 4590 & 4379 from Michael J. Leahy to
William Penny, and also to amend permit ~4379 to change
configuration of dock from 3'x 26' dock, 3'x 16' ramp, and one
6'x 20' float straight out to a 4'x 40' dock, 3'x 16'ramp, and
two 6'x 16' floats in an "L" configuration, three 2 - pile
dolphins, and twostorm poles.
This approval does not constitute approvals from any other
agency.

The following recommendation was adopted at the April 28, 1997 meeting of the
Southold Town Conservation Advisory Council:

dock consisting of fixed walkway, ~4' x L~0'; hinged ramp, 3' x 16'; two floats,
each 6' x 16'; install three 2-pile dolphins to secure float and two storm
poles.

Dear Sir:
The permit referred to was issued to Michael Leahy on October 28, 1994. Because of difficul-
ties in obtaining DEC approval of the project, the Trustees agreed to extend the exph'afion date
one year to October 27, 1997. No work was ever performed under the permit.
The property was purchased by ~Villiam Penney in September 1996. Proper-T Services repre-
sents Mr. Penney in this matter and a letter of authorization is enclosed. Also enclosed is a let-
ter from William Moore, Esq., attorney for Mr. Leahy, authorizing the transfer of the perrrdt.
Mr. Penney was not able to act on the project until now. The Board's response to my 10/9/96
letter requesting a two-year extension was to grant only a one-year extension. I would be grate-
ful ff the Board would reconsider that decision and further extend to permit to October 27,
1998. This extension would give the new owner the benefit of the entire usual permit term.
Nothing has changed at the project site, and from an environmental standpoint there would ap-
pear to be no impediment to granting this additional extension.
We also request that the portion of the permit applicable to the construction of the dock be
amended as shown in the attached drawing. You will recall that the original approval was con-
tingent upon shortening the then-proposed walkway to a length of 26 feet, gi-~ing an overall
length of 60 feet for the structure. The amended plan proposes a structure which does not ex-
tend any further into the creek, but has a configuration which is the on13' one which will ac-
commodate the owner's 35-foot boat.

Dear Sir:
This is a request for an extension of two years for the referenced permit, resulting in an expira-
tion date of October 27, 1998.
The reason for this unusual request is as follows: The Trustee permit was issued relatively soon
after the application was submitted. Thc NYSDEC permit, however, was the subject of lengthy
discussions and negotiations concerning the upland renovations, g/hen it was realized that thc
issuance of thc DEC permit was still some time away, it was decided to submit a new, separate
application to thc DEC for thc dock alone. Thc DEC permit for the dock alone was issued
September 30, 1995, almost a full year after the Trustee permit was issued. Thc DEC permit
for thc remaining upland renovations, etc., was not issued until December 26, 1995. Shortly
after the befljiming of the "dock-building season" of 1996, Mr. Leahy decided to put the prop-
erty on the market. It was sold, and thc closing took place in mid-October. The new owner
should have the benefit of the full permit period.
Thc reason that I am not applying at this time to have the permit transferred to thc new owner
is that I intend to first obtain approval of this step from Mr. Leahy's attorney. It may well be
that I will have that approval, and therefore will make application for the transfer, beforc the
Trustees' October meeting.

The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WHEREAS, Michael Leahy applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated September 15, 1994.
WHEREAS, said application, was referred to the SoutholdTown
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
reSpect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,

Michael Leahy to add a 21' X 24+' 2 story addition; a I5' X 44'
deck at rear of house; a 10' X 43' covered porch on the road
side of the house; a 13' X 41' Conservatory on the southeast
side of the house; a gambrel roof added to existing boathouse to
provide 2nd floor home office space; a 24.5' X 22.4' dormer
added to existing garage to provide 2nd floor storage space.
Also to amend this application to include a 3' X 2 ' fixed dock,
a 3' X I ' ramp, and a 6' X 20' floating dock, as per CAC
recommendations. The Trustees require the applicant to place
haybales from the south edge of the bulkhead to the north edge
of the property in order to prevent runoff into Town Creek.

Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.

I know that this request is late by several weeks, but I would appreciate it if you would extend
again the time period for the payment of the fees for this pernfit by another 90 days, until Oc-
tober 26, 1995.
Considerable difficulty is still being encountered in obtaining the permit for the project from
the NYSDEC, and Mr. Leahy would prefer not to lay out any more funds until all of the ap-
provals have been received. I expect that the problem with the DEC will be resolved in princi-
ple within two weeks, but it will probably involve the design and approval of a new septic
system, which could take another several weeks.

You will recall ~at the Board was about to deny Mr. Leahy's revised application which pro-
posed a much longer structure in the small "cove" near the northern property line when he was
given the opportunity to revert to his original design (a 3' x 26' walkway, 3' x 10' ramp, and 6' x
10' float) and location (the more southerly of the two existing bulkheads), which opportunity
he gratefully accepted. The sizes of the original components, however, are not adequate to
reach a suitable water depth or to provide secure dockage and access for even the modest boat

The following action was taken by the Board of Town Trustees
during its regular meeting held on October 27, 1994 regarding
the above matter:
WHEREAS, Michael Lgahy applied to the Southold Town Trustees for
a permit under the provisions of the Wetland Ordinance of the
Town of Southold, application dated September 15, 1994.
WHEREAS, said application, was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on October 27, 1994 at which time
all interested persons were given an opportunity to be heard,
and,
WHEREASr the Board members have personally viewed and are
familiar with the premises in question and the surrgunding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the Board of Trustees approves the application of
Michael Leahy to add a 21' X 24+' 2 story addition; a 15' X 44'
deck at rear of house; a 10' X 43' covered porch on the road
side of the house; a 13' X 41' Conservatory on the southeast
side of the house; a gambrel roof added to existing boathouse to
provide 2nd floor home office space; a 24.5' X 22.4' dormer
added to existing garage to provide 2nd floor storage space.
Also to amend this application to include a 3' X 20' fixed dock,
a 3' X 10' ramp, and a 6' X 20' floating dock, as per CAC
recommendations. The Trustees require the applicant to place
haybales from the south edge of the bulkhead to the north edge
of the property in order to prevent runoff into Town Creek.
Located 2200 Hobart Avenue, Southold.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
upon completion of said project.

from an upland source.
The CAC recommends approval of the 116' and 60' bulkhead. The
Council recommends disapproval of the 56' bulkhead. The 56' bulkhead is not

Dear Sir:
Mr. Lcahy has asked that I provide you with the attached revised project plan which should re-
place that submitted previously.
The most sigt~cant change is in the size and location of the dock. Mr. Leahy discussed this
with Mr. Holzapfd during the inspection of the site. Mr. Lcahy feels that the new proposed lo-
cation is more esthetically suitable for the property since it would not interfere with the view,
which is the most significant feature of the location. The new proposal provides a dock con-
ftguration of a total length necessary to roach a low-water depth of about throe feet.
Other additions to the previously submitted sketch are: a covered porch of the road side of the
house; a conservatory, or greenhouse room, on the southeast side of the house; the addition of
home office space on the second floor of the existing boathouse, facilitated by the addition of a
gambrel roof; and a storage space on the second floor of the existing garage, facilitated by the
addition of roof dormers.
Although thc location and size of thc dock has been changed, thc construction details will re-
main essentially the same.
Mr. Leahy is especially anxious to begin the work on thc house in an attempt to have it closed
in before thc weather interferes with construction.
