Because of difficul- ties in obtaining DEC approval of the project, the Trustees agreed to extend the exph'afion date one year to October 27, 1997. No work was ever performed under the permit. The property was purchased by ~Villiam Penney in September 1996. Proper-T Services repre- sents Mr. Penney in this matter and a letter of authorization is enclosed. Also enclosed is a let- ter from William Moore, Esq., attorney for Mr. Leahy, authorizing the transfer of the perrrdt. Mr. Penney was not able to act on the project until now. The Board's response to my 10/9/96 letter requesting a two-year extension was to grant only a one-year extension. I would be grate- ful ff the Board would reconsider that decision and further extend to permit to October 27, 1998. This extension would give the new owner the benefit of the entire usual permit term. Nothing has changed at the project site, and from an environmental standpoint there would ap- pear to be no impediment to granting this additional extension. We also request that the portion of the permit applicable to the construction of the dock be amended as shown in the attached drawing. You will recall that the original approval was con- tingent upon shortening the then-proposed walkway to a length of 26 feet, gi-~ing an overall length of 60 feet for the structure. The reason for this unusual request is as follows: The Trustee permit was issued relatively soon after the application was submitted. Thc NYSDEC permit, however, was the subject of lengthy discussions and negotiations concerning the upland renovations, g/hen it was realized that thc issuance of thc DEC permit was still some time away, it was decided to submit a new, separate application to thc DEC for thc dock alone. Thc DEC permit for the dock alone was issued September 30, 1995, almost a full year after the Trustee permit was issued. Thc DEC permit for thc remaining upland renovations, etc., was not issued until December 26, 1995. Shortly after the befljiming of the "dock-building season" of 1996, Mr. Leahy decided to put the prop- erty on the market. It was sold, and thc closing took place in mid-October. The new owner should have the benefit of the full permit period. Thc reason that I am not applying at this time to have the permit transferred to thc new owner is that I intend to first obtain approval of this step from Mr. Leahy's attorney. The most sigt~cant change is in the size and location of the dock. Mr. Leahy discussed this with Mr. Holzapfd during the inspection of the site. Mr. Lcahy feels that the new proposed lo- cation is more esthetically suitable for the property since it would not interfere with the view, which is the most significant feature of the location. The new proposal provides a dock con- ftguration of a total length necessary to roach a low-water depth of about throe feet. Other additions to the previously submitted sketch are: a covered porch of the road side of the house; a conservatory, or greenhouse room, on the southeast side of the house; the addition of home office space on the second floor of the existing boathouse, facilitated by the addition of a gambrel roof; and a storage space on the second floor of the existing garage, facilitated by the addition of roof dormers. Although thc location and size of thc dock has been changed, thc construction details will re- main essentially the same. Mr. Leahy is especially anxious to begin the work on thc house in an attempt to have it closed in before thc weather interferes with construction.
