The following action was taken by the Board of Town Trustees
during its regular meeting held on January 29, 1997 regarding
the above matter:
WHEREAS, En-Consultants on behalf of RICHARD MAGEE applied to
the Southotd Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated
December 19, 1996, and,
WHEREAS, said application was referred to the Southold Town
Conservation Adviso=y ~ouncit for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on January 29,. 1997, at which time
all interested persons were given an opportunity to b~ heard.,
and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimon~ and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with. the standard set forth in
Chapter 37-18 of the Southold Town Code,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE. BE IT,
RESOLVED, that the Board of Trustees grant a Wetland Permit to
replace (within 18") an existing 64 1.f. and 77 1.f. of
bulkhead, construct a 12' extension to existing return and
backfill with approx. 50 c.y. of clean fill with a 20' non-turf

Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and permit
issued within six months of the date of this notification.
TWo inspections are required and the Trustees are to be notified

Dear Mr. MaGee:
On December 27, 1996, the New York District, U.S. Army Corps
of EnGineers, received a request for Department of the Army
authorization to replace 101 linear feet of timber bulkhead
within 18 inches of an existing bulkhead, construct a 12 linear
foot extension to an existinG return and place 50 cubic yards of
backfill to be trucked in from an upland location. The site is
in Jockey Creek, Shelter Island Sound at the Town of Southold,
Suffolk County, New York.
Based on information submitted to this office, our review of
the project indicates that an individual permit is not required.
It appears that the activities within the jurisdiction of this
office could be accomplished under an existinG Department of the
Army nationwide General permit. The nationwide permits are
prescribed in Title 33 of the Code of Federal ReGulations (33 CFR
330, Appendix A, Part B, No. 3). The work may be performed
without further authorization from this office provided the
activity complies with the permit conditions and any applicable
regional conditions added by the State of New York. A public
notice issued from this office which describes the nationwide
permits and conditions for New York is enclosed for Your review.
This determination covers only the work described in the
submitted material. Any major changes in the project may require
additional authorizations from the New York District.
Care should be taken so that construction materials,
includinG debris, do not enter any waterway to become drift or
pollution hazards. You are to contact the appropriate state and
local Government officials to ensure that the subject work is
performed in compliance with their requirements.
If work is completed by January 21, 1998, no further contact
with this office will be necessary. If work is not completed by
this date, it is recommended that you contact this office so we
can ascertain if the proposal is permissible under revised
Nationwide General Permit No. 3.

The following recommendation was adopted a meeting of the Southold Town
Conservation Advisory Council held Friday, January 17, 1997:

RESOLVED to recommend to the Southold Town Board of Trustees
DISAPPROVAL of the Wetland Application of RICHARD MA(iEE ?0-~-15.1 to
replace (within 18") existing 64 linear feet and 77 linear feet bulkheads along
Jockey Creek and APPROVAL to construct a 12 linear foot extension to
existing return. Backfill with approximately 50 cubic yards clean sand to be
trucked in from upland source.
The CAC recommends disapproval to replace the bulkhead because it is in good
condition. The Council suggests the minor erosion areas along the bulkhead be
filled and a 10' non-turf buffer be installed.
The CAC recommends approval of the extension to the return provided the
neighbor approves.

Dear Mr. Kmpski,
Recently, my husband, Tom Kelly, and I received a letter from EN-Consultants of
Southampton regarding the property of our neighbor, Mr. Richard Magee. According to
this letter, Mr. Magee proposes "to replace (within 18") existing 64 linear feet and 77
linear feet bulkheads along Jockey Creek. Construct a !2 linear foot extension to existing
return. Backfill with approximately 50 cubic yards clean sand to be trucked in from
upland source."
While I can understand Mr. Magee's desire to make any needed repairs to his
butkheading, i am very concerned about the effect of these repairs to our property.
Several years ago, Mx. Magee repaired the bulk&eading adjacent to our property and
added a small extension. Since that repair, the !and on our side of the property tine along
the return of the bulkheading has almost completely eroded.
When we purchased our house in 1981, our waterside property extended in a fairly
straight line from the property of our neighbors to the north down along Jockey Creek to
the corner of the bulkheading on what is now Mr. Magee's property. Presently, our
property adjacent to Mr. Magee's has been so eroded that its edge now lies not at the
corner of the bulkheading but at the end of its return, a distance of approximately 20 linear
feet. We have experienced on average erosion of more than a foot a year!
While ! am not an engineer, it seems logical to me that new butkheading and more
butkheading wilt not necessarily solve a problem of significant and considerable soil
erosion. We respectfully suggest to the Board of Trustees that Mr. Magee investigate this
matter further before begi~ming any work on his bulkheading, i believe that he is also
experiencing some erosion on his property. What is causing it? Is it only worn-out
