I have reviewed the FLOOR PLAN of the above referenced project, and have found that
the substitution of two (2) 11-?/8" x 1-3/4" LVL's for the two (2) 2 x 12's shown as
headers between the new Kitchen and Dining Room will sufficiently meet the structural
requirements. I therefore hereby certify that substitution.

THE CHAIRMAN: Well~ this will be an accessory use~ so it can
be no closer than 3 ft. off the west line& and your sidewall~ if you
build one~ must be no higher than 3 ft.a and the carport mus~be in
line with the rear of the house. Also, at no t/me may this carport
be enclosed.
After investigation~and ins~ection the Board finds that the
a~plicant requests permission to construct addition to exist/rig
dwelling with ln~mfficient side yard area. The applicantys
house is located at the extreme westerly end of his property as
set Off in 1938~ long before a recent-inheritance which considerably
enlarged the present area. The Board is agreeable to granting this
variance subject to the conditions listed belowo
On motion by F~. Gillispiea seconded by Mr. Berge~ it was
RESOLVED John Matrick~ Middle Read, Cutchogue~ New York~ be
GRANTED permission to construct addition to exist/rig dwelling
with insufficient si~e yard area as applied for on prol~e~rty
located at north side of Middle Roa~ Cutchogue~ New York~ subject
to 'the following conditions=
1o The posts sup~orting the carport shall be no closer than
3 feet to the westerly line.
2. The sidswall on the west side shall be no higher than
3 feet.
3. At no time may this carport be enclosed.
4. The carpert must be in line with the rear of the house.

ALFRED H. GOLDSMITH: Yes.,, my name ks Alfred H. Goldsmith,
I am the contractor. Mr. Donlin asked me to come here tonight
and s~esk for him. because he is in the hospital.
THE CHAIRMAN: Did Mr. Donlin knoW it was a violati0n ~ he
authorized you to do the work?
MR2 GOLDSMITH: NO~ neither of us knew it was a violation,
normally where the roof is existing~ you can enclose it without
permit. I didn't real/ze ~.hat closing the walls violated the
setback~
THE CHAIRMAN: This ks a corner' lot which 'requires a 35 ft.
setback on both roads. But the fact that this is only s right-
of-way alleviates it a littlem it is unl/kely that it will ever be
taken over by the ToWn.
MR.' HULSE: HoW wide ks it?
THE CHAIRMAN= It ks a 35ft right-of-Way but the actual road
is only about 20ft. The only thing that ks a little unfortunate
about this is that theyha~, in the past~, applied for a building
perm/t and a variance for the other endl it was a different builder,
didnlt they add s garage?
MR:' GOLDSMITH: Yes, I think it was on the north end.
THE CHA/~M~N: At that t/me they also put this porch on. I
believe that there was a condition set whi=h stated that this porch
could never be enclosed.
MRS' GOLDSMITH: Well, I was totally unaware of this until
received the violation.
· l.n~ CHAIRMAN: The way we try to look at these situations is
as though they donlt exist~ We try not to base our decision on
the fact~that there is a violation. We try not to be vindictive.
The fact that this is a right~of~way and not a public street
helps a little, What is the size of the lot?
HOWAZD TERRY~ BUIv~/I~G INSPECTOR: It is a lot and a half,
it is about 150 ft. on Town Harbor Road and about 135--140 ft. ~ee~,.
but the additional property was purchased after the original house
was built.

applicant requests l~rmission to construct addition to existing
dwelling with insufficient front yard setha~k. The Board fin~s
that the applicant is the owner of a lot and a half~ but the
half lot was purchased after the ori$inal dwelling was built.
The Board find~-~_hst this addition will front on a private
right--of--way which will not be travelled as a regular street.
~" The Board finds that strict application of the Ordinance
would ~roduce practical difficulties or unnecessary hardship;
t_he hardship created is unique and would n~t be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will net change
the character of the district and w~]l observe the spirit of
the Ordinance.
