BASIS OF APPLICATION: Building Inspector's December 21, 2001 Notice of Disapproval
for the reason that applicants' proposed garage will be located in an area other than the
code required rear yard, pursuant to Section 100-33.
AREA VARIANCE REQUESTED: Applicant is requesting authorization to locate an
accessory one-stow, 35' x 25'three-car garage 20 feet from the easterly side property line.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on February 21,
2002, at which time written and oral evidence was presented. Based upon alt testimony,
documentation, personal inspection of the property and the area, and other evidence, the
Zoning Board finds the following facts to be true and relevant.
PROPERTY DESCRIPTION: The applicant's property is a 123,318 sq. ft. located on the
on the west side of Old Woods Path, a private right-of-way, near Nokomis Road, Southold.
The property is improved with an existing dwelling, set back almost 200 ft. from Old Woods
Path, and an accessory in-ground swimming pool. To the north of the dwelling is Iow-lying
flood zone area.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board
and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character
of the neighborhood or detriment to nearby properties. The property is a large wooded
parcel. The location request for the garage will be non-visible from Old Woods Path. The
board as a condition to this variance is requiring evergreen screening along the easterly
side of the garage along or near the easterly property line, to reduce the impact to the
neighbor to the east.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance. The rear yard area is confined by
wetlands and a flood zone. To locate an accessory garage in any other area would also
require a variance.

The Southold Town Board of Trustees reviewed the survey dated April 27, 1988 and last revised
September 27, 1988, and after a field inspection made on December 19, 2001, and determined
the proposed garage, to be out of the Wetland jurisdiction under Chapter 97 of the Town
Wetland Code.
However, any activity within 100' of the Wetland line would require permits from this office.
This determination is not a determination from any other agency.

The proposed accessory garage is partially located in both the front and side yards.
Total lot coverage on the property, following the proposed construction, would be approximately three

of the Environmental Conservation Law). Please be advised, however, that
no construction, sedimentation or disturbance of any kind may take place
seaward of the 10~ contour or topographic crest without a permit. It is
your responsibility to ensure that all necessary precautions are taken to
prevent any sedimentation or other alteration or disturbance to the
ground surface or vegetation in this area as a result of your project.
Such precautions may include providing adequate work area between the
10' contour or topographic crest and the project (i.e. a 15' to 20' wide
constructzon area) or erection of a temporary fence, barrier, or hay
bale berm.

a. This application MUST be completely filled in by typewriter or in ink and submitted to the Building Inspector with 3
sets of plans, accurate plot plan to scale. Fee according to schedule.
b. Plot plan showing location of lot and of buildings on premises, relationship to adjoining premises or public streets or
areas, and waterways.
c. The work covered by this application may not be commenced before issuance of Building Permit.
d. Upon approval of this application, the Building Inspector will issue a Building Permit to the applicant. Such a pe~xfit
shall be kept on the premises available for inspection throughout the work.
e. No building shall be occupied or used in whole or in part for any purpose what so ever until the Building Inspector
issues a Certificate of Occupancy.
f. Every building permit shall expire if the work authorized has not commenced within 12 months after the date of
issuance or has not been completed within 18 months from such date. If no zoaing amendments or other regulations affecting the
property have been enacted in the interim, the Building Inspector may authorize, in writing, the extension of the permit for an
addition six months. Thereal~er, a new permit shall be required.
