No. 5070 - ART SAFALOW Property Location: 737 Old Woods Path, Southold 87-1-23.4 BASIS OF APPLICATION: Building Inspector's December 21, 2001 Notice of Disapproval for the reason that applicants' proposed garage will be located in an area other than the code required rear yard, pursuant to Section 100-33. AREA VARIANCE REQUESTED: Applicant is requesting authorization to locate an accessory one-stow, 35' x 25'three-car garage 20 feet from the easterly side property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon alt testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is a 123,318 sq. ft. located on the on the west side of Old Woods Path, a private right-of-way, near Nokomis Road, Southold. The property is improved with an existing dwelling, set back almost 200 ft. from Old Woods Path, and an accessory in-ground swimming pool. To the north of the dwelling is Iow-lying flood zone area. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The property is a large wooded parcel. The location request for the garage will be non-visible from Old Woods Path. The board as a condition to this variance is requiring evergreen screening along the easterly side of the garage along or near the easterly property line, to reduce the impact to the neighbor to the east. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear yard area is confined by wetlands and a flood zone.
