SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated May 13, 2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, rectangular-shaped, 22,833 square feet, .524- acre parcel located in the R40 Zoning District measures 102.66 feet and 39.00 feet along a curve in Main Road also known as State Route 25, then runs south 175.57 feet along a residentially developed lot to the east (owned by the applicant),then runs west 133.00 feet and returns north 162.00 feet along an"L-shaped"parcel developed as a hotel. The property is improved with a 2-story frame residence with front and rear entrance steps,a frame building(subject of this application),a gravel driveway and asphalt parking area,as shown on the survey prepared by John T.Metzger, Licensed Land Surveyor and last revised April 8, 2020. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and Building Inspector's May 10, 2022 Notice of Disapproval based on an application for a permit to legalize an"as built" accessory building; 1) located less than the code required minimum rear yard property line setback of 10 feet; located at: 7970 Main Road, East Marion,NY. ADDITIONAL INFORMATION: The applicant provided a foundation plan,first floor plan,elevations and sections for the structure, to be used as a workshop, and containing a half(1/2) bath, including two proposed storage areas where the walls and ceilings are to be sheet rocked, prepared by Robert I. Brown, Registered Architect and dated May 3, 2022. Page 2,January 19,2023 #7676, Dellaportas SCTM No. 1000-31-6-32.1 Improvements on the subject parcel are covered by the following Certificates of Occupancy and Building Pen-nits: #Z-22012 Dated December 8, 1992 Pre-C of O,Covering a one-family dwelling,accessory one car garage,two small accessory storage sheds and a wood frame, one room guest cottage. #40117 Dated September 25, 2015 Building Permit for construction of a new single-family dwelling. Expired—now recognized as permit#42765. #42759 Dated June 5,2018 Building Permit for alteration to an existing accessory building/conversion to a workshop. Replaces BP#39749. Expired. Per the applicant's and their agent's testimony, the pre-existing guest cottage was `accidentally' knocked down by a contractor working on the site,who then built the existing"as built"accessory workshop with basement crawlspace, while the owner was on vacation, which thereby extinguished the Pre-Certificate of Occupancy for the accessory guesthouse. The applicant seeks a final Certificate of Occupancy on the new, accessory structure (proposed to be used as a workshop) and concurrently a final Certificate of Occupancy on the residential structure. The applicant states that while they own the subject parcel, they reside at 9625 Main Road, East Marion NY as evidenced by prior relief granted in ZBA file #7489SE, which granted the resident/owner (Dellaportas) a special exception permit to establish and operate a Bed and Breakfast in their primary/primary/principal residence at 9625 Main Road. Board research illustrates that in addition to the subject parcel and the residential/B&B property across the street,the applicant also owns 8100 & 9495 Main Road, East Marion; a total of four properties. Testimony was offered that the subject parcel, 7970 Main Road, East Marion is jointly owned by family members: Argyris, Patricia, Kalergis, Panegiotis, and Theoni Dellaportas and that the applicant's daughter resides at the subject property, although no evidence to this fact was submitted, as a requirement of qualifying for an accessory "workshop" use. The subject property is void of a C of O and is currently under construction. Town of Southold property tax bills and Assessors records indicate a mailing address of 21-55 Hazen Street,Jackson Heights/Flushing,NY 11370 for all four properties. The applicant stated that the workshop is a needed, personal, space to store and to produce their crafts to support their Queen's,NY restaurant/diner business which offers private catered events. The applicant's agent submitted a "Memo for Continued Hearing" on December 12, 2022, containing several exhibits, including photographs of the applicant's craft work, including filing purchased containers with packaged candy;the applicant also offered testimony that they use a`cricket' machine to create banners and that they produce other crafted itdms for various private catering events, such as `Candy Bars', hosted by their restaurant/diner. The agent previously submitted examples of prior relief granted for similar applications. On February 4,2021 the Board of Appeals rendered an interpretation of the Town Code Section 280-17(c)accessory uses in an R-40 Zoning District(ZBA file no.: 7457) in which the Board found that a workshop was a permitted use so long as an owner/applicant complies with the following 13 specific elements/conditions: 1. Such use is incidental to the principal residential use on the premises. 2. The artist's studio/workshop in an accessory structure is not rented to or used by anyone other than the property owner of the principal dwelling. 3. No individual or group instructions, classes or demonstrations related to the production/fabrication of crafts/art works in the studio/workshop may take place on the property. 4. The property owner may not employ or engage unpaid assistance by any other persons(s) in relation to the production/fabrication of art/crafts in the accessory structure. 5. There is no exterior effect at the property line such as noise, traffic, odor, dust, smoke, gas, fumes or radiation. 6. No display of products/artwork/crafts etc. is visible to the street. Plumbing in the accessory structure is limited to a half bath (toilet and sink) and a utility sink. 9. Activities in the artist's studio/workshop in the accessory structure are limited to the production of crafts and works of art such as painting, sculpture, photography, ceramics, weaving/textiles, glass art (but not glass blowing), and personal woodworking/carpentry and auto mechanics on vehicles belonging only to the property owner. 10. No sleeping or cooking is permitted in the accessory structure. 11. An accessory structure used as an artist's studio/workshop may only contain that one use in addition to non-habitable (unfinished, open rafters and stud walls) storage of general household items, garden tools and/or vehicles. 12. An accessory apartment in the accessory structure is not permitted unless the artist's studio/workshop use is removed, and a special exception permit is obtained from the Zoning Board of Appeals. 13. The following uses are not, by this determination, considered to be permitted uses in an artist's studio/workshop in an accessory structure, as defined herein and are prohibited: workout/fitness activities, recreational activities, and home offices (as defined in the Town Code). In this subject application, personal testimony by the applicant and documentation submitted by the applicant's attorney does not confirm, to the Board's satisfaction, that the property owner complies with all of the above cited requirements in order to use an accessory structure as a "workshop use"that is incidental to the principle residential use on the property by the property owner/applicant No member of the public, or an immediate neighbor, spoke in favor of or against the application for variance relief. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 6, 2022 and January 5, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject parcel fronts Main Road/S.R.25 a major artery in the Town of Southold running east to west and connecting New England, via the Cross Sound Ferry, with points west on Long Island. While the parcel is not conforming, the"as built" accessory structure is set far back from the roadway and partially screened by shrubbery. Furthermore, accessory structures are common throughout the Town of Southold, and within the immediate neighborhood in the hamlet of East Marion. Although the rear yard setback of the as built accessory structure is not code compliant,the rear property line is planted with a row of evergreens for privacy and the small non-conformity is visually unperceivable to passersby or guests at the adjacent hotel immediately behind the structure. 2. Town Law X267-b(3)(b)(2). The benefit sought by the application cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The"as built"structure contains a poured concrete foundation and is not easily or economically relocated to a conforming location. Additionally, the structure is built using the pre-existing setback established by the accessory guest house that was `accidentally' demolished. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 9% relief Page 4,January 19,2023 #7676,Dellaportas SCTM No. 1000-31-6-32.1 from the code. However, the property and the accessory "as built" structure is partially screened by evergreen shrubbery, the adjacent neighboring house is owned by the applicant and there is a motel property on two sides of the subject property with extensive landscaping. 4. Town Law &267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member , and duly carried,to GRANT the variance as applied for and shown on the survey prepared by John T.Metzger,Licensed Land Surveyor and last revised April 8, 2020 and the foundation plan, first floor plan, elevations and sections for the structure, prepared by Robert I. Brown, Registered Architect and dated May 3,2022. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The accessory structure shall be non-habitable and may contain ONLY a 1/2 bath and no additional plumbing or cooking facilities. 2. The applicant is to provide this Board with copy of the final Certificate of Occupancy for the construction of the new house and the final Certificate of Occupancy for the accessory structure within 18 months of this decision. 3. The accessory structure is NOT to be used as a workshop, as sufficient evidence to the Board's satisfaction, was not provided by the applicant to illustrate their craft/hobby met the requirements of the 13 specific elements/conditions required for granting this use. 4. The accessory structure is to be uninsulated, unpartitioned and without the benefit of heat with exposed rafters, stud walls and subflooring. 5. The applicant is to file with the Suffolk County Clerk, a Declaration of Covenants and Restrictions, listing the above conditions of approval relative to the use of the accessory storage structure, to the satisfaction of the Southold Town Attorney. A copy of the Covenants and Restrictions, is to be provided to the Board prior to the issuance of a Certificate of Occupancy. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving non conformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate,the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within,three (3)years from the date such variance was granted. The. Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILITY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. The structure was re- constructed in the same location. The demolished structure was 9.1' from the rear property line but a new structure is required to be located at 10' from the property line. The accessory structure will not impact the adjacent property or uses. The Dellaportas family owns the house on the east side. The property is surrounded by the motel (Zoned RR) on the south and west side. The Motel is required to have a vegetative buffer. Evergreens screen the properties and preserve the privacy for both parcels. The accessory building is adjacent to the Motel swimming pool. The accessory building will not change the character of the neighborhood or nearby properties. Other similar variance granted to 1000-31-6-18 (Richter) #4277 11/2/94 for "as built" accessory structure with insufficient side yard setbacks (12' x 40' x 10') 5' from the property line. Former use of east side: The adjacent property (east side) was issued a Special Permit for a B&B with an additional cottage in a metal building (Special Permit #5653 Garritano 5/12/05). The Special Permit lapsed when the property was sold. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The accessory structure was re-constructed in the same location. Dear Board: In anticipation of the continuation of the hearing and in response to questions posed at the hearing on October 6, 2022,I have the following information based on the building department records: 1. Building Department History and timeline Building Permit #39562 dated 3/2/15 (Exhibit A) the building department issued a permit for "addition to single family dwelling". the workshop was given a separate permit as is typically done with accessory structures. (Voided when the house was demolished) Building Permit#39749 issued March 15,2015 (Exhibit B)for the proposed"workshop". The plans included the demolition of a preexisting cottage with a full bathroom and living space (previously rented by prior owners) and construction of a new structure labeled"workshop"with a %2 bathroom. Both the house addition and the workshop had Health Department approval. The"as built" design of the workshop is shown on the plans, issued a building permit,and construction started. After the building was constructed and substantially completed,ready for CO inspection,the building department noticed that the setback of the workshop was 9.1 feet to the property line rather than 10,as is required for accessory structures. SinEle Family dwellins demolished: Without notice to the owners and while the owners were out of the country,the builder demolished the existing house and the existing garage. The cottage was the only structure intended to be demolished. Due to the demolition,building permit#39562 was voided and replaced with Building Permit#40117 dated 9/25/15 for a new single-family dwelling(Exhibit C). The workshop was not part of this new house permit because permit#39749 issued March 15,2015 (see Exhibit B) was still valid as it was a separate permit for a new accessory structure (workshop). Only the permit for"addition to single family dwelling"had to be replaced with a new building permit for new single-family dwelling. This process caused a significant disruption of the construction. When the architect's construction plans had to be replaced with"new construction"plans Mr. Schwartz had to prepare new plans at significant cost to my client.After the construction plans were filed for the new house there was a falling out between the owner and architect over fees. Modifications to the single-family dwelling construction permit plans were required and a new architect had to be retained. Building Permit #42765 was issued for a bathroom modification in the single-family dwelling. (Exhibit D) The application for the variance was significantly delayed because the Zoning Board insisted on sealed plans for this submission, rather than the sealed plans filed with the building department and available from the Town's official records. Architect Robert Brown was retained to redraw the plans of the workshop so that sealed plans could be filed with the Board for this submission. 2. WORKSHOP USE The building permit for a"workshop"was issued in 2015 and the construction started and nearly completed. The setback of the demolished cottage was also 9 feet. The foundation was replaced in the preexisting location. The setback of 9.1 appears on the Health Department survey but the architect's site plan did not show the dimensions. Whether the setback was scaled incorrectly by the building department when the permit was issued or missed,we do not know. When the issue was discovered a"stop work" order was issued. Completion of the building was stopped but the structure is nearly finished. INTERPRETATION I was advised at the hearing that the Board had issued an interpretation of"workshop" in appeal#7457 dated 2/4/21. This interpretation predates issuance of the building permit for the existing structure in 20.,15 and prior to the issuance of the notice of disapproval first issued August 10,2020. The notice of disapproval was renewed three times through May 10,2022. This interpretation was never sited in the notice of disapproval. Nevertheless, in review of the Board's interpretation in Nardolillo (#7457)the owners conform to this interpretation. The property is owned by Argyris,Dellaportas,Patricia Dellaportas and their adult children, Kalergis Dellaportas,Panagiotis Dellaportas and Theoni Dellaportas. The adult children have children(Mr and Mrs. Dellaportas are grandparents). The family (in particular Patricia and her daughter)wanted a workshop because they have personal hobbies for their own enjoyment which include decorative crafting. The workshop will be their personal space for crafts and provide needed storage of years of accumulated crafting materials. Some of the materials are currently stored in Patricia's home across the street. Mother and daughter make holiday decorations and special event decorations for their restaurant,their family, and their friends. I asked her to give me an example of their decorations which is herein attached. (Exhibit E) Therefore,,as is listed in the Nardolillo interpretation: 1.The accessory building and workshop is incidental to the principal residential use. 2. The workshop in the accessory structure will be used solely by the family(owner of the residence) 3.No classes or demonstrations will be conducted in the workshop 4.No employees or unpaid assistants will occupy the workshop. 5. There is no exterior effect at the property line such as noise,traffic, odor, dust, smoke, gas, fumes or radiation. The accessory building is adjacent to a commercial use(Blue Dolphin Inn) 6.No display of products or crafts will be visible to the street. 7. No sales to the public are permitted on the subject property. 8. Plumbing in the accessory structure is limited to a half-bath(toilet& sink)and a utility sink. The plans approved by the building department and the health department have the bath and it is connected to the new sanitary system of the house. 9.Activities in the workshop are limited to the production of crafts. 10.No sleeping or cooking is permitted in the work shop. 11.An accessory structure used as a workshop may only contain that one use in addition to non-habitable storage. The structure is already designed to meet this condition. 12.An accessory apartment is not proposed in the workshop. The CO of the House has not been issued: The single-family dwelling has a valid building permit and is ready for the CO,the accessory structure has a separate building permit. Because of this"alleged"violation(the building was constructed with a building permit but nonconforming setback)requiring this application,the building department has refused to issue the certificate of occupancy for the single-family house. This is an injustice which should not be permitted to exist. I had spoken to the building department prior to by ZBA application and I had been assured that once the variance application was filed that the CO could be issued. That was not done and the CO for the house is still being withheld. The accessory building was issued a building permit, as built,was issued a notice of disapproval for the setback, and the applicant respectfully requests that the Board grant this minor variance for the workshop.
