Project Description: For the as-built 14.6'x15.6' deck, 88"x88"x40' hot tub and
10'x12' sunshade.
Findings: The project meets all the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code. The
issuance of an Administrative Permit allows for the operations as indicated on the
site plan prepared by Vincent Benic Architect, dated August 11, 2022, and
stamped approved on January 18, 2023.
Special Conditions: Existing vegetation is to remain.
Inspections: Final Inspection.
If the proposed activities do not meet the requirements for issuance of an
Administrative Permit set forth in Chapter 275 of the Southold Town Code, a
Wetland Permit will be required.
This is not a determination from any other agency.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposed action is
INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands. .
A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws -
and regulations for all Andros Patent and other lands under their jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee permit
conditions.
1. The as-built structures were constructed without Board of Trustee review or
permit. -
2. The 39' setback to the wetldnd with a slope to the system is not supported by
Policy 6. It is close and'erodes the function"of adjacent upland ecosystems to
wetlands.
3. A natural buffer is not proposed.
4. Drywells are not shown for draining the hot tub. Chapter 236 drainage
requirements should be applied.
Pursuant"to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.
