MINUTES Southold Town Board o~ Appeals April 7~ 1960 A regular meeting of the Southold Town Board of Appeals was held 7:30 P.M., Thursday~. April 7~ 1960 at the Town Clerk Office~ Main Roach. Southol~. New York. There were present: Messrs. Robert Chairman~ Robert Bergen~ and Herbert Rosenberg. Absent: Messrs, Charles Grigonis, Jr., Serge Doyen~ Jr., and Howard M. Terry~ Building Inspector. PUBLIC HEARING: 7:30 P.M, (E~S.T.),. Appeal No. 267 - Upon application of Eugene Mazzaferro~ a/c Catholic War Veterans~ Post 9730~ Greenpor~ New York, for a variance in accordance with the Zoning Ordinances, Article II~ Section 202~ for permission to operate a temporary amusement enterprise in an "A" Residential and Agricultural District. Location of property: east side Moore~s~Lane,. Greenport~ New York,. bounded north by Village of Greenport~ east by A. Herzog~ Sr. and Leo Sledjeski~ south by H.I~ Kalin and A. Herzog~ Jr~ and west by Moore's Lane, No fee required, The Chairman openedthe hearing by reading notice of dis-- approval issued by the Building Inspector~ application for a Southold Town Board of Appeals -2- April 7~ 1960 variance~ legal notice of hearing and affidavit attesting to its publication in the official newspaper. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? MR. EUGENE MaZZAFERRO~. Greenport~ New York: I have nothing further to say# I think the application covers it, THE C~: I think it is pretty well covered and we are all familiar with what you said when you were here before. Is there anyone present who wishes to speak agains this application? Are there any questions members of the Board might like to ask? MP~ BERGEN: If this is granted~ do we have a right to stipulate that they keep the papers from blowing around? MR. MAZZAFER~O: The owner of the property has already stipulated that. We will erect a fence for Lloyd Kalin so the people will not be running through the area and papers will not blow around. MR. ROSENBERG: Did you speak to the police? MR. MAZZAFERRO: I spoke to Chief Anrig and he said he would contact Mr. Gillispie stating that the traffic will be taken care of. THE CHAIRMAN: Will there be any problem of cleaning up? MP~ MAZZAFERRO: That is part of our contract,, that we will clean up and put the land back in shape. THE CHAIRMAN~ We ar-e not permitted to cause undue burden on any of the branches of the Town government and the only other burden we would cause woUld be on the police~ but since it has been done before you might say that it is in the ordinary course of events. Resolution was offered by Mr. Ros.enberg~, seconded by Mr/ Bergen,, and carried~ WHEREAS application of Eugene Mazzaferro,_ a/c Catholic War Veterans Post ~730 having been considered at Public Hearing No~ 267 on April 7~. 1960~ and the Board finding Southold Town Board of Appeals April 7~.~ 1960 that the strict application .of the Ordinance would produceundue hardship because without approval of the Board applicant would be unable to conduct this temporary amusement enterprise which has been conducted for many years on the opposite side of the street. The situation is unique and would not be shared by all properties alike in the ~ediate vicinity because this lot is situated next to the municipal light plant where utilities are available and .parking will be provided on a municipal lot. The public con- venience and welfare and justice will be served and the legally established or permitted use of neigkborhood property and adjacent use districts v~uld not be substantially or permanently injured and the spirit of the ordinance would be observed because this lot is located adjacent to the municipal light plant(, across the street from the base ball fields~, near a business area and part of the property is used for a florist shop business~ therefore be it RESOL~VED that the application be granted for permission to operate a temporary amusement enterprise on th-e condition that the Catholic War Veterans Post $730 be ~esponsibl~e for restoring the property to its original condition, Vote of the Board: Mr. Rosenberg. New for a s~ecial exception in accordance with the Zoning Ordinances. Article III,. Section 306~ for permission to reduce front yard setback on a corner lot, Location of property: northwest corner of Robinson Road~ Greenport~ New York, bounded north by Truman Cook~. east by Robinson Road~ south by Robinson Roa~.. and west by William Bieo Fee paid ~15.00. Are there any questions anyone would like to ask? (There was no response.) Resolution was offered by Mr. Bergen,. seconded by Mr. Rose~berg~ and carried,~W/tEREAS application of Richard Powe!i having been con- sidered at Public Hearing No. 268 on April 7~. 1960~ and the Board finding that the public convenience and welfare and justice will be served~ and the legally established or permitted use of neigh-- borhood property will not be s~bs'tantially or permanently injured and the spirit of the ordinance will be observed~ therefore be it RESOLVED that the applicatic~ be granted as applied for. Vote of the Board: Rosenberg. Ayes:- Mr. Gillispie,. Mr. Bergen,. and Mr. Joseph Droskoski~ Orient,.. New ¥ork,~ came before the Board of Appeals for an informal discussion. Mr. Droskoski had purchased two cottages and wished to place them on a piece of his property at Orient 172 ft~ by 150 ft.. After looking at the layout. of the property it was determined that Mr. Droskoski could enlarge the lot to 200 ft. by 150 ft. thus making two 100 ft, lots in conformance with the requirements of the Ordinance. Mr. Peter Karas~ East Marion~ New York,. came before the Board of Appeals for an informal discussion relative to erecting a third sign on his "B" Business property at west Greenport. Mr. Karas had been granted a special exception on June 4,~ 19~9 giving him permission to erect a roof sign on the Greenport Snack Bar~ however~ it was stipulated that this roof sign was to take the place of the customary standing sign~ since he would then have~ in effect~ two wall signs. Mr~ Karas now agreed that he would take down the wall sign on the west side of the Snack Bar if he is granted permission to have a standing sign~ The Board of Appeals stated that that would be satisfactory as long as the wall sign is taken down first. Southdd ToWn Board of Appeals April 7#. 1960 The Board of Appeals next spoke informally to Mr. Steve Hornick of Elmhurst~_ New York. Mr. Hornick has purchased the former Reybine house on Skippers Lane~ Orient, New York# and would like to convert it into a three family dwelling. At the time he purchased it the real estate agent assured him it could easily be made into a three family dwelling as it is surrounded by two and three family dwellings and tourist houses. Mr. Hornick was advised that the house is located in the "A" Residential and Agricultural District~. where only one-family dwellings are permitted~ He was further advised that his problem would be solved if he applied for and was granted a change of zone from "A" To "M" Multiple Residence District. It was pointed out that the change might be looked upon favorably if some of the neigh-- Ix)rs were to ~oir~ with him in the application for a change to "M". The minutes of the meeting of Mar~ch 24~. 1960, on motion of bir. Bergen, seconded by Mr. Rosenberg,.~. and carried, were approved as submitted, Vote of the Board: Ayes:- Mr. Gillispie~ Mr. Bergen~ and Mr. Rosenberg. On motion of Mr. R°senberg, seconded by Mr. Bergen,. and carried,. it was RESOLVED that the Board of Appeals set 7:30 P.M., Thursday~ April 21,~ 1960, Town Clerk Office, Main Road, Southold~ New York, as time and place for hearing upon application of C~ '.W.:..:Smith & Sons, a/c Rodney Quarty~ Bayview Road~ Southold,_ New York~ for a variance in accordance with' the Zoning Ordinance~ Art£cle III~. Section 303 and 307, and Article X,. Section 1000A, for permission to reduce frontage and side yard setback and-use as a single lot property located on the west side of North Bayview Road, Southold,.. New York, bounded north by Southold Development Corporation, east by North Bayview Road~ south by T. Byrnes,. Jr.~ and west by Southold Development Corporation, Vote of the Board: Rosenberg. New York, for a special exception in accordance with the Zoning Ordinance~ Article III~ Se chion 300, Subsection 11~ for permission to alter existing neon roof sign on roof of Silver Sands Motel~ Silvermere Road~ Greenport~ BIew York,. Southold Town Board of Appeals -6- April 7, 1960 bounded north by Silvermere Road~ east by Silvermere Road, south by Bay, and west by August Sieger. Vote of the Board: Ayes:- Mr. Gillispie~.. bit.
