That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months, which is considered to be the estimated time required to complete the work involved,but should circumstances warrant,request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required, upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. The Permittee is required to provide evidence that a copy of this Trustee permit has been recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar days of issuance of this permit. 9. That the said Board will be notified by the Permittee of the completion of the work authorized. 10. That the,Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 11. No right to trespass or interfere with riparian rights. McKENNA 1775 NAUGLES DRIVE, MATTITUCK SCTM# 1000-99-4-19 Dear Mr. Just: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, March 15, 2023 regarding the above matter: WHEREAS, J.M.O. Environmental Consulting on behalf of MARYANNE KELLEY & DIANE C. McKENNA applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 23, 2022, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policy of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: reducing length of fixed dock, and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on February 15, 2023 and March 15, 2023, at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 1. 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees approve the application MARYANNE KELLEY & DIANE C. McKenna 1775 Naugles Road, Mattituck S.C.T.M.No.1000-99-4-19 Dear Mr. Goldsmith- I am presently writing you as a follow up to the discussion that I had with the Board's February meeting. One of the issues which was addressed was had the Board issued an approval for the existing docking structure. The past owner of the property was Stanley Naugles, pre 1945 who sold that portion of the property he owned to James McKenna in 1945, it has been in the applicant's family since then, he was the person who built the dock. The applicant has been in litigation for complete ownership of the property since mid 1990. In 2020 Maryanne Kelley and Diane McKenna , who are James McKenna's grand children took total ownership of the site. Box 447 Quogue, New York 11959-0447 The second item discussed was whether the dock could be relocated to the west side of the property. As I noted during our discussion by relocating the dock there is potential that in doing so there would be more disturbance to the existing marsh. In reconstructing the dock in its current location there would be disturbance in the replacement of the existing piling. In relocating the dock the existing piling would need to be removed and new piles would be placed in now what is an undisturbed area of marsh and there is the lack of water depth in that area and would have to be dredged. The area in which the existing dock has sufficient depth for docking. The relocation of the dock to the west of the current location would also place the new dock very close to the applicant's property line. During our discussion there was a question regarding access to the dock. We have revised our plans to note that the applicant has proposed to "create" a 4'x125' access path. The last item which was discussed was the would the proposed reconstructed dock be located within the "pier line" of the creek. To assure this we have revised our plans to show that the applicant is proposing to reconstruct 50' of fixed dock which is currently 60' in length and to reduce the size of the seaward ram from 3'x18' to 3'x16'. I have attached a copy of the survey of the site which I have marked up in red. First of all one should park their vehicle on the opposite side of the road from the site. The site is very over grown with no place to park in front of the property; there are remnants of and old drive which has a chain across the drive. To access the dock I suggest walking down the very steep slope just before you get to the first cottage. Be careful the slope has a lot of fallen leaves on it and I have ended up sliding down the slope at least two times. When you get to the bottom of the slope I usually walk along Mean High Water out to the Creek. There are stairs at the site but they are unsafe. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with LWRP Policy 6.3 and, therefore, INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. The as-built structure was constructed without a Board of Trustee review or permit. An unpermitted structure should be reviewed as if it is not constructed or does not occur on the parcel. How long was the unpermitted dock? Why is further encroachment into public waters proposed? How wide will the vessel be on the end of the dock? Will the dock disrupt tidal flow? If the action is approved, the dock may extend past the pier line on a curve and should be shortened in this narrow navigable water section of Mattituck Creek.
