TERMS AND CONDITIONS
The Permittee Peter Sabat residing at 3000 Beebe Drive Cutchogue,New York as part of the
consideration for the issuance of the Permit does understand and prescribe to the following:
1. That the said Board of Trustees and the Town of Southold are released from any and all
damages, or claims for damages, of suits arising directly or indirectly as a result of any
operation performed pursuant to this permit,and the said Permittee will, at his or her own
expense, defend any and all such suits initiated by third parties, and the said Permittee
assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees
of the Town of Southold.
2. That this Permit is valid for a period of 24 months, which is considered to be the estimated
time required to complete the work involved, but should circumstances warrant, request for
an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to
maintain the structure or project involved,to provide evidence to anyone concerned that
authorization was originally obtained.
4. That the work involved will be subject to the inspection"and approval of the Board or its
agents, and non-compliance with the provisions of the originating application may be cause
for revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work herein
authorized.
6. That there shall be no interference with the right of the public to pass and repass along the
beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations in the
location of the work herein authorized, or if, in the opinion of the Board of Trustees,the work
shall cause unreasonable obstruction to free navigation,the said Permittee will be required,
upon due notice,to remove or alter this work project herein stated without expenses to the
Town of Southold.
8. The Permittee is required to provide evidence that a copy of this Trustee permit has been
recorded with the Suffolk County Clerk's Office as a notice covenant and deed restriction to
the deed of the subject parcel. Such evidence shall be provided within ninety(90)calendar
days of issuance of this permit.
9. That the said Board will be notified by the Permittee of the completion of the work
authorized.
10. That the Permittee will obtain all other permits and consents that may be required
supplemental to this permit, which may be subject to revoke upon failure to obtain same.
11. No right to trespass or interfere with riparian rights. This permit does not convey to the
permittee any right to trespass upon the lands or interfere with the riparian rights of others in
order to perform the permitted work nor does it authorize the impairment of any rights,title,
or interest in real or personal property held or vested in a person not a party to the permit.

Dear Mr. Patanjo:
The Board of Town Trustees took the following action during its regular meeting held on
Wednesday, February 15, 2023 regarding the above matter:
WHEREAS, Jeffrey Patanjo on behalf of PETER SABAT applied to the Southold Town Trustees
for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated September 30, 2022, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
and to the Local Waterfront Revitalization Program Coordinator for their findings and
recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application be found
Consistent with the Local Waterfront Revitalization Program policy standards, and,
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
February 15, 2023, at which time all interested persons were given an opportunity to be heard,
and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold
Town Code,

WHEREAS, the Board has determined that the project as proposed will not affect the health,
safety and general welfare of the people of the town,
NOW THEREFORE __.
RESOLVED, that the Board of Trustees have found the application to be Consistent with the
Local Waterfront Revitalization Program, and,
RESOLVED, that the Board of Trustees approve the application of PETER SABAT for the
demolition of the existing single-story residence and deck with existing foundation to remain as
existing and be re-used for construction of new residence with same footprint (26'x60' irreg.)
and the addition of second story. A 2' x 22' addition will be added to front of house, a 5.3' x 19.5'
addition will be added to south side of house, a 5' x 12' covered porch will be added to front of
house, a new 14' x 19.5' screened porch will be added to south side of house, the existing 8' x
12' sunroom will be removed and replaced with an 8' x 12' open porch, the existing 12' x 16'
wood deck will be removed and replaced with a 12.5' x 14' irreg. bluestone patio. The existing
24' x 24' garage will be demolished and a new 24' x 46' garage constructed to house three cars
and a pool house with 3.7' x 7.7' outdoor shower and patio to serve the proposed 16' x 32' in-
ground swimming pool along with an 8'x6' spa and associated pool backwash drywell and at-
grade 50' x 33' (overall & irregular) bluestone patios. Two 3' x 3' a/c pads will be installed on
north side of house. The existing conventional sanitary system will be replaced with a new low-
nitrogen I/A style system placed in a more landward location than existing. Roof drainage will be
provided to capture all runoff and a silt fence will surround the property until final stabilization is
reached; establish and perpetually maintain a 15' wide non-turf buffer along the wetland line and
have a 4' wide walking path to gain access to the dock. All existing trees will be preserved as
part of this project and no removal of any wetlands or native Baccharis will take place; and as
depicted on the site plan prepared by Frederick R. Weber, Architect, last dated February 8,
2023, and stamped approved on February 15, 2023.
Permit to construct and complete project will expire two years from the date the permit is signed.
Fees must be paid, if applicable, and permit issued within six months of the date of this
notification.
Inspections are required at a fee of$50.00 per inspection. (See attached schedule.)

single-story dwelling and deck with existing foundation'to remain and construct a two-story
dwelling with a 1,778sq.ft. footprint that includes a 2'x22' landward addition; a 5.3'x19.5' south
addition; a 5'x12' front covered porch; a 14'x19.5' screened porch on south side; existing
sunroom to be removed and replaced with an 8'x12' seaward side open porch; existing 12'x16'
wood deck to be removed and replaced with a 12.5'x14' irregularly shaped bluestone patio;
existing 24'x24' garage to be demolished and construct new 24'x46' three-car garage with
attached pool house, a 5.x14' roof overhang and 3.8'x7.7' outdoor shower; install a 16'x32' in-
ground swimming pool and 8'x6' spa; install an at-grade 50'x33' (overall & irregular) bluestone

Jeffrey Patanjo on behalf of PETER SABAT requests a Wetland Permit to demolish existing single-story
dwelling and deck with existing foundation to remain and construct a two-story dwelling with a 1,778sq.ft.
footprint that includes a 2'x22' landward addition; a 5.3'x19.5' south addition; a 5'x12' front covered porch; a
14'x19.5' screened porch on south side; existing sunroom to be removed and replaced with an 8'x12'
seaward side open porch; existing 12'x16'wood deck to be removed and replaced with a 12.5'x14' irregularly
shaped bluestone patio; existing 24'x24' garage to be demolished and construct new 24'x46' three-car garage
with attached pool house, a 5.x14' roof overhang and 3.8'x7.7' outdoor shower; install a 16'x32' in-ground
swimming pool and 8'x6' spa; install an at-grade 50'x33' (overall & irregular) bluestone patios; install a pool
equipment area, associated pool backwash drywell and 4' high pool enclosure fencing; install two 3'x3' a/c
pads on north side of dwelling; abandon existing sanitary system and install a new low-nitrogen I/A style
system landward of dwelling; install gutters to leaders to drywells to contain roof runoff; install silt fencing
before and during construction until final stabilization is reached; and to install and perpetually maintain a 10'
wide non-turf buffer with a 4'wide access path to dock along the landward edge of the wetlands. Located:

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based
upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as
well as the records available to me, it is my recommendation that the proposal is CONSISTENT with LWRP
Policies and with the LWRP.
Retain existing vegetation to protect the wetland.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written
determination regarding the consistency of the proposed action.

At the meeting of the Southold Town Conservation Advisory Council held Thurs.,
November 10, 2022 the following recommendation was made:
Moved by Carol Brown, seconded by John Stein, it was
RESOLVED to SUPPORT the application of PETER SABAT to renovate the existing
single-story residence to include reconstruction of the existing first floor and addition of
second story. A covered porch will be added to the front of the house, the existing 8'X 12'
sunroom will be removed and replaced with an open porch, the existing 13'X 16' wood

After further review of the application referenced above, unfortunately the application will have to be postponed from
the January agenda. After speaking with Trustee Sepenoski today who briefly reviewed the application,the following is
requested prior to proceeding.
• If this project is being deemed a demolition per Town Building Dept. code,then please update the written
project description to state that. Currently the written project description describes a partial demolition to
which this is not verbiage that can be used, please use only additions/alterations or demolition (project meets
Town Code definition of demolition). Is the garage to be proposed as a one-story or two-story, please advise in
the written project description.
• The construction plans require a legend or a call-out of all of the walls,windows, doors, etc. what is to be
removed, remaining, new, etc. for the first story plan. Please submit four(4) updated sets of to scale, stamped
plans as they will need to be given to the CAC and LWRP for their reviews.
• A pier line plan leading from the two closest abutting dwellings and across this property to show that the
proposed dwelling is not being constructed seaward of this pier line. This is a requirement for any demolitions,
or expansions proposed seaward.
• Trustee Sepenoski recommended a non-turf buffer area mimicking the width of the non-turf buffer on the
neighboring property be proposed with a 4'wide access path to dock.
Please submit the requested as soon as possible but no later than January 19, 2023 in order to be considered for the
February 15, 2023 public hearing date and the February 7, 2023 field inspection date. Please remember to stake out all
proposed for the field inspections or the application will be postponed from February's agenda due to not staking out
the proposed.

Regarding the above referenced application,thank you for the submissions and the merging of the two lots. Regarding
the construction plans that Mr.Weber submitted are still incomplete and the Building Dept. cannot make a
determination if any part of this project meets or exceeds their codes. We need full construction plans with legends for
what is staying, going, floor joists, windows, doors, etc., existing structure/elevation proposed structure/elevation, and
now with the new pyramid law that went into effect regarding enlarging dwellings there are other items needed. The
project plans that Fred dropped off did not contain these required items. If Fred Weber is unfamiliar with any of these
items, he is welcome to contact Amanda in the Building Dept. to help. She will better explain what is needed than I can.
At this time, unfortunately the application will have to be postponed until this office receives the required plans in order
to make required determinations.

PROJECT DESCRIPTION
Project includes the renovation of the existing single-story residence to include
reconstruction of existing first floor and addition of second story. A 2' x 22' addition will
be added to front of house, a 5.3' x 19.5' addition will be added to south side of house, a

be removed and replaced with an open porch, the existing 13'x16' wood deck will be
