Box 1179 Southold, New York 11971 Dear Mr. Fish: As a followup to our telephone conversation on July 5th regarding the illegal use of a structure as a guest house on the property of my neighbor, Mr. William Thompson, 650 South Drive, Mattituck, may I ask if you have found the time-to read through the letters and material on file in your office. I have been pursuing this problem with the Building Department since the structure was built in 1984, and although promises were made, no action was ever taken to assure that this building is not used as a guest house. ~ith a new administration now at Town Hall it is my hope that attention will be given to my For the past 10 yea~this "workroom/storage" building has been used for the off-and-on purpose of living and sleeping mn - mostly on weekends. On September 20, 1993, I wrote to Mr. Thompson, being explicit about my protestation of the use of the building and requesting that he cease using it as a guest house. There was no response, and once again, in July 2 and 3 of this year guests stayed in the dwelling. Incidentally, recently a large spotlight was erected on the top of the building to light the road leading to the "house" at night. May I hear from you, Mr. Fish? Hopefully, the file has been preserved (some snapshops should be there too). If you need copies, I can supply you with all correspondence over the years. This situation has gone on for a ridiculously long time. I cannot understand why my complaint has never been addressed. Why has Mr. Thompson never been called to task and told to desist from using that building illegally? Why was a C.O. given for a building and deck built far out of line with the plan (a sketch) filed with the Building Department? If the law is not adhered to, the building should be gutted and beds removed. I shall wait to hear from you, Mr. Fish. You have a file on the situation. I met with you last year on Aug. 10, and at my request you wrote a letter to the judges informing them of their illegal use of their "barn" as a guest house. This past~.weekend, on July 2, 3, and 4, this structure was again used as a guest house with sleeping acc- ommodations. I have 3 witnesses to the fact. Mr. Lessard, it must be evident to you, as it is to me, that ' the intention in building this "storage-warehouse-barn~' was to use it as a guest house and that is exactly what has been going on since it was built. The intent was, and is, fraud and deceit. This is a com- plete small house, with living room, kitchen, bathroom, and a bedroom containing 2 beds. I know, because I have been able to look in the windows and see it all!! I have been in contact with you since July of 1985 about this illegal occupancy. It still continues and is permitted. The Town now has a new Attorney and an Ass't Attorney, and I do expect action to be taken. The Town permitted this structure to be built without checking and inspecting to see that deception was taking place, and then even allowed a "deck" to be built around this "barn!" This must stop. I am angry and discouraged that it goes on and on. Are 2 judges to be permitted to manipulate the law to their advantage? (shame on them!) They are deceiving all of us. Should they be permitted to break the law? I shall call you as soon as I feel you have received this letter. If necessary I can make an appointment to see you once again, or I can make an appointment with Mr. Schondebare, and I expect some- one to tell me what is going to be done. This structure is a "house," and is completely set up to be used as a year-around dwelling. How did this happen? I protest. This "house" abuts my property at the edge of the road that leads into it. I foresee the use of it as a guest house, and even a live-in house as time goes by and no one protests I am protesting and raising questions. Mr. Lessard, will you please inform me how and why this swelling was permitted to be erected, and advise me if legal steps are necessary to file a formal complaint. At my'meeting with you in May you showed me a "sketch'~ which had been submitted as the supposed plans indicating what the structure would look like, and that its purpose would be for a "workshop/storage area. At this point I can only say that you must personally view the "structure" to see that it bears absolutely no relation to that sketch. This building is a "dwelling" with in- sullation, an 8' basement, 2 Anderson windows on each wall and an enormous picture window with glass sliding dooes taking up one whole side. The inside is partitioned into 3 rooms with a loft, and a stove and a refrigerator have been installed. This replaces a "barn~" 1) I have many questions, among them .... The initial "sketch" called for an amount of $10,000 to be the cost of the building. One look will tell you that the cost of this dwelling is at least $40,000. Was not an architect needed for this? 2) It so happens that I have pictures of the "barn" that stood in this location when the property was owned by Mrs. Jean Eginton. It wa.s a barn, no taller than 12' The new structure is 18' high and can in no way be considered a "storage/workshop. Are no interim inspections made to see what is being erected?- and that it might be contrary to law? 3) IS anyone permitted to submit a h%tmble plan such as the one you have which looks like a "barn," and then alter those plans to positively haveevery feature of a "house" or "dwelling?" 4) Is not a variance needed to alter submitted plans, or to erect a "house" on one's property, and,if so, as the next-door neighbor, why was I not asked for such a variance? 5) Without a permit, can anyone erect a "cabana"?
