En-Consultants on behalf of DANIEL McGOVERN & CATHERINE LUCARELLI requests a Wetland
Permit to remove existing 3'x4.5' steps, and construct a fixed timber dock with water and electricity
consisting of a 4'x60' fixed timber catwalk (53' seaward of bulkhead), constructed with untreated
decking (including open-grate decking at least 15' seaward of bulkhead), with two (2) 4'x6' steps for
beach access; a 3'x14' hinged ramp; and a 6'x20' floating dock situated in an "L" shaped
configuration and secured by two (2) 8" diameter pilings. Located: 830 Oak Avenue, Southold.

The proposed dock has been reviewed to Chapter 268, Waterfront Consistency Review of the Town
of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to
this department, as well as the records available to me, it is my recommendation that the proposal
is INCONSISTENT with LWRP Policy 6.3 therefore, INCONSISTENT with the LWRP.
Goose Creek is an NYSDEC Critical Environmental Area; the cumulative impacts of higher
dock density on water quality, wildlife, submerged vegetation, recreation and commercial
fisheries have not been addressed.
In the event that the action is approved, an alternative to CCA treated pilings is recommended.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

assessment is intended to supplement other information used by a Town uutllutct apme—y—in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its significant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

The proposed dock is located along a historically developed shoreline amongst numerous similar dock structures,including the neighboring,Trustees-permitted docks to
the southwest(Permit No.8430)and northeast(Permit No.9284);and it would be consistent in all ways with the'construction and operation standards"for docks set
forth by Town Code Section 275-1 l(C)(2). And although it has been purposefully proposed where there is no wetland vegetation,consistent with"Best Management
Practices,"the dock would not inhibit the potential future growth of intertidal marsh beneath it,as within the intertidal zone,the catwalk will be elevated at least 4 feet
above grade and constructed with light-penetrating open-grate decking at least 15 feet seaward of the bulkhead. Thus,the project would not create a"fragmentation of
ecological communities"along the developed shoreline;result in the physical loss,degradation,or functional loss of ecological components;or otherwise adversely impact
the quality or function of the adjacent tidal wetlands or waters of Goose Creek.

Consistent with Policy 9,the proposed dock would not cause any adverse impacts on existing navigational conditions or otherwise
affect the public and recreational use of Goose Creek. Rather,the dock is proposed along a historically developed shoreline amongst
numerous Trustees-permitted dock structures,including the Trustees-permitted docks to the southwest and northeast. The dock and
associated watercraft would extend seaward a distance well less than one-third the width of the waterway and would be consistent with
the"pier line"along the Oak Avenue shoreline of Goose Creek.
