WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: September 14, 2022 Re: LWRP Coastal Consistency Review for NICOLE MARTORANA & DAVID ALWORTH SCTM# 1000-115-17-11 En-Consultants on behalf of NICOLE MARTORANA & DAVID ALWORTH requests a Wetland Permit to make alterations to the existing two story dwelling consisting of constructing a 9'x14' screened porch addition with 4'x3' steps in place of existing first floor door, basement/bilco door, and stoop/steps to be removed; construct a 7.1'x14.5' wood deck with 3'x4' steps in place of existing 7.1'x8' wood deck and steps to be removed; construct a 4'x6' front entry porch with steps in place of existing porch and steps to be removed; construct a 4'x4' side entry porch with steps; construct two 4'x5' basement egress window wells; construct a 1'0'x14' expansion of the existing second floor over and within the footprint of the existing first story (no increase in bedrooms); install drywell; and to establish and perpetually maintain a 10' wide, approximately 990sq.ft. non-turf buffer (including approximately 420sq.ft. of existing lawn) adjacent to existing covenanted non-disturbance buffer. SCTM# 1000-115-17-11 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with LWRP Policies and with the LWRP. Provided the following is considered to protect the function and values of the wetland system: Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. INSTRUCTIONS 1, All applicants for permits* including Town of Southold agencies, shall complete this CCAF for proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. Before answering the questions in Section C, the preparer of this form should review the exempt minor action list, policies and explanations of each policy contained in the Town of Southold Local Waterfront Revitalization Program. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable i LWRP ADDENDUM FOR NICOLE MARTORANA & DAVID ALWORTH 3400 DEEP HOLE DRIVE MATTITUCK,NY SCTM#1000-115-17-11 Policy 5 & 6 Along with two open entry porches and two basement egress window wells,the project consists primarily of the construction of a waterside porch addition(in place of an existing stoop/steps, first floor door, and basement Bilco door) and a 103 sf waterside deck in place of an existing 57 sf deck. The minimum wetland setbacks to these proposed waterside additions will be no less than the minimum wetland setbacks to the existing structures they are replacing; and consistent with Section 275-11(A)(3),they will be situated well landward of the seaw rojections of the two adjoining dwellings, both of which will continue to project notably er to th adjacent wetlands. Additionally, as mitigation for the proposed construction,a 10-foot ide non-turf buffer is e posed on the landward side of an existing non-disturban er, whose covenanted limit is just et seaward of the waterside of the dwelling. sta s additional buffer within 20 f the house will result in the permanent removal of approximately 420 sf of existing lawn area. Also proposed is an expansion of the existing second floor over and within the footprint existing first floor,which should be considered a permit-exempt activity pursuant to Section 275- 4(A)(1)(j). However, due to the likelihood that this addition will be constructed as part of a single construction phase, it is indicated on the site plan for the purpose of presenting the full scope of proposed exterior work. It should be noted that the dwelling is served by an existing, SCDHS- approved 3-bedroom sanitary system, and no increase in bedrooms will result from the proposed renovations. Moreover, a drywell is proposed to capture and recharge roof runoff. Therefore,the proposed work will result in no change to the habitable dwelling footprint; no change in wetland setbacks; and a minimal increase to lot coverage(172 sf),while resulting in almost 1,000 additional square feet of buffer area adjacent to the wetlands. The project will thus have a net beneficial impact on the adjacent tidal wetlands and Town waters; and it will be consistent with the LWRP Policy 5 and 6 goals of protecting water quality and the function and quality of the adjacent tidal wetland ecosystem a --SEE ATTACHED ADDENDUM ADDRESSING POLICIES 5 &6-- Attach additional sheets if necessary Policy 7.
