En-Consultants on behalf of MARILYN PYMM IRREVICABLE FAMILY TRUST requests a Wetland
Permit to install approximately 78 linear feet of 200-500 pound stone rip-rap (over filter cloth) along
toe of eroding embankment (±48 linear feet adjacent to James Creek and ±30 linear feet adjacent to
Peconic Bay); and restore embankment face with approximately 10 cubic yards of clean sand fill to
be trucked in from an approved upland source and planted with Cape American beach grass 18" on
center. Located: 2504 Camp Mineola Road Ext., Mattituck. SCTM# 1000-122-9-7.25
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department, as well as the records available to me, it is my recommendation that
the proposed action is INCONSISTENT with LWRP Policy 6.3 and therefore, INCONSISTENT with
the LWRP.
4.1 Minimize losses of human life and structures from flooding and erosion hazards.
The use of vegetation only to control erosion is recommended to further policy 4.
B. Use vegetative non-structural measures to manage flooding and erosion hazards.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS
1 , All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
malting a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nig f cant
beneficial and adverse effects upon the coastal area(which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.

Policy 4&6
The purpose of the project is to revegetate, restore, and provide long term stabilization of two
areas of severely eroding embankment located between the beach and upland. These
embankment areas are located on either side of a seaward protruding portion of the property that
fronts Peconic Bay to the south and James Creek to the north and west, making it susceptible to
waves created both by storm action and the adjacent, highly trafficked navigational channel.
Specifically, the project proposes to stabilize and protect the embankment toe with stone rip-rap
and restore the eroded embankment face with clean sand fill and native vegetation. The rip-rap
will allow the fill and plantings to become successfully established in the short term and provide
a reasonable measure of long-term protection against further erosion, which if left unabated
would allow the continued loss of upland and create increased potential for flood and erosion
damage to the existing swimming pool and other structures. The project thus combines
vegetative resource enhancement with hard stabilization to minimize the potential loss of
structures and natural resources from flooding and erosion, consistent with Policy 4. And
consistent with Policy 6, the project would be situated entirely landward of the lines of mean
high and spring high water and would not cause significant adverse impacts on the quality or
function of the adjacent ecosystem.
