ESSEKS & KATHRYN R. STOKES SCTM# 1000-64-1-14.7 Costello Marine Contracting Corp. on behalf of DAVID C. ESSEKS & KATHRYN R. STOKES requests an Amendment to Wetland Permit#5974 to rotate the existing 6'x20' floating dock to form a straight "I" configuration, and to reset the two (2) float pilings and the two (2) tie-off pilings. Located: 522 Town Creek Lane, Southold. SCTM# 1000-64-1-14.7 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed actions are INCONSISTENT with the below listed LWRP policies and therefore is INCONSISTENT with the LWRP: Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems 6.3 Protect and restore tidal and freshwater wetlands. 1. The littoral zone provides important functions and values to the marine wetland system species (shelter, food supply and habitat). 2. Severe erosion is not occurring indicating there is not a need for an erosion control structure. 3. Vegetation planted on the littoral shelf(spartina alt.) is a better option and furthers Policy 6 of the LWRP program. See properties to the east. 4. The introduction of a CCA treated materials into a living ecosystem has an adverse impact on the species within that ecosystem. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed actions. This assessment is intended to supplement other information used by a Town of Southold agency in making a determination of consistency. *Except minor exempt actions including Building Permits and other ministerial permits not located within the Coastal Erosion Hazard Area. 2. The wall will replace existing sections of retaining wall that are deteriorating due to age. This structure is minor in nature and reasonable for this location.
