SCTM# 1000-81-1-18.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is CONSISTENT with LWRP Policies and with the LWRP. Turbidity controls are required. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ®Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR PECONIC RIVER LLC 450 BASIN ROAD SOUTHOLD, NY Policy 4 & 6 The project seeks to replace an existing bulkhead and retaining wall in their current locations to maintain the property's historical method of protection against erosion and flooding and stabilization of the naturally vegetated embankment landward of the bulkhead. The site has been supported and protected from flooding and erosion by bulkheading on the east side of the property since prior to 1966 and on its west side since 1973; and the seaside embankment on the east side of the property has been stabilized by the retaining wall to be replaced since prior to 1994. The retaining wall on the west side of the property, which was installed not at the top of the bank but near the bulkhead as part of a storm damage repair project in 1994 (see Town Wetlands Permit No. 4382), can now be removed and the embankment slope re-graded, planted, and re-naturalized. There is, however, no viable non-structural alternative means of maintaining the shoreline and protecting the upland portion of the property in its current location without replacement and maintenance of the bulkhead, as without it the subject property and adjacent, bulkheaded properties would be exposed to severe erosion, flooding, and potential damage to the residential structures located thereon. And without replacement of the easterly retaining wall, the higher and wider embankment on that side of the property would become destabilized and more susceptible to runoff, erosion, and slumping. To mitigate against potential impacts associated with construction, the disturbed portions of the embankment will be restored/replanted and permanently maintained as a vegetated buffer, as recently required by Town Wetlands Permit No. 9930; and the 10' wide non-turf buffer required by the same permit to be established along the landward edge of the existing easterly retaining wall will be established adjacent to the replacement wall. Thus, consistent with the goals of Policy 4, the project combines maintenance of hard erosion control structures with vegetative resource enhancement to minimize the potential loss of structures and natural resources from flooding and erosion. And consistent with Policy 6, the project is designed to protect and restore the quality and function of the naturally vegetated embankment and the adjacent tidal waters of Southold Bay.
