KIMOGENOR POINT COMPANY requests a Wetland Permit to construct a continuous 189 linear
foot long vinyl bulkhead in place of, and partially landward of±59' and ±130' sections of existing
timber bulkhead to be removed, and permanently remove ±2' section of existing timber bulkhead to
eliminate "bumped out" portion of bulkhead; excavate up to ±18" wide, approximately 100sq.ft. area
between existing 130' "bumped out" section of bulkhead and proposed vinyl bulkhead to a
maximum depth of-3' MLW to match existing seaward grade; use approximately 25 cubic yards of
excavated on-site material and approximately 50 cubic yards of clean sand to be trucked in from an
approved upland source as backfill; remove and replace existing ±65 linear foot long timber jetty
with vinyl jetty; and remove and replace in-place existing 16'x16.5' fixed dock platform (using
untreated decking). Located: 50 Jackson Street, New Suffolk. SCTM# 1000-116-6-24.1
The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the
Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy
Standards. Based upon the information provided on the LWRP Consistency Assessment Form
submitted to this department and the records available to me, it is my recommendation that the
proposal is CONSISTENT with LWRP Policies, and with the LWRP.
1. Requires the use of turbidity controls.
2. Reduce CCA treated materials in construction.
3. Incorporate native vegetation in design.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

LWRP CONSISTENCY ASSESSMENT FORM
A. INSTRUCTIONS )
1.. All applicants for permits* including Town of Southold agencies, shall complete this CCAF for
proposed actions that are subject to the Town of Southold Waterfront Consistency Review Law. This
assessment is intended to supplement other information used by a Town of Southold agency in
making a determination of consistency. *Except minor exempt actions including Building Permits
and other ministerial permits not located within the Coastal Erosion Hazard Area.
2. Before answering the questions in Section C, the preparer of this form should review the exempt
minor action list, policies and explanations of each policy contained in the Town of Southold Local
Waterfront Revitalization Program. A proposed action will be evaluated as to its si nificant
beneficial and adverse effects upon the coastal area (which includes all of Southold Town).
If any question in Section C on this form is answered "yes" or "no", then the proposed action will
affect the achievement of the LWRP policy standards and conditions contained in the consistency
review law. Thus, each answer must be explained in detail, listing both supporting and non-
supporting facts. If an action cannot be certified as consistent with the LWRP policy standards and
conditions, it shall not be undertaken.
A copy of the LWRP is available in the following places: online at the Town of Southold's website
(southoldtown.northfork.net), the Board of Trustees Office, the Planning Department, all local
libraries and the Town Clerk's office.

For the purpose of maintaining the property's historical method of protection against erosion and flooding and stabilizing the adjacent
beach and navigational channel,the project proposes to replace and maintain an existing jetty and sections of bulkhead that were
constructed in 1965 and since maintained pursuant to Southold Trustees Permit Nos. 73 (59'bulkhead, 1985),3891 (130'bulkhead,
1991),and 4527 (jetty, 1995). There is no viable non-structural alternative means of maintaining and protecting the property,the beach,
and the adjacent navigational channel in their current locations;and without such maintenance,the subject property and beach would be
subject to increased erosion;the residential structures located thereon would be exposed to potentially severe flooding and erosion
damage;and the adjacent navigational channel would be subject to potentially severe shoaling.

"bumped out" 130'section of bulkhead that resulted from a seaward replacement of the originally constructed bulkhead in 1991. The
proposed design thus pulls that section of bulkhead landward and into its original alignment with the 59'section of bulkhead and 65'
jetty to be replaced,thereby creating a reduced upland footprint and greater surface water area. And all of the existing treated bulkhead
sheathing and treated dock platform decking will be replaced with untreated sheathing and untreated decking.
