Main Rd. &Youngs Ave.) Southold, NY 11971 ® Telephone: 631 765-1938 c®U ,� LOCAL WATERFRONT REVITALIZATION PROGRAM TOWN OF SOUTHOLD MEMORANDUM To: Glenn Goldsmith, President Town of Southold Board of Trustees From: Mark Terry, AICP LWRP Coordinator Date: November 10, 2022 Re: LWRP Coastal Consistency Review for DANIEL & SUZANNE DIVINEY SCTM# 1000-43-5-8 En-Consultants on behalf of DANIEL & SUZANNE DIVINEY requests a Wetland Permit to demolish and remove existing 1,345sq.ft. two-story dwelling with attached deck, and remove existing shed; construct a new two-story, single family dwelling with a 1,516sq.ft. footprint and 341sq.ft. attached garage with 39sq.ft. concrete apron, stoop and steps beneath 92sq.ft. front roof overhang, 410sq.ft. deck (with balcony above), and 4'x4.25' steps, 123sq.ft. screened porch (with balcony above), and 4'x4.25' steps, and 112sq.ft. second-story deck/balcony; install 112sq.ft. pavers-in-sand patio, 4'x4' outdoor shower enclosure over gravel (piped to proposed drainage system), HVAC, and buried utilities, replace existing concrete driveway with pervious gravel driveway; remove existing septic system and install new I/A OWTS sanitary system; install a stormwater drainage system; and to establish and perpetually maintain a 10 foot wide, approximately1,385sq.ft. vegetated buffer adjacent to the tidal wetland boundary (including existing vegetation to remain undisturbed). SCTM# 1000-43-5-8 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposal is INCONSISTENT with LWRP Policies and with the LWRP. 1. The increase in structure in FEMA flood zones is not supported by Policy 4. The structure is located in an AE EI 6 flood zone. See the map below. 2. Structure in Special Flood Hazard Areas should be minimized to lessen the impacts and loss from repetitive storm events. SFHAs are defined as the area that will be inundated by a flood event having a 1-percent chance of being equaled or exceeded in any given year. Y1> - t f 1% _ _ y 24 - g., Eutrophic.Conditions Due to the proximity to ground and surface waters (Note that the surface water body shows evidence of high nutrient loading due to the amount of floating vegetation due to poor flushing). It is recommended that the Board consider requiring the following conditions on the parcel to further Policy 5 and Policy 6 and protect water quality: 1. Establishment of a 30' wide non-fertilized, landscaped buffer landward of the wetland line (Figure 1). Chapter 268 of the Southold Town Code defines a landscape buffer as: LANDSCAPED BUFFER-A land area of a certain length and width which is planted with indigenous, drought-tolerant vegetation similar to that found within the immediate proximity of the parcel. Vegetation shall be installed in sufficient densities to achieve 95% ground cover within two years of installation. Survival of planted vegetation shall be 90% for a period of three years. Maintenance activities within the buffer are limited to removing vegetation which is hazardous to life and property, trimming tree limbs up to a height of 95 feet to maintain viewsheds, replanting of vegetation and establishing a four-foot-wide access path constructed of pervious material for access to the water body.
