SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated September 23,2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 29,874 square foot parcel located in an R-40 zoning district. The parcel runs 74.49 feet along Main Road, 400.01 feet on the West side, 75 feet on the North side, and 399.50 feet on the East side. The parcel is improved with a two-story frame dwelling with attached enclosed porch and framed accessory garage. All is shown on a survey by Ward Brooks L.L.S. last revised May 16, 2021. BASIS OF APPLICATION: Request for Variances from Article III, Section 280-15; Article XXIII, Section 280- 124; and the Building Inspector's August 18, 2022, Notice of Disapproval based on an application for a permit to construct a second floor addition on an existing single family dwelling and to legalize an "as-built" pergola on an existing accessory structure at; 1) dwelling is located less than the code required minimum side yard setback of 15 feet; 2) pergola is located less than the code required minimum side yard property line setback of 10 feet; located at: 16045 Main Road,Mattituck,NY. SCTM No. 1000-115-1-7. RELIEF REQUESTED: The applicant requests a variance to construct a second-floor addition and rebuild the existing enclosed porch(sunroom)as living space with a minimum side yard setback of 13.57 feet where Town Code requires a minimum side yard setback of 15 feet. The applicant also requests a variance to legalize an "as-built" pergola, adjacent to but not physically connected to the as built accessory garage and accessory apartment, with a side yard setback of 4.41 feet where Town Code requires a minimum side yard setback of 10 feet for accessory structures. ADDITIONAL INFORMATION: The applicant has the benefit of ZBA Special Exception#7508SE dated October 7, 2021 for an accessory apartment in an accessory garage on the applicants' property. The parcel has the benefit of Pre-existing Certificate of Occupancy No.37433 for a single-family dwelling which includes a list of Certificates of Occupancy; no. Z3579 for addition to dwelling,No. 3773, for accessory garage, and No.Z3935 for swimming pool. J Page 2,January 19,2023 #7726,Kiely SCTM No. 1000-115-1-7 The actual Certificate of Occupancy #Z3579, dated August 29, 1969 reads "Private One Family Dwelling", Certificate of Occupancy#Z3935,dated August 12, 1970 reads"Private One Family Dwelling with Accessory(Swim Pool)",Certificate of Occupancy Z11020,dated June 4, 1982 reads"An Accessory Garage". Building Permits have been issued for improvements to the single-family residence and the installation of an accessory swimming pool. The applicant has received letters of support from neighbors. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2022 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a mixed-use neighborhood consisting of agricultural parcels, an insurance office, a school, and single-family homes that were constructed prior to zoning. The size of the proposed single-family dwelling is comparable to other dwellings along and near Main Road. The pergola is an open wood structure over an existing at grade patio, does not have a roof, and is a common sunshade device on many homes and decks or patios throughout the town. Moreover, the pergola is located in a conforming rear yard, behind the as built accessory apartment/garage and is not visible from Main Road or adjacent properties. 2. Town Law &267-b(30)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could construct the second-floor addition at a conforming side yard setback of 15 feet. However, the proposed second floor addition maintains the same setback as the first floor below. However, the "as-built" pergola existed when the prior side yard setback variance for the accessory garage/apartment was approved by this Board, and, had it been physically attached to the accessory garage/apartment,this current variance request for the same non-conforming side yard setback would not be required. 3. Town Law §267-b(3)(b)(3). The variances granted herein for the second-floor addition's side yard setback is mathematically substantial, representing 10% relief from the code. The variance granted herein for the non- conforming pergola side yard setback is mathematically substantial representing 56%relief from the code. However, the non-conforming side yard setbacks are in line with legally existing non-conforming side yard setbacks of existing structures on the property. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law _§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second story addition and accessory pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried,to r' Page 3,January 19,2023 #7726,Kiely SCTM No. 1000-115-1-7 GRANT the variances as applied for, and shown on the Architectural Plans (Sheets G001, G002, D101, D102, A101 thru A501) prepared by Nicholas Mazzafarro, P.E., last revised August 18, 2022, and on a survey prepared by Ward Brooks L.L.S., last revised May 16, 2021. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variances)granted herein as shown on the architectural drawings,site plan and/or survey cited above,such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses,setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three(3) consecutive one (1)year terms. IT IS THE PROPERTY OWNER'S RESPONSIBILI-TY TO ENSURE COMPLIANCE WITH THE CODE REQUIRED TIME FRAME DESCRIBED HEREIN. Utility Bills Appeals Zoning Board of App SECOND FLOOR LOFT: Town code on accessory apartments states in §28 - e "The entirety of the living floor area of the accessory apartment must be on one floor of the accessory structure" At the public hearing,the applicant submitted floor plans and elevations dated 6/3/2021 but unsigned and unstamped by an unidentified architect/designer,along with a perspective rendering of the proposed second floor open loft space and full interior staircase.The open loft area is proposed to be finished and conditioned,and the proposed attic storage will be unconditioned space. The applicant's mother,who will be in residency with the applicant's father,testified that she wanted to incorporate shed dormers on the second story level for natural light and ventilation and that a full staircase to the proposed storage loft was necessary for the comfort,convenience and safety of herself and her husband. It was discussed at the hearing by the Board that storage areas could only be accessed through a pull- down interior staircase since a full staircase leading to a second floor constitutes a non-permitted habitable use on more than one floor.Additionally,since the applicant is proposing a conforming 586 square foot habitable apartment on the first floor,they can add an additional conditioned storage area on the first floor to the footprint of the as built garage to provide the accessible storage space they require. Moreover,shed dormers and a cathedral ceiling in the proposed apartment can be designed without creating non-conformity to provide the light and ventilation that the applicant's mother stated she desires. AMENDED FLOOR PLAN: Pursuant to condition Kone)of the July 15,2021 ZBA approval of the Special Exception for the subject Accessory Apartment,the applicant submitted an amended floor plan,last revised dated August 24,2021 prepared by Anthony Henry Andrews,LPE. In the revised floor plan the applicant removed the non-conforming loft space and relabeled it iinflshed attic storage,and added a room.on the first floor labeled"conditioned storage"on the West''side of the building. During the September 16,2021 Special Meeting of the Zoning Board of Appeals,the Board Members reviewed the amended building plans dated August 24,2021 and sent a letter to the applicant dated September 21,2021 explaining that although the August 24,2021 amended plan, as required in the conditional approval for the proposed accessory apartment, does not exceed the square footage df'the code permitted maximum livable floor area for an accessory apartment in an accessory structure, it now depicts a fully conditioned habitable second room addition accessed through the great room that, although labeled as conditioned storage, includes windows and exterior French doors that could possibly be used as a second bedroom,which is not permitted by code.
