SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23,and the Suffolk County Department of Planning issued its reply dated August 30,2022 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 21,006 sq. ft. parcel located in an R-40 Zoning District. The property has a 103.81 feet of road frontage along Haywaters Drive, then turns west 245.31 feet towards Mud Creek, then has 101.49 feet of frontage along Mud Creek before returning east for 251.88 feet back to Haywaters Drive. The property is improved with a two-story frame residence, an existing accessory garage with sunroom,and a frame shed;all as shown on survey prepared by Nathan Taft Corwin,III,L.S. last revised August 3, 2022. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-123 and the Building Inspector's July 6, 2022 Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing accessory garage at; 1) a non-conforming building containing a non-conforming use shall not be enlarged, reconstructed, structurally altered or moved, unless such building is changed to a conforming use; located at: 590 Haywaters Drive, Cutchogue,NY. SCTM No. 104-5-22. RELIEF REQUESTED: The applicant requests a variance to alter the as built frame garage by removing the existing pitched roof and installing a flat roof, and replacing the attached sunroom with a screened porch,thereby continuing a nonconformity, since the building may not be enlarged or structurally altered according to Section 280-123 of the Town Code. However, reducing the height of the roof, creates less nonconformity with the Town Code. AMENDED APPLICATION: During the hearing,the applicant was asked to amend the architectural plans to add a solid visual screen to the proposed roof top deck to block views between the subject property and the adjacent property to the north. The applicant,on January 9,2023,submitted Architectural Plans prepared by William S.Ryall, Jr, Architect, depicting a solid wood privacy screen at 7 ft. 7 in. high from the proposed roof deck floor along the northerly edge of the proposed deck. Page 2,January 19,2023 #7722, Eckstrom-Saavedra SCTM No. 1000-104-5-22 ADDITIONAL INFORMATION: In both oral and written testimony from the applicant's agent, the project was described as removing the existing pitched roof on the garage, and replacing it with a flat roof to take advantage of the views of the creek. There was discussion of privacy with the adjacent neighbors to the north, and the applicant subsequently submitted revised plans showing a privacy screen on the north side of the garage roof. The neighbors spoke against the project as per the privacy issues brought up in the hearing. In discussions during the hearing, it was agreed upon that a privacy screen between the properties would be an acceptable solution to this issue. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2023 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law§267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Replacing the existing pitched roof of the accessory garage with a flat roof will reduce the elevation and will result in less mass which will reduce the visual impact of the existing accessory garage 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. Due to the fact that the as built structure is non-conforming, any change proposed for the structure, even within the allowable setbacks,would require an area variance. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 100%relief from the code because the code states that any change to the non-conforming building is not allowed unless it is changed to a conforming use. However, the applicant is proposing to bring the accessory building into more compliance with the code by replacing an existing first floor attached enclosed sunroom with a proposed screened porch which is more conforming to the code. Moreover, removing the existing sloped roof, and replacing it with a flat roof,containing a deck with a privacy screen would lower the profile of the existing structure and thereby lessen the visual impact. . 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and conditions of this Board. In addition,the proposed deck will provide an outdoor recreational space that avoid adverse impacts to the extensive wetlands on the rear(seaward side) of the dwelling. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6.Town Law§267-b. Grant of the relief based on the amended plans,is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a second-floor outdoor deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13,motion was offered by Member Lehnert, seconded by Member Weisman(Chairperson),and duly carried,to .t, Page 3,January 19,2023 #7722, Eckstrom-Saavedra SCTM No. 1000-104-5-22 GRANT relief as applied for, based on AMENDED plans drawn by William S. Ryall, Jr., Architect, last revised January 9, 2023. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The subject accessory garage shall remain'unconditioned, non-habitable space, used for storage and a screened porch only, and no plumbing shall be installed. 2. The proposed solid wood privacy screen shall be installed prior to the issuance of a Certificate of Occupancy. 3. The proposed roof deck shall remain open to the sky 4. The proposed 20'-9"x 22'-2"roof deck shall not be enlarged. 5. The applicant shall submit a Declaration of Covenant and Restrictions to the Zoning.Board of Appeals to the satisfaction of the Town of Southold Town Attorney,and filed with the Clerk of Suffolk County that memorializes.the above conditions and the Amended Plans depicted herein. This approval shall not be deemed effective until the required conditions have been met.At the discretion of the Board of Appeals,failure to comply with the above conditions may render this decision null and void That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. IMPORTANT LIMITS ON THE APPROVAL(S) GRANTED HEREIN Please Read Carefully Any deviation from the survey,site plan and/or architectural drawings cited in this decision, or work exceeding the scope of the relief granted herein, will result in delays and/or a possible denial by the Building Department of a building permit and/or the issuance of a Stop Work Order, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings,site plan and/or survey cited above, such as alterations, extensions, demolitions, or demolitions exceeding the scope of the relief granted herein, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. TIME LIMITS ON THIS APPROVAL: Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. "The intended use will most likely require demolition of the existing structure" The garage will not be demolished but reinforced.As stated in the application,the existing sun- room will be demolished with a screened porch built in its place.The concrete slab of the sun- room will be removed and pavers set-in-sand will be installed in its place,thereby improving permeability on the site. 3. "(a)second story deck...existed on the main house prior to the applicant's renovation" It is not correct that there was an existing deck on the house before the renovation.There was a decorative railing around the flat roof area facing the street-but this roof area was not accessible from either the house or from the exterior ground level. 4. `7f the issue is water view,the applicant's backyard has sufficient room for a deck or patio with unobstructed views of water" Naturally,having views to the water is a concern for the owners of this property—this is the primary reason why people want to live in this beautiful coastal area.The neighbors to the north and south of our client's property currently enjoy raised decks facing the water.The back yard of our client's property is within the required wetlands setback area and the vast majority of it is within the AE flood zone. The structure that the applicant is seeking to alter sits less than five feet from my southern property line. Currently the structure is utilized as a one-story garage. We learned of this application when we recently saw a sign posted at the property for the public hearing on January 5, 2023. I understand that the Town Code requires certified mailings to the surrounding landowners for variance applications. We have not a received a notice and are concerned that the other surrounding landowners have not received notice. The applicant seeks to remove the roof from the existing garage and create what is, in effect, an elevated deck on the new second floor of the garage. This second story deck would sit approximately ten feet off the ground covering the footprint of the existing garage and"sun- room". The proposed deck would look directly over my backyard and into my house as the building is less than 40 feet from my house. The proposed use of the structure creates privacy issues as anyone using the structure looks directly over my back yard and into my house. This proposed use would seriously diminish the value of my property due to the privacy issues it creates for the use of my backyard and house. We would like to submit an expert report as to effects this intended use will have on the value of my property. The applicant's statement that the intended use would"decrease" and"reduce"the size of the structure is not true. Currently the structure is used as a one-story garage with a gable roof and shed roof over the one story"sun-room". The intended use would create a second floor over both structures thereby doubling the floor area of the structures. The intended use will most likely require demolition of the existing structure to create the necessary support for the proposed second story deck. The existing sunroom would not support a second floor and would have to be completely demolished. L l The intended use is not in keeping with general character of the neighborhood. The neighborhood generally consists of one to two story houses some with detached garages with gable roofs. The intended use would create a structure consisting of a garage area at ground level with an oddly shaped second story structure to accommodate stairs and entry to the second story deck(see plan#submitted with application) along the lines of something that might be more commonly found at the New Jersey Shore. --AI�/ The applicant's statement that the existing use creates a hardship is not true. If the applicant wished to have second story deck, one existed on the main house prior to the applicant's renovation(see attached). This consisted of a deck area surrounded by a railing with room for an accessory door leading to the house. The accompanying current photo of the house reveals the flat area at the second floor that was a deck. This area could be easily modified to restore a deck similar to what existed previously without impinging on the privacy and use of the adjoining property. If the issue is water view, the applicant's backyard has sufficient room for a deck or patio with unobstructed views of water. We are also concerned with the applicant undertaking this construction. When the applicants purchased property and began the complete renovation of the house, which took several years, they neglected to maintain the property. The premises lawn was not maintained for an extended period of time, fall leaves were not removed, construction materials and debris were left strewn about the property.
